This gave me the impression it was a low-budget operation with little commitment from the operator. Not sure if those things make it a scam, but non-payment puts it a whole lot closer. Did you try emailing the operator? Hrm, I hadn't even noticed this company until you pointed out it is now in the DeathMarket. Who sets up a whole new forum just to post information about a mining company share? A simple static webpage would have been better. It might be a tip-off that something is fishy when there are typos in the contract. And who puts a smiley in a contract? I wouldn't touch those shares with a ten foot pole. There is suspicion that the funds were in BS&T as dividend payment stopped when it closed down.

I don't think so, a lot of the bad stuff is clearing or has been cleared out, whats left and what is being added is of much better quality. Also, the distinction between new with the ability to move to white or blue markets eventually and securities that will never be able to advance may be a handy feature.
