Legitimate sellers of gift cards can offer unlimited warranty periods.

it cant be legit if someone sells a 100$ voucher for 25$

24 hours is ridiculous. Even if you ordered something from starbucks online it wont be shipped it 24 hours.

but you can spend these vouchers for 3gallons of cofee
i know people who can make that easily
within 24hr  :D

Why would you use 1$ for the escrow ? There are lots of escrows which offer free service and will require no fees. And I don't think anyone will be able to use a Starbucks card with 100$  within 24 hours.

are there really legit escrow middlemans who do not take fees?

Yes, there are people who essentially do it for free just to keep the community safer. If you go to the escrow list https://bitcointalk.org/index.php?topic=108716.0 , you can see many escrows are willing to do it for Free.
