Title: How do I get involved in these MtGox lawsuits?
Post by: wd7777777 on March 18, 2014, 11:49:08 PM
I moved several BTC to that site just before all this happened.

You can now open mtgox.com to see your balance, but that's it.

I am not in any of the countries that these class action lawsuits are coming from, though I am a citizen of one. Is it possible to throw my name into this? Has anyone here done so?

An answer to this would be cool. MtGox owes me a bit over $8,000 USD. Made withdraws to a US bank account, the withdraws were listed as "confirmed" on gox's site and never cleared to my bank. Made the withdraws back in December during the $1000k+/BTC hike. Probably never seeing that money, but damn, I have 8000 reasons to get involved in any way that I can.

There aren't any lawsuits.

Mt Gox is in bankruptcy protection meaning that the court protects them from being sued by anyone.

If you are a US citizen you can join the class action lawsuit Gregory Green v.  Mtgox. Contact the law firm at edelson.com.  the author of the previous post has shit for brains.  While mtgox has filed for bankruptcy protection, Mark Karpeles is not protected personally nor is the parent company that owns mtgox, nor is their us subsidiary.  Third parties who knew of the situation at mtgox but were profiting from mtgox are also subject to liability such as the Japanese bank used by Karpeles and mtgox.  Class action attorneys are paid on a contingency basis so you do not pay attorney fees unless you receive a settlement or award meaning there is no cost to join the class action.

Check out the Legal forum.

Which actions you may be able to get involved in depends on where you're located.  Make sure that you fully understand the nature of any agreements you're asked to sign as the funding arrangements for class/multi-plaintiff actions can vary dramatically by jurisdiction and may or may not be fully contingency-based.

A class action can take place, which is the only case for this scenario.

But, I`m not sure if anyone has filed already - if so they should link the to do steps to join.

What about people who are in a country where nobody is going to file any class action (either because there are too few people who would join it, or because the local law just can't handle it properly)?

Is it possible to join any of those class actions from another country?

why if you are a US citizen only? I'm not, yet several years ago I did join a class action at SDNY Court (now on appeal) ???

I think your safest bet is to just contact the firm and ask.  They will know.  They will do everything in their power to get you in on their suit because it will be more fees and a possibly bigger reward for them.

I'll gladly pay for the reward if they manage to recover a meaningful amount of my coins and fiat.

First of all, thank you to Nikki Snowe for this information. I have been going back & forth, talking with Edelson, and they said that if you are an American citizen, and have BTC and/or money in an account with these Mtgoxuckers, there is no need to actually "join" or be "added to" the suit, you are already a part of it as "putative class members", so no further action is required on your part. They added that "If this case reaches the class certification stage, you will be contacted and can identify yourself as a class member at that time."

As some have mentiontioned, a similar class action lawsuit was recently filed in Canada, which follows suits that (I believe) have been filed in Japan (?) and the UK (right?). They are currently exploring their options and reaching out to lawyers in other countries to find out if similar cases can be filed in other countries.

They told me they are interested in any communications between Mtgox and people affected by this that have reached out to find out what was going on: "emails, chats, or other exchanges you had with Mt. Gox about any 'bug,' the prohibition on withdrawals, and the shutting down the exchange entirely. Please forward any such communications to MtGox@edelson.com."

If you contact them about this, they will send you an invite to a site that has been set up to provide those "added to the group" information regarding the most recent developments in the case, as well as links to any relevant documents.

If you have anything to send them, please do so. I know we all want to get this handled as soon as possible.

If I had known, prior to moving some BTC from Coinbase over to Mtgox, (just before this withdrawal freeze happened  >:( ) that MTGOX stood for Magic The Gathering Online Exchange, I never would have even considered it. I only found that out recently and I wish I didn't know that.  :D It's a bit of embarrassment on top of everything else. Damn.
