The law prohibits them from giving a rating until they have done an analysis. Pretty hard to do an analysis when you don't know what the final legislation is going to be.
Secondly, mortgage backed securities where rated AAA ...how did that where out? Some AAA MBS experienced 80% default rates within 90 days of being given that rating!
