They obviously can and did, but what annoys me is I believe their reasoning behind trademarking it was so somebody else didn't and use it for their own gain, now it seems it's just going to be sold to the highest bidder which could cause real problems.

Yes, at the time they (Mark) said it was for the good of the community to grab those TM's.
Always beware of people who claim to represent "the greater good" or say "this action will strengthen our collective fortune".
