I have no objection to the first, but unless that design was actually stolen (if it was, disregard what I'm about to say :) ), it looks fine to me. Not writing CSS from scratch does not necessarily mean that you're stealing work. There are plenty of CSS frameworks available out there that anyone can use for web development.
