Now she's trying to seize a hotel worth 1.5 million because guests have committed drug related crimes.

Ah yes, the old "crimes have happened here, thus the owners are in on the crimes" property/asset forfeiture abuse the government NEVER abuses.

It's shit like this why I consider myself Libertarian.  mo state, mo problems.

There is nothing worse out there for the citizens of any country when bureaucrats such as this lose sleep over knowing people can make their own choices.

As the prosecutor emphasized to the judge, the burden in this trial is on Caswell to prove he’s an innocent owner.

Such are the new Intolerable Acts, which are forming the basis for justifying a second American Revolution.

The King's Men will respect our Liberty, or die for their transgressions.

Ain't that the truth: the only reason bureaucrats fight against the rightful freedoms of the citizens is that they think they have something better.

They're fighting to establish fascism or a monarchy – still haven't learned the lessons of history.

Please: have the means to defend yourself. Be prepared. But oh, don't be the instigator of bloodshed. Our cause is just. There's nothing that needs to be proven. The usurpers will trip themselves up and reveal their true nature even without our help.

(Shooting somebody in the name of freedom would be just what Obama wants!)

It wil be interesting how this plays out, but honestly, it's really horrible. I won't even start to say what some people may do if the state take their property. For sure, that's not how you make friends..

Silly Americans.

Asset forfeiture is not an American only problem.

Silly Americans.

Asset forfeiture is not an American only problem.

What countries do it ? I have heard Argentina and Venezuela ?

It's wrong either way, and should be fought at all costs.

The way I see it, every government world wide is capable of it.

Whether through forced acceptance of compensation or outright confiscation of land.

It is as it ever was. "Legal plunder" is the aim of the state.

any one want to go to Ms. Ortiz house with me to make a drug trade in her front yard so we can see if she will attempt to have her own property confiscated by the government?

In Slovakia, the gov. stole the land from people to build a highway. 10 years ago. Some of the people still did not get any money.

Crime is everywhere.

Just the other day I went to a surgery room and a guy in a mask pulled a knife on me!

Amendment 4 - Search and Seizure. Ratified 12/15/1791.

Amendment 5 - Trial and Punishment, Compensation for Takings. Ratified 12/15/1791.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

This does not apply in this case ?

Great news! Thanks for sharing. Well done on the motel owner to stand up against Ortiz.

Her spokeswoman declined comment on the Caswell case last night, saying prosecutors are reviewing the judge’s decision.

'Her spokeswoman' ? She can't speak for herself? Geez....

Thank you again for the update.  So glad to hear that incompetent cunt got smacked down in court.

Were I the hotel owner or a surviving relative of Swartz, I would have sufficient standing to go after her bar card.

It wouldn't be easy, but discovery is a powerful tool.

Prosecutorial immunity is not absolute.  Just ask old Mike Nifong!   ;)

Now here's justice for you:

All those Duke Lacross players will be marked for life by the court case. You know their names are all over the internet now. Oh, and have they been compensated for that?

Mike Nifong, on the other hand, "will not be eligible to regain his license until 2012." (http://en.wikipedia.org/wiki/Mike_Nifong) Did he compensate the Duke team for what he did? How about some jail time? (Contempt of court would be appropriate.)

And Carmen Ortiz isn't facing any disciplinary action either. The motel owner is suing the US Government for damages...$600,000 isn't going to break the US Government but it may anger them. The motel owner is playing a dangerous game tweaking Uncle Sam's nose.

It is stories like this that make me think bitcoin will be huge. The government can't seize your bitcoins (that you don't disclose at least). They can take your house, car, bank accounts, etc. But if you rent your house, have a used car, no substantial bank accounts, they will leave you alone.
