The fan wasn't working and I had to change the bios to run the card
It was the bios of a 5870. saykor don't send the BTC, he is not responding to my email since 2 days... I had 370 MH/s per card at 70°C." Sorry I didn't make this public earlier: I didn't want to wrongly accuse the seller of something I wasn't sure of.
