Title: Ben's Outlet WTF - Paid for 5870, got 5850

Wow- so I just opened my order of 5 5870's from Ben's outlet and they turned out to be 5850's. BO has not contacted me to tell me they couldn't fill my order or w/e. If I pull up my order on BO it still shows 5870s.

I'm so pissed it is difficult to type this. I get maybe 4 days home a month and I don't know what to do. New 5870's are pretty much impossible to find for a reasonable price right now. What should I do? I'm sure BO doesn't have any 5870s in stock. Should I get a refund and wait another month? Should I just keep these and try and get a credit for the difference? I bought parts for another rig and I wouldn't have done that unless they were 5870s.

I fucking hate BO now.

I would suggest that if they do not help you with the issue to your satisfaction, that you call your credit card (hopefully you payed with one) and reverse the transaction stating that the items you order were not delivered and that they are unwilling to help you. However, you must contact BO first and document that they will not assist.

I ordered with Amex. Are you sure I have to do that?

Yes (unless you lie).  The first thing CC company will ask is have you contacted the merchant and what was the outcome.

Wow, that really sucks. I ordered 4 5870s from them as well, thankfully none of them were anything other than 5870s, although one is defective (locks up the system whenever the GPU is loaded). I have found Ben's Outlet support leaves a lot to be desired. They are very slow in responding to emails. I have been trying to see if they will replace my defective 5870 and still haven't gotten an answer. Might have to see if AMD will replace it instead.

The other thing that annoys me is they state on the page that the 5870s are "Brand New" and they are anything but. They come in a simple cardboard box with no documentation or any extras, and have obviously been refurbished. For the price it's still a good deal (assuming you get an actual working 5870).

The single 5870 I ordered from them arrived in the same cardboard box without any documentation.  Definitely refurbished, but in very nice condition.

Fortunately, the thing runs beautifully.

I installed the 10 5870s I purchased from them and 2 are bad. Guess I'll be getting a refund on those.

This is what you should do:
If they had already told you they cannot fulfill your order, then speaking to Ben will not help you that much.

1saleaday and BensOutlet care deeply about their reviews and ratings. Email customer service and if they do not respond within 2 days, then write a negative review outlining all details here http://www.resellerratings.com/store/Ben_s_Outlet
The point is not to leave a negative review but to get their attention, someone from their Review dep't will contact you within 2-3 days and offer a resolution as long as you delete or edit the review. Make sure you post your order # in the appropriate field so their staff knows which order your referring to.

If those two do not work. Place a chargeback on your AMEX card and you will win 100% as long as you show what you got, and have a copy of the invoice. BensOutlet will not fight it, rather they will ask you send the goods back and they will pay for return shipping.

At the same time you are doing that:
PM me a copy of your invoice, and a little info on what you got (Im not so familiar with these video cards)
I will call Ben tomorrow and let him know that someone I had vouched for (him) let a community down who is a big source of traffic for him.
He will ask what resolution you want, if he doesn't have any of the cards Ill tell him you want a refund.

I'm sorry this happened to you bro, will do my best to help you get your money or cards back, I promise you that.

The other 1 is junk... but the customer service sent me a return label and I just sent it off...

I've ordered a bunch of stuff from them since the 5870's and it's been a pleasant experience.  Perhaps its a mistake?  Customer support took a couple days getting back to me.

This still doesn't help the fact that I'm leaving my home on Monday morning and won't get back until Thursday Feb. 2nd. I'm out my money(for the time being), the money for the new rigs, and my mining time. The slow response(sent them a message on Friday, haven't heard a word except for their daily email) is really the problem. I won't be able to do anything about the cards until I get back.

It just blows me away that instead of telling me they couldn't fill my order(which would have been shitty, but understandable), they choose to not inform me and ship an inferior product. I spent $500 in parts expecting to build 2 (5x 5870) machines. Hell, I even broke down the old rigs housing the other 5 5870s, which have been out of commission since.

Could be a mistake, rather than a malicious act. If you just sent them an email Friday, the general response time from support in my experience has been 2 business days (which depending on when you sent it would be Mon-Tues).

If it takes that long normally, I'll wait until Monday or Tuesday to see if they reply to me before taking other measures. Interestingly enough, from a quick calculation using the numbers people threw out in this thread, it looks like there's a 16.6% failure rate (4 bad out of 24 total) on these cards from Ben's Outlet.

They are def. refurbs, no doubt about that.  Sold as "New".

After reading about the 5970 debacle with NewEgg Diamond ones though, I feel pretty lucky that only 1 out of 10 was dead.

I'm going to wait that long, I don't have a choice. Still doesn't help that I won't be around to ship them back or do anything else. Even if they overnighted me all 5 on Monday, I wouldn't be able to do a thing until until the 3rd.

They also had a deal for 5850 refurbs for $119 (of course called "brand new" by their fraudulent site), after the 5870's were OOS:http://bensoutlet.com/products/ati-radeon-hd-5850. Maybe they thought you wouldn't notice.

Ok, so finally got some resolution. I decided to keep the cards since I can't find 5870s for a reasonable price and I don't want to deal with shipping them back. BO is going to credit me with the difference in price.

Still though, this was very disappointing- I wanted the 70's. Also, they refused to answer how this happened- did someone else get my cards, did they sell more than they had in stock? If I didn't know what I was doing I could have been unaware that I didn't get what I ordered.
