3% is a very high fee.

2% is more normal

1.5% is good.

My mine is small about 2000th. it earns 110-120 usd a day before power cost

so 3% of that is $3.30. which is about $1200 a year

Is it a hack of cgminer or is it 100% clean code?
If it is based on cgminer, is the source code available as is required by the cgminer GPL license?

GMiner is fully developed from scratch, there is no one single line from CGMiner

Well considering how regularly that statement is made and how often it is a lie, unless you have the source available to check, it's almost certainly an illegal rip off.
People usually use executable compression and in file encryption to hide the truth.
