Title: [2018-03-20]Ukraine to Compensate a Citizen in Bitcoin – for ”Moral Damages” Post by: Yaunfitda on March 20, 2018, 09:56:34 AM Sounds interesting,
Quote Ukraine to Compensate a Citizen in Bitcoin – for ”Moral Damages” A district court in Kiev Oblast has accepted a lawsuit which is setting a precedent in Ukraine. The plaintiff seeks compensation in bitcoin for “moral damages” caused by law enforcement officials. A preliminary hearing has been scheduled after the presiding judge found no legal grounds to reject the claim. Setting a Precedent For the first time in Ukraine’s judicial practice, a claim for compensation in cryptocurrency has been accepted by a local court. Ukrainian citizen Dmitriy G. wants to be paid 1 BTC for “moral damages” he suffered in result of an “unlawful” search. He is suing officers from Ukraine’s Security Service (SBU) and their colleagues from the Prosecutor’s Office who conducted the operation. https://news.bitcoin.com/ukraine-to-compensate-a-citizen-in-bitcoin-for-moral-damages/ Yeah, I never heard such precedence before so I guess cryptoverse needs to monitor what will be the outcome of the verdict in this one. He is settling for 1 BTC which I think is very big amount for moral damages. Let's see how it goes, I don't think that this will bring any weight in the US justice system though. In Ukraine there are no fair courts so the decision will be very controversial. Any decision of the court of first instance may be set aside by the court of appeal. Also in Ukraine it is very difficult to get a large sum for moral damage. It seems to me that this is a PR in order to draw attention to the problem of the use of cryptocurrencies in Ukraine.

But this kind of publicity is good for bitcoin and crypto in general. At least it somewhat attracts attention and maybe Ukrainian will find a way to put money in crypto out of curiosity.
Yeah, there's no precedence here, just normal case that will ended up in the thrash anyways. And I don't think its worth to watch how this case will end up. Adoption of the claim for proceedings by the court does not mean anything. The court could not say anything about the compensation of moral harm in Bitcoin at this stage. He must take action against the proceedings, if the rule of the civil procedure code on the general rules for filing a claim is not violated. And in this article there is no mention of the currency in which compensation for moral damage should be expressed. The lawsuit in bitcoin will be unequivocally rejected at the stage of making the decision. In Ukraine there is no independent and fair justice now.

Yes, most likely this is the case. Ukraine has no legislation on crypto-currencies, and bitcoin is not recognized as a payment system, as, for example, in Japan. Payment of the claim in bitcoins will be considered illegal in any case, not to mention the corrupt judicial system and other aspects.
