Post by: sase007 on January 12, 2015, 11:38:32 AM
Hi,
I want to make a few $ by selling marijuana seeds(just seeds, nothing else). It is legal in my country and in most of europe, but it is legal on bitcointalk?
Thanks for answer :)

Yes, as long as you don't ship to a country where it is illegal to do so then it's fine.

IMO you would probably have somewhat difficulty selling on here. It would be likely that your post would get flagged for selling illegal drugs (despite your claim that it is legal in your country).

You should probably make a sticky thread on all the Marketplace section (Goods, digital goods , currency exchanges etc ... ) saying what is allowed and what is not . I don't see any rules to be honest

Then they will likely get a bad report for it if it's not illegal in his country and he's not breaking the rules.

It already is stickied in the Marketplace but maybe could be stickied in Goods as well: https://bitcointalk.org/index.php?topic=3629.0

Thanks for answers.

So according to market rules, I cant sell to countries where canabis seeds are illegal? So I have to ask buyer before he pays, where he lives?

Gonna be fun :D

You're best just putting a disclaimer that they're legal in your country and you won't ship to any countries where it is illegal to do so. This may save you problems.

You have to ask the buyer where they want you to ship the goods. If you're not sure you should also get them to confirm that shipping the goods to that address is legal. In addition you should confirm the legality yourself. Cover your ass.

Note that many countries have restrictions on shipping organic matter, specifically seeds.

Just put a notice on your thread that says something like:

"Cannabis seeds may be illegal to purchase in your jurisdiction. You may only place an order if the purchase, sale and possession of cannabis seeds is legal in your jurisdiction. It is the buyers responsibility to check the relevant laws in his/her jurisdiction."

That should cover your ass. I don't think you need to check if it is legal for the buyer to buy them, thats the buyers problem  ;)

So, you really think that sending illegal goods to a country will not get you in trouble in that coutry receiving those goods that are illegal there?!?

Sorry, but that won't work that way. Even worse, that country can ask for your extradition and if that country has got an extradition treaty with the country sender is in.... Well, guess what will happen  ::)

Seems like everybody on the internet is a qualified lawyer. I don't know where the OP is located, but if its legal for him to export the cannabis seeds, then the buyer is the one committing the crime by importing them, not the seller. The notice I posted above is similar to ones used by many cannabis seed websites that ship worldwide.

I don't know about everybody, but yes... I might know a thing or two about International Law.  ;D

I don't think most moderators know what exactly is illegal in all countries. Just because the OP says that it is not illegal does not mean that is a true statement.

There also appears to be a thing or two about international law you don't know, one of which is the dual criminality requirement for extradition. A person can only be extradited for something that is a crime in both countries. If it is legal for the OP to export the seeds (which is a big if, since exporting drugs is an entirely different matter than producing them for personal consumption), then he can't be extradited.

That depends on the treaty and I - personally - would certainly not let my freedom depend on it.
