Gox is currently in the process of running batch programs to transfer all BTC within there domain outside. They are not currently allowing transactions from a MtGox bitcoin wallet to an external bitcoin address. This is so that users can continue to see false information as to their balances while they pilfer the loot. They will be posting shortly that due to a technical problem beyond their control all is lost. They are currently allowing transfers of BTC between Gox addresses, as those are fake and within their control. They are also allowing currency withdrawals (Yen, Euro, etc.) as those are government backed currencies and stealing those will get you jailed. Disappearing BTC is not new, and not a single person has ever been arrested for pilfering BTC and never will. So where is BTC going, I'll tell you, it is going, going, gone baby, and the MTGox people are already on a plane to someplace nice and warm ;)

In countries where Bitcoin is considered a commodity, its theft most certainly can and will be prosecuted.  Successfully prosecuted is another story.

I think the real question is whether bitcoins can actually be owned.  A private key just gives you access to a particular wallet, and not even exclusive access (for instance, who owns the "password" brain wallet?).

guys, this is all a giant con.

Gox is broke. Gox is a relic of early adopters' Far West.
Gox do not have the realcoins and realcash to match everyone's goxcoins and goxcash.
They got fucked by seizures, hackers and their own incompetence (and they are possibly not the only ones btw).
The latter they are blaming on the protocol in a calculated attempt to bring the price down so they can reduce the weight of their own obligations.
By now goxcoins and goxdollars are like credit default swaps, and are traded accordingly, mostly by insiders.

Yep. No money comes in... People trade what they have there in speculation... He accumulates most of the BTC and fiat there gradually over time... He announces withdrawals are fixed... Price soars... He dumps... Repeat  ;)

Let me expand (my speculation):

After purposely generating the FUD, Gox is using "liquidators" to trade goxcoins for realcoins.
So that they can shit on everyone and yet come out clean later.
In the Far West every rich man has dirty hands. See some of the characters in the board of the bitcoin foundation.

Seriously though if GOX died off it would be a good thing. They're a terrible exchange with terrible service and terrible support. I had to wait 5 months to withdraw $1000 from my gox account. I never received the money, i just gave up waiting after 5 months, cancelled the withdrawal and moved to bitfinex.
