Post by: pekv2 on August 10, 2011, 08:56:34 PM
Think they are going start loading the 5830's again? They show up, even with add to cart button, then look at second image to see what happens when add to cart button is pressed.

Sure is.

Bait-and-switch is a form of fraud, most commonly used in retail sales but also applicable to other contexts. First, customers are "baited" by advertising for a product or service at a low price; second, the customers discover that the advertised good is not available and are "switched" to a costlier product.

I did get upset as I posted a request loan thread, right after that, I tried to add it to cart to get grand total to get a newegg gift card, it threw me that error of the second screenshot, then i had to close and lock my request loan thread.

It qualifies as bait and switch if they add a different item to your cart, not fail to add it at all.  That is false advertising.  Yes, listings on newegg are "advertising."  If it pleases the court, I'd like to cite as precident someone vs someone else in which it was ruled many years ago that you must add a "see price in cart" option for certain items because newegg has agreements with suppliers not to "advertise" a lower price than $xxxxx on a given product.  Like if EVGA says don't "advertise" under $200 for this graphics card or it's not fair to our other resellers and newegg wants to give it up for $190, they slap a "see price in cart" in there to make it legal.  Soooooo advertising that you have some in your product listing and then not having it = false advertising.

That's like being Best Buy saying we have the new iPhone in stock at this location! and then not having it in stock, and by the way they got sued for doing precisely that a year or two ago.

I rule in favor of the miners *bangs gavel*  :D

Btw I have also seen the red text of doom and been SO MAD!  >:(

Oh btw, use the power search and select "all" as the first choice and then 5830 as the model and TADA is magically start displaying returns and open boxes and refurbs that weren't listed in the normal search.  They all sold out too though and I won't even tell you the price cuz you'd toss your monitor out the window :( okay fine, I believe it was $109 for open box ones.
