Correct - within HSBC the 300k must be put into the account- not the sellers account but if the buyer does not follow through at the F2F then this 300k shall go to the seller.

On Hk deal, Seller lost 300k establishing banking for the 7b transaction that did not go through. After the call went so bad. He cancelled the transaction.

HSBC is requiring the fee again to re establish your new contract.
He wants to avoid future failure of non performance. He wants 300k deposited in HsBC as good faith money to be held at HSBC and credited back to buyer on 2nd tranche.  We just got off the phone with his banker. And they will not apply the first fees paid to a new transaction. The fees are lost. So if your buyer is willing to put up the 300k at HSBC till 2nd tranche let me know. If not he will not engage this buyer after the first buyer attempted to dictate unrealistic  terms.
