Ever wonder why multiple investigations of the Benghazi attack failed to turn up much from Hillary Clinton’s e-mails? So did the House Select Committee investigating the attack on the facility and the failures that led to it. To their surprise, the Secretary of State had conducted all of her e-mail on a private account rather than an official State Department account — and her aides had carefully culled only the e-mails they wanted investigators to see. The New York Times’ Michael Schmidt dropped that bombshell earlier this evening:

Hillary Rodham Clinton exclusively used a personal email account to conduct government business as secretary of state, State Department officials said, and may have violated federal requirements that officials’ correspondence be retained as part of the agency’s record.

Mrs. Clinton did not have a government email address during her four-year tenure at the State Department. Her aides took no actions to have her personal emails preserved on department servers at the time, as required by the Federal Records Act. …

The existence of Mrs. Clinton’s personal email account was discovered as a House committee investigating the attack on the American Consulate in Benghazi sought correspondence between Mrs. Clinton and her aides about the attack.

Two weeks ago, Mrs. Clinton provided the committee with about 300 emails — amounting to roughly 900 pages — about the Benghazi attacks that Mrs. Clinton’s aides had found among her personal emails.


Federal law requires government officials to conduct business communications on official media, for lots of good reasons. First, it allows for archival without the officials in question having an opportunity to “sanitize” the record. Second — and this is pretty important for the diplomatic corps — it allows the government to protect against intrusion from other nations and entities. Hillary’s practice of doing business through private servers bypassed both of those key protections.

Hacker "Guccifer" first discovered backchannel receipt of intel memos


MARCH 3--The disclosure that Hillary Clinton used a non-governmental e-mail address while she was Secretary of State originally came courtesy of “Guccifer,” the Romanian hacker now serving time in a Bucharest prison for his online attacks against scores of public figures.

As TSG first reported in March 2013, “Guccifer” illegally accessed the AOL e-mail account of Sidney Blumenthal, who worked as a senior White House adviser to President Bill Clinton, and later became a senior adviser to Hillary Clinton’s 2008 presidential campaign.

When “Guccifer” (who was later identified as Marcel Lazar Lehel) breached Blumenthal’s account, he discovered an assortment of correspondence sent to Hillary Clinton at the e-mail address hdr22@clintonemail.com. The “clintonemail.com” domain was registered in 2009, shortly after her nomination to become Secretary of State.

While Blumenthal, a longtime Hillary Clinton confidant, used her private e-mail to send personal messages (like a get well note after she fell at home and suffered a concussion in December 2012), he also forwarded the Cabinet member a series of “Confidential” memos about foreign policy matters.

The “For: Hillary, From: Sid” memos, provided to TSG by “Guccifer,” address a wide range of topics in global flashpoints like Algeria, Turkey, Mali, and Libya. Blumenthal also provided Clinton with information about the European Central Bank, the Georgia elections, and German Chancellor Angela Merkel.

The memos to Clinton carried titles like “Comprehensive Intel Report on Libya,” and included all-cap warnings that, “THE FOLLOWING INFORMATION COMES FROM EXTREMELY SENSITIVE SOURCES AND SHOULD BE HANDLED WITH CARE.” Blumenthal has not held a public post since leaving his White House job in January 2001.

Each memo included a note on the sources of intelligence included in the document. One typical memo referred to “Sources with access to the highest levels of the Muslim Brotherhood in Egypt, the leadership of the Armed Forces, and Western Intelligence, diplomatic, and security services.”

A January 15, 2013 memo on “Libya internal government discussion,” reportedly relied on “Sources with direct access to the Libyan National Government.”

The memos offer no indication as to whether the intelligence gathered by Blumenthal was done at Clinton’s suggestion. Likewise, the hacked material does not include evidence of Clinton’s response to Blumenthal’s memos (which appear to have been prepared with input from Tyler Drumheller, a former Central Intelligence Agency official who ran covert operations in Europe).

While he rummaged through Blumenthal’s e-mail account, “Guccifer” sorted mail sent to Clinton’s hdr22@clintonemail.com address. He then took a screen grab showing more than two dozen e-mails sent over a two-month period ending in mid-February 2013.

Along with Valentine’s Day greetings and a mention of Clinton “walking in my neighborhood,” the subject lines of those Blumnethal e-mails include repeated references to “intel” shared with the Secretary of State. Other subject lines refer to “Q you raised” and “got your message a few days ago; I’m around whenev…” A February 17 e-mail included the subject line, “H: fyi, will continue to send relevant intel. I believe you are missing the bigger picture, explicitly or not. The point is she did ALL STATE BUSINESS on her private email... Ok... But with whom?


You need both party to agree to use the back channel. If she is guilty, how come everyone who dealt with her emails aren't?

Hacked e-mails indicate that Hillary Clinton used a domain registered the day of her Senate hearings



The New York Times reported Monday night that, during her tenure at the State Department, Hillary Clinton never used her official e-mail account to conduct communications, relying instead on a private e-mail account. As the Times notes, only official accounts are automatically retained under the Federal Records Act, meaning that none of Clinton's e-mail communication was preserved.

In March 2013, an adviser to Clinton, Sidney Blumenthal, had his e-mail hacked by "Guccifer" -- the Romanian hacker perhaps best known for revealing George W. Bush's paintings to the world. At the time, Gawker reported that Blumenthal was communicating with an account that appeared to belong to Clinton at the "clintonemail.com" domain. The content of some of those e-mails was published by RT.com.

Examining the registry information for "clintonemail.com" reveals that the domain was first created on Jan. 13, 2009 -- one week before President Obama was sworn into office, and the same day that Clinton's confirmation hearings began before the Senate.





As the Times notes, others have used private e-mail accounts for official business, including former EPA administrator Lisa Jackson. The extent of Clinton's hidden communication, part of her work in a much more significant capacity, is unknown.

It wouldn't surprise me if Team Hillary concoct some defensive campaign against these revelations via all her allies in the MSM which is sympathetic to wanting a Clinton-Bush showdown. This woman deserves serious jail time, not just for this incident, Benghazi and taking bribes from foreign officials (like her hubby did in Chinagate during his tenure) but for all the dirty shit she and he did back in Arkansas during their crime spree there. People can refuse to believe all the shit they've done but people of integrity and honor don't have these kinds of skeletons that have continued on and on, not to mention all the people that wind up dead around their wrongdoings.

Oversight Committee To Join Benghazi Committee In Probing Hillary Emails For Violation Of Federal Law…




A congressional committee will review whether Hillary Clinton violated federal law by using a personal email account to conduct government business as secretary of state, it was announced Tuesday.

House Oversight Committee Chairman Jason Chaffetz (R-Utah) said his panel will join with the Benghazi committee in reviewing whether Clinton broke any disclosure laws.

“Violations of the Federal Records Act within federal agencies is something we take very seriously,” Chaffetz said.

“The House Oversight Committee will work with (Chairman) Mr. (Trey) Gowdy and the Select Committee on Benghazi to further explore Hillary Clinton’s use of personal emails while at the State Department.”

Clinton, still facing fallout from a 2012 attack on a diplomatic outpost in Libya that killed an ambassador and three security aides, is under fire for the email controversy.

Critics said that by using a personal email address, Clinton may have breached security and broken disclosure laws.

Not only did Clinton send and receive tens of thousands of emails from the unregulated address, she was never during her four-year tenure issued an official government account with which to communicate.

Hillary Clinton is defending her use of a private email address, hosted at ClintonEmail.com, to conduct official State Department business by claiming that her emails were captured by official @state.gov accounts that other agency employees were instructed to use to contact her. But according to a knowledgeable source, at least two other top Clinton aides also used private email accounts to conduct government business—placing their official communications outside the scope of federal record-keeping regulations.

“Her top staffers used those Clinton email addresses” at the agency, said the source, who has worked with Clinton in the past. The source named two staffers in particular, Philippe Reines and Huma Abedin, who are said to have used private email addresses in the course of their agency duties. Reines served as deputy assistant secretary of state, and Abedin as Clinton’s deputy chief of staff. Both rank among Clinton’s most loyal confidantes, in and out of the State Department.

We were able to independently verify that Abedin used a ClintonEmail.com address at some point in time. There are several email addresses associated with Abedin’s name in records maintained by Lexis-Nexis; one of them is huma@clintonemail.com. An email sent to that address today went through without bouncing.

Clinton ran own computer system for her official emails



WASHINGTON (AP) - The computer server that transmitted and received Hillary Rodham Clinton's emails - on a private account she used exclusively for official business when she was secretary of state - traced back to an Internet service registered to her family's home in Chappaqua, New York, according to Internet records reviewed by The Associated Press.

The highly unusual practice of a Cabinet-level official physically running her own email would have given Clinton, the presumptive Democratic presidential candidate, impressive control over limiting access to her message archives. It also would distinguish Clinton's secretive email practices as far more sophisticated than some politicians, including Mitt Romney and Sarah Palin, who were caught conducting official business using free email services operated by Microsoft Corp. and Yahoo Inc.

Most Internet users rely on professional outside companies, such as Google Inc. or their own employers, for the behind-the-scenes complexities of managing their email communications. Government employees generally use servers run by federal agencies where they work.

In most cases, individuals who operate their own email servers are technical experts or users so concerned about issues of privacy and surveillance they take matters into their own hands. It was not immediately clear exactly where Clinton ran that computer system.

Clinton has not described her motivation for using a private email account - hdr22@clintonemail.com, which traced back to her own private email server registered under an apparent pseudonym - for official State Department business.

Operating her own server would have afforded Clinton additional legal opportunities to block government or private subpoenas in criminal, administrative or civil cases because her lawyers could object in court before being forced to turn over any emails. And since the Secret Service was guarding Clinton's home, an email server there would have been well protected from theft or a physical hacking.

But homemade email servers are generally not as reliable, secure from hackers or protected from fires or floods as those in commercial data centers. Those professional facilities provide monitoring for viruses or hacking attempts, regulated temperatures, off-site backups, generators in case of power outages, fire-suppression systems and redundant communications lines.

A spokesman for Clinton did not respond to requests seeking comment from the AP on Tuesday. Clinton ignored the issue during a speech Tuesday night at the 30th anniversary gala of EMILY's List, which works to elect Democratic women who support abortion rights.

It was unclear whom Clinton hired to set up or maintain her private email server, which the AP traced to a mysterious identity, Eric Hoteham. That name does not appear in public records databases, campaign contribution records or Internet background searches. Hoteham was listed as the customer at Clinton's $1.7 million home on Old House Lane in Chappaqua in records registering the Internet address for her email server since August 2010.

The Hoteham personality also is associated with a separate email server, presidentclinton.com, and a non-functioning website, wjcoffice.com, all linked to the same residential Internet account as Mrs. Clinton's email server. The former president's full name is William Jefferson Clinton.

In November 2012, without explanation, Clinton's private email account was reconfigured to use Google's servers as a backup in case her own personal email server failed, according to Internet records. That is significant because Clinton publicly supported Google's accusations in June 2011 that China's government had tried to break into the Google mail accounts of senior U.S. government officials. It was one of the first instances of a major American corporation openly accusing a foreign government of hacking.

Then, in July 2013, five months after she resigned as secretary of state, Clinton's private email server was reconfigured again to use a Denver-based commercial email provider, MX Logic, which is now owned by McAfee Inc., a top Internet security company.

The New York Times reported Monday that Clinton exclusively used a personal email account it did not specify to conduct State Department business. The disclosure raised questions about whether she took actions to preserve copies of her old work-related emails, as required by the Federal Records Act. A Clinton spokesman, Nick Merrill, told the newspaper that Clinton complied with the letter and spirit of the law because her advisers reviewed tens of thousands of pages of her personal emails to decide which ones to turn over to the State Department after the agency asked for them.

In theory but not in practice, Clinton's official emails would be accessible to anyone who requested copies under the U.S. Freedom of Information Act. Under the law, citizens and foreigners can compel the government to turn over copies of federal records for zero or little cost. Since Clinton effectively retained control over emails in her private account even after she resigned in 2013, the government would have to negotiate with Clinton to turn over messages it can't already retrieve from the inboxes of federal employees she emailed.

The AP has waited more than a year under the open records law for the State Department to turn over some emails covering Clinton's tenure as the nation's top diplomat, although the agency has never suggested that it didn't possess all her emails.

Clinton's private email account surfaced publicly in March 2013 after a convicted Romanian hacker known as Guccifer published emails stolen from former White House adviser Sidney Blumenthal. The Internet domain was registered around the time of her secretary of state nomination.

Rep. Trey Gowdy, R-S.C., chairman of the special House committee investigating the Benghazi attacks, said the committee learned last summer - when agency documents were turned over to the committee - that Clinton had used a private email account while secretary of state. More recently the committee learned that she used private email accounts exclusively and had more than one, Gowdy said.

President Barack Obama signed a bill last year that bans the use of private email accounts by government officials unless they retain copies of messages in their official account or forward copies to their government accounts within 20 days. The bill did not become law until more than one year after Clinton left the State Department.

Right, says Karl — but all of her business was transacted on a private account. She didn’t even gesture towards compliance with records accountability by having an official State Department account set up for her. This is what I mean with my headline above. If you take this seriously, Earnest’s claiming that it’s no biggie for federal employees at the highest levels to bypass official e-mail accounts entirely so long as they’re willing to produce their e-mails eventually. And in this case, “eventually” meant two years after Hillary left office.

DEFENDING HILLARY: DAVID BROCK’S BIZARRE ‘MORNING JOE’ APPEARANCE



In a bizarre attempt to defend Hillary Clinton from a brewing scandal involving a secret email account, Media Matters founder David Brock appeared dazed and disheveled during a Tuesday appearance on MSNBC’s “Morning Joe.” Brock is demanding The New York Times retract its Monday bombshell detailing the fact that for four years as Secretary of State Ms. Clinton used only a private email account.

Per his own words, Brock’s argument is based on the Times’ conclusion that by withholding the emails and not archiving them, Clinton might have broke federal law. “The only named source they have to support this allegation — Jason Banks — the highest ranking lawyer in the National Archives, said after the piece was published that no law was broken,” Brock argued. “So the story is wrong. It’s based on a false premise.”

Host Joe Scarborough then read Brock a 2009 federal regulation that requires all federal employees to preserve emails “in the appropriate recordkeeping system.” This is something Clinton did not do until recently, at least until two years after leaving the State Department. Brock appeared to argue that in doing so she did in fact comply. Of course, Brock has no way of knowing that. Because she skirted the law for 6 years, and apparently used her own email server, there is no way to know if she turned over every email.

This appears to violate both the letter and spirit of the law that requires “a system not operated by the agency MUST ensure that “emails outside of the federal system are preserved.” [emphasis mine]

Unbound by facts, Brock added this to his bizarre defense, “The State Department said yesterday that the emails were regularly preserved.” Brock is arguing here that the emails were preserved by … Ms. Clinton.

When reminded that the law requires that the emails be “preserved in the appropriate agency” and not by the individual’s home-brewed server, Brock didn’t appear to grasp what that meant. “It’s not clear that didn’t happen, Joe,” Brock replied. “The New York Times doesn’t establish that at all. In fact, the 2009  law you’re referring to isn’t even cited in the New York Times.”

If I’m interpreting Brock correctly, he is again demanding a New York Times retraction — not because there isn’t a law that Ms. Clinton appears to have broke — but because the Times didn’t publish the law Ms. Clinton appears to have broke.

State Department technology experts expressed security concerns that then–Secretary of State Hillary Clinton was using a private email service rather than the government’s fortified and monitored system, but those fears fell on deaf ears, a current employee on the department’s cybersecurity team told Al Jazeera America on Tuesday.

The employee, who spoke on the condition of anonymity for fear of losing his job, said it was well known that Clinton’s emails were at greater risk of being hacked, intercepted or monitored, but the warnings were ignored.

As our friends at Judicial Watch will no doubt remind everyone, there were plenty of Freedom of Information Act requests that would have implicated her e-mails. But they were never searched, even though a reasonable search of all responsive federal records must be made in response to FOIA requests. And the records would have been relevant to congressional inquiries as well, including continuing investigations of the Benghazi attacks.

Why does that matter? Well, a federal criminal law makes it a felony when any custodian of official government records “willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same.” The crime is punishable by up to three years in prison. And interestingly, Congress felt strongly enough about the crime that it included the unusual provision that the perpetrator shall “forfeit his office and be disqualified from holding any office under the United States.”

Clinton’s E-Mail System Built For Privacy Though Not Security


A week before becoming Secretary of State, Hillary Clinton set up a private e-mail system that gave her a high level of control over communications, including the ability to erase messages completely, according to security experts who have examined Internet records.

“You erase it and everything’s gone,” Matt Devost, a security expert who has had his own private e-mail for years. Commercial services like those from Google Inc. and Yahoo! Inc. retain copies even after users erase them from their in-box.

Although Clinton worked hard to secure the private system, her consultants appear to have set it up with a misconfigured encryption system, something that left it vulnerable to hacking, said Alex McGeorge, head of threat intelligence at Immunity Inc., a Miami Beach-based digital security firm.

The e-mail flap has political significance because Clinton is preparing to announce a bid for the Democratic nomination for president as soon as April. It also reminds voters of allegations of secrecy that surrounded Bill Clinton’s White House. In those years, First Lady Hillary Clinton fought efforts by some White House advisers to turn over information to Whitewater investigators and, later, sought to keep secret records of her task force on health-care reform. The committee also said Wednesday that it has discovered two e-mail addresses used by Clinton while secretary of state.

Nick Merrill, a Clinton spokesman, didn’t immediately respond to a request for comment, though he said in a statement Tuesday that her practices followed “both the letter and spirit of the rules.” […]

In order to ensure her e-mails were private, Clinton’s system appeared to use a commercial encryption product from Fortinet — a good step, McGeorge said.

However, when McGeorge examined the set-up this week he found it used a default encryption “certificate,” instead of one purchased specifically for Clinton’s service. Encryption certificates are like digital security badges, which websites use to signal to incoming browsers that they are legitimate.

“It’s bewildering to me,” he said. “We should have a much better standard of security for the secretary of state.”

Judicial Watch Sues for Hillary and Huma’s Egypt Emails



(Washington, DC) – Judicial Watch announced today that it has filed a Freedom of Information Act (FOIA) lawsuit against the State Department seeking any and all communications – including emails – from then-Secretary of State Hillary Clinton and her Chief of Staff Huma Abedin with Nagla Mahmoud, wife of ousted Egyptian president Mohammad Morsi, from January 21, 2009 to January 31, 2013 (Judicial Watch v. U.S. Department of State (No. 1:15-cv-00321)).   This latest lawsuit will require the State Department to answer questions about and conduct thorough searches of Hillary Clinton’s newly discovered hidden email accounts.  Judicial Watch also has nearly a dozen other active FOIA lawsuits that may require the State Department to search these email accounts.  Huma Abedin is also alleged to have a secret account as well.

Judicial Watch submitted its original FOIA request on August 27, 2014. The State Department was required by law to respond by September 26, 2014 at the latest to Judicial Watch’s request for:

Any and all records of communication between Secretary of State Hillary Clinton and Nagla Mahmoud, wife of ousted Egyptian president Muhammad Morsi, from January 21, 2009 to January 31, 2013; and
Any and all records of communication between former State Department Deputy Chief of Staff Huma Abedin and Nagla Mahmoud from January 21, 2009 to January 31, 2013.
To date, the State Department has not responded.

Ms. Mahmoud threatened Mrs. Clinton after Morsi was ousted.  According to JihadWatch.org:

In the words of El-Mogaz News, Morsi’s wife “is threatening to expose the special relationship between her husband and Hillary Clinton, after the latter attacked the ousted [president], calling him a simpleton who was unfit for the presidency.  Sources close to Nagla confirmed that she has threatened to publish the letters exchanged between Morsi and Hillary.”

The report continues by saying that Nagla accuses Hillary of denouncing her former close ally, the Brotherhood’s Morsi, in an effort to foster better relations with his successor, Egypt’s current president, Sisi—even though, as Nagla laments, “he [Morsi] was faithful to the American administration.”

“Now we know why the State Department didn’t want to respond to our specific request for Hillary Clinton’s and Huma Abedin’s communications,” stated Tom Fitton.  “The State Department violated FOIA law rather than admit that it couldn’t and wouldn’t search the secret accounts that the agency has known about for years.  This lawsuit shows how the latest Obama administration cover-up isn’t just about domestic politics but has significant foreign policy implications.”

According to a 2012 report from the State Deptartment’s inspector general, former U.S. ambassador to Kenya Scott Gration set up a private e-mail system for his office in 2011.

The inspector general’s report offered a scathing assessment of Gration’s information security practices — practices that are eerily similar to those undertaken by Clinton while she served as Secretary of State […]

The inspector general’s report specifically noted that Gration violated State Department policy by using a private, unsanctioned e-mail service for official. Hillary Clinton appears to have established multiple email addresses for her private use, and possibly the use of her aides, under the domain of “clintonemail.com,” according to a prominent member of the hacking community who supplied independent research data, conducted with high-tech tools, to Fox News.

The hacker used an open-source tool, publicly available, called “The Harvester” to search a variety of data sources – including well-known platforms such as Google, Bing, LinkedIn, Twitter and others – for any stored references to email addresses seen using a particular domain, in this case clintonemail.com. Hackers working under contract for private firms, also known as “White Hat hackers,” routinely use The Harvester during so-called “penetration testing,” or “pen testing,” on behalf of clients trying to ensure that their internal systems are secure.

The application of The Harvester to clintonemail.com revealed additional email addresses besides the one that Clinton aides have insisted publicly that she used, and have said was the only one that she used, when she served as Secretary of State: namely, hdr22@clintonemail.com.

Hillary Clinton won’t be presiding over a soul-searching press conference or sitting down for a come-clean interview about her use of a private email address any time soon — at least if everything goes according to her team’s plan.
The former secretary of state and her advisers have decided to adopt a time-tested Clintonian approach: take a concrete step to ease the pressure, then wait out the storm, according to three sources with knowledge of her team’s approach.

Their theory is that her late Wednesday tweet asking the State Department to release the 55,000 pages of emails she provided to the agency would start to calm the media and political tempest, while giving her spokesman an easy answer to many journalists’ questions: ask State.

Clinton and her team are aware that her tactics will only hold out for so long and that she’ll eventually have to answer questions about her e-mail practices, but she and her advisers are aiming to delay that moment, ideally until she formally announces she’s running for president. At that point, they hope, the controversy will have subsided to the point where her campaign launch will be a much bigger headline than her response to a month-old scandal. Had the existence of the email address and private server been made public in August, they say, it could have become a marginal issue in the run-up to the midterm elections, which Democrats badly lost anyway and in which Clinton wasn’t a candidate. But the decision to let it linger has meant it will cast a much larger shadow over Clinton’s expected campaign announcement.

According to the sources, the problem came to light in August as the State Department prepared to respond to a request from the House Select Committee investigating the attack on the U.S. consulate in Benghazi, Libya. State Department officials noticed that some of the 15,000 pages of documents included a personal email address for Clinton, and State and White House officials conferred on how to handle the revelation, which they expected the committee to notice. But they felt that Clinton’s personal staff should take the lead, since she was no longer in government, and Clinton aides decided to wait and see.

Clinton spokesman Nick Merrill said aides believed the former secretary’s email practices broke no rules and were no cause for concern. Clinton tweeted earlier this week that she wanted all her emails from her tenure as secretary made public.

“There was nothing to get ahead of,” Merrill said. “This was perfectly permissible and the practice of past secretaries, and not only did she turn over all pertinent emails, she has taken the extraordinary step of now asking them to be released to the public. When that’s done, which we hope is soon, it will become clear that it’s all in there and then some.”

As the scandal has grown, White House aides have worked to put distance between the president and the mess. Although Clinton aides have been in touch with the White House about the response in recent days, the situation has put the White House in the uncomfortable position of having to defend the expected presidential candidate because her own staff has left a public vacuum—setting up a potentially precarious dynamic between staffers for Clinton, who have traditionally been reluctant to engage with reporters and aides, and aides to President Barack Obama. Between the two camps, animosity buried after their 2008 primary campaign occasionally flares up.

White House press secretary Josh Earnest took care to point out that Obama himself was unaware of any issues with Clinton’s email. “The expectation of the president is that everybody throughout his administration is acting in compliance with the Federal Records Act,” Earnest said on Wednesday.

The White House does not have Clinton’s full email record, and was only made aware of the situation with her account after receiving the standard notification that a congressional committee had asked for, and received, documents from any agency, he said.

“The White House doesn’t have it and so can’t speak to it,” said one person familiar with the situation.

It’s not clear when Republicans recognized the potentially damaging information in the emails. Though emails with the personal address were among the Benghazi documents the State Department produced in August, it wasn’t until November 18 that the House Select Committee specifically mentioned her private account, in a new request for documents from Clinton and other senior State Department officials.

“The Department is committed to working with the Select Committee,” said a senior State Department official. “We have been in constant, often daily contact with the Committee as we have tried to make the Committee’s priorities our own.”
The official said that State has “long had access to a wide array of Secretary Clinton’s records — including emails between her and Department officials with state.gov accounts as well as cables.”

White House suggests Obama learned about Clinton emails by 'reading the newspaper'






The White House Friday implied that President Obama learned former Secretary of State Hillary Clinton exclusively used a private email account only after "reading the newspaper."

"I have no idea when the president first learned," White House press secretary Josh Earnest told reporters of the simmering controversy. "I wouldn't be surprised, however, if he had learned about that by reading the newspaper. The president has a lot of things on his plate. I'm not sure the details of a senior administration official's email arrangement lands on the president's desk with any regularity."

Clinton, the presumptive Democratic frontrunner for the 2016 presidential nomination, has faced immense pressure in recent days after a GOP investigation revealed that she relied exclusively on personal email during her tenure at the State Department — and even established a private server to handle the digital messages.


Clinton, in a tweet this week, said she wanted to make the tens of thousands of emails her staffers turned over to the State Department public. However, she did not say what she would do with the messages not given to State officials.

Other than the tweet, Clinton has not publicly addressed the controversy.

The White House has tried to distance itself from the political storm in recent days, with little success.

Critics say that the Obama either gave Clinton special treatment or did little to ensure senior officials were meeting his pledge to run the "most transparent administration in history."

What did the White House know and when did they know it? 

That timeline got murkier on Friday as the White House struggled to respond to mounting questions over Hillary Clinton’s private email use. The heat was turned up after Politico reported that top White House officials knew back in August that Clinton was conducting official business on personal email.

But according to those that worked there, and public statements by Earnest, the administration atmosphere at least emphasized enforcement of the rules surrounding email usage. Inside the White House, the repeated warnings weren’t so much about using personal email accounts but about keeping any private emails they sent about their jobs out of the archived public record. Former staffers said they rarely if ever used personal email for government work, but if they did it was usually only when they were off-site and government email was down.

“They were pretty consistent about reminding us the rules,” one former White House official recalled. “Every once in a while there would be an email outage or something and you’d get a reminder that you shouldn’t be using your personal email for government business and that, if you had, you needed to immediately forward any emails to your .gov account so they’d be preserved.”

Now, if it is ever revealed that Clinton did keep private emails conducting official business from the State Department, then she will be guilty of a felony.

But that would require a third party gaining access to all of her personal emails…

“It’s somewhat ridiculous that we are trusting the decisions of private citizens hired by this person to preserve the country’s records,” John Wonderlich, policy director of the Sunlight Foundation, a government transparency nonprofit, told BuzzFeed.

But, unless Clinton agrees to give her server to a third party, that is exactly the situation we are facing.

The Unbearable Lightness Of Being…A Clinton Supporter



Upon hearing the news of Hillary Clinton’s closeted email server, progressives went into their natural state – attack mode.

The former secretary of state unambiguously violated the law by housing her official emails in her mansion’s basement rather than government servers, but true believers couldn’t care less. In the same week retired General David Petraeus pleaded guilty to one count of unauthorized removal and retention of classified material for giving his mistress access to information for his biography, progressives are unconcerned with the idea of untold numbers of classified communications with administration officials and world leaders sitting on an unsecure server in an estate in Chappaqua, N.Y.

The phrase “double standard” comes to mind, but, as the saying goes, without double standards progressives would have no standards at all.

Upon learning of Clinton’s private storage facility for state secrets, loyalists lined up to throw their credibility on their sword to protect the Bill and Hillary machine.

Lanny Davis, whom I like personally, took to the pages of USA Today to deflect “innuendo,” as he calls it, away from Hillary’s ignoring the law. He wrote of Hillary using a private email account that “the law restricting such private accounts by public officials was changed in 2014.” Indeed, long after she’s left office.

But what Davis doesn’t want you to know is the law also was changed in 2009 to require all official electronic communications regarding government work, including emails and texts, be conducted on government email (which Hillary didn’t use) or a personal one (which she used exclusively) for preservation on the servers where the person works. Since Hillary’s were (and presumably still are) sitting in her basement and not on government servers inside the State Department, well, you can see how that is not following the law.

Davis tries to brush this off by saying, “Secretary Clinton's e-mails were preserved on the server, regardless of whether it was located at home.” That would be fine if the Federal Records Act required emails be stored “somewhere,” but it doesn’t. It requires they be stored in the agency itself.

As it stands now, the only proof they have been preserved at all is the word of Hillary Clinton. That and $2.50 will get you a cup of coffee.

Then Davis writes what will become the mantra of Clintonistas, “More than 50,000 pages had already been turned over.” Some use the number 55,000, but whatever number they use is irrelevant because they’re talking about “pages,” not emails.

An email reading, “Lunch today?” is one page. An email with a news story pasted into it can be any number of pages depending upon how long it is. So 55,000 pages is a worthless number used to sound big, not to give any real information.

And remember, those “pages” are the ones Team Clinton agreed to turn over to the State Department. Which emails were withheld? For what reason? How many were permanently deleted from the private server that housed them because they’d hinder Hillary’s ambitions? After all, the people who “deemed” these pages relevant have their entire financial future resting on Hillary Clinton being elected president.

Deleting emails now can mean a huge payout down the road. Incentives, matter, as much as many would like you think they don’t. And Hillary’s staff has the largest incentive to protect her anyone could imagine.

Lanny then writes, “Fact: To those who argue Mrs. Clinton's server at home was less secure than the one used by State, I answer: Really? Heard of Edward Snowden?” This is too cute by half.

Davis is implying that Clinton’s emails would be no safer at the State Department than they were at her house. There are two problems with this: 1. We know about her secret personal email address only because of a hacker named Guccifer; and 2. The law required them to be stored on State Department servers.

The only purpose of Clinton’s illegal email practices was to shield her communications from congressional investigators conducting their constitutional oversight duties, the national archivists whose job it is to preserve them and the taxpayers who paid for each and every character in them.

I don’t mean to single out Lanny Davis in this. His is just the last defensive piece I read before writing this. It easily could have been countless others who scrambled to explain away the reality of Clinton’s deception.

One common tactic employed by almost all of them is to claim Jeb Bush and Scott Walker did the same thing in their careers. It sounds like “Everyone does it,” right? The only problem is Jeb Bush was governor of Florida at the time, and therefore not subject to the Federal Records Act (the word “federal” is a bit of a giveaway there). And Scott Walker was a county commissioner.

Neither position requires compliance with the Freedom of Information Act. States have their own versions, but the federal law is fairly unambiguous – and every FOIA request that was returned without Clinton’s emails was a direct violation of that law.

So why would people who are otherwise sane (which doesn’t necessarily include Media Matters founder David Brock, who spent a few days on TV looking like a meth-head trying to recite the alphabet backwards to win a hit) go out and embarrass themselves to protect one person? Because there’s money and power in it.

The Clintons have left a wake of ruined lives in their path, but they’ve also created incredibly wealthy people too. Loyalty to the Clintons, especially if you’re willing to sacrifice your credibility to protect theirs, is rewarded as handsomely as disloyalty is destroyed. Those riches come with the caveat that you will be thrown under the bus should it be necessary to protect themselves, but if you make it out the other end unindicted, you will be taken care of.

You could end up broke and in prison, or you could end up a rich Wall Street banker or even an ABC News host. The possibilities are endless. All it will cost you is some integrity and a little piece of your soul. But if you’re inclined to serve the desires of that secretive, law-breaking, power hungry family, how much of either did you really have to being with?

Via the Standard, Jazz touched on this last night but it deserves extra attention. At the moment, E-mailgate is three scandals in one. (Maybe four eventually, but let’s not get ahead of ourselves.) The first is Clinton violating her own department’s regulations on sticking to official government e-mail accounts for official government business. Not only didn’t she comply with that, she didn’t make a pretense of complying: Her private e-mail server was registered before she was sworn in as SoS and her official State e-mail account was never activated. That’s the “Clintons think the rules don’t apply to them” angle to all this. Every Clinton scandal has one. The second scandal is the inexplicably piss-poor security she used to protect her private server even though she and Bill had the means to hire the best tech experts in the world to lock it down for her. She went to great lengths to prevent American voters from reading her e-mails by taking her correspondence off the grid, but when it came to preventing foreign hackers from reading them, she couldn’t be bothered to pony up a few hundred thousand bucks to do it right. That’s the “how can we trust President Hillary with national security after this?” angle.

Now here’s Gowdy with the third scandal, that Hillary obviously still hasn’t turned over all of her e-mails related to official State business. Her staff claims she did that a few months ago, and State itself claims they turned over everything relevant to Libya and Benghazi to Gowdy’s House committee. But if that’s true, says Gowdy, how come there are no e-mails from the trip to Libya that she took in October 2011? The famous photo of her with her shades on, checking her Blackberry, was taken on October 18, 2011 aboard a military aircraft bound for Tripoli. The rebels had recently seized the capital from Qaddafi and Hillary was on her way to chat with the transitional government about nation-building. Qaddafi himself was killed just two days later. These were, to put it mildly, momentous days in the Libyan revolution. And yet, according to Gowdy, his committee has no messages from Hillary — zero — during that trip. Either the Secretary of State went totally dark on e-mail during enormous upheaval in a country Obama was using as a showpiece for lefty hawks’ “responsibility to protect” doctrine or she (and/or State) is withholding communications. And that’s not the only long stretch of radio silence in her e-mails, per Gowdy. Nixon, to follow the analogy du jour, had the 18-and-a-half-minute gap. Hillary, per Gowdy, has e-mail gaps stretching many months. The White House’s chief defense of her private e-mail usage last week was that there’s really no harm, no foul so long in a government official using private e-mail so long as copies of her correspondence are turned over promptly to government archives. Not only weren’t they turned over promptly — it took two years for Team Clinton to finally pony up — but Gowdy’s accusing her outright here of not turning over messages related to key foreign policy developments at all.

An ominous possibility is that those e-mails weren’t turned over because they no longer exist. That’s what made having a private e-mail server potentially so attractive to Hillary — unlike people who use commercial e-mail services, she could erase all traces that an e-mail had been sent or received on her end by simply wiping it from her personal server. Maybe Team Clinton went through her files systematically after she stepped down at State and scrubbed what needed to be scrubbed, knowing that this would eventually blow up and she’d be asked to turn over her archives. The next step for Gowdy’s committee is to compare the e-mail records they have from Hillary to the records they have from people she corresponded with. If they don’t have two identical copies of every e-mail she sent or received — one from her own server, the other from the State Department account of whoever she was e-mailing with — then how does she explain that discrepancy? She should be asked to produce her own copy of every e-mail the committee already knows that she saw. If she can’t, there’s your proof that messages have been permanently deleted from her server. That’s when this scandal goes nuclear.

Exit question from Andy McCarthy: If Gowdy’s known for six months that Hillary routinely used private e-mail to conduct State business, why are we only hearing about it now? Where are the hearings? Where are the subpoenas?

Wallace also lost it when Davis seemed to congratulate Clinton for the “unprecedented move” of volunteering her emails. “She did volunteer to release all of those emails,” Davis said. “She’s the only secretary to openly ask the public to look at all those emails and wants them published right now.”

“She didn’t volunteer!” Wallace objected. “She had to negotiate for four months with the State Department lawyers before she turned them over.”

Davis naturally didn’t think of it as “cleaning up” and said he was proud to work with the Clintons. “There have been mistakes, but the last time you got very heated about the Clintons was Whitewater,” Davis said, though Wallace denied having covered Whitewater. “This is another bogus ‘scandal.’”

Clinton avoids email controversy at women's event


NEW YORK (AP) — Hillary Rodham Clinton’s silence on the email controversy swirling around her is getting louder by the day.

On Monday, the potential 2016 Democratic presidential candidate ignored the issue at a forum while a second Democratic senator urged her to speak out — and predicted she will — about her decision to conduct business while secretary of state in a private email account. Republicans are ramping up their attention on the issue.

Clinton was considering holding a news conference in New York in the coming days to address the email controversy directly, according to a person familiar with her thinking. The person spoke on condition of anonymity and was not authorized to speak publicly. The potential news conference was first reported by Politico.

At the White House, spokesman Josh Earnest said President Barack Obama indeed knew she was using a nongovernment account during her tenure. Obama had indicated earlier that he only learned of that from recent news reports.

Earnest said the president actually learned from those news reports of Clinton’s privately run email server, but was familiar with her private account earlier because the two had exchanged emails when she was in office. Obama did not know at the time that she was using private email exclusively, Earnest said.

Clinton spoke at a carefully choreographed two-hour event involving her No Ceilings project at the Clinton Foundation, highlighting economic and educational opportunities for women and girls. She took no questions. When she sat down to lead more informal conversations with invited speakers, participants appeared to be reading from teleprompters.

Why the Clinton email server story matters — and why it may be worse than you think


Commentary: Let me start by saying what this article isn’t.

This isn’t an article about Hillary Clinton (in fact, for the rest of the article, I’m simply going to talk about the “Secretary of State” or “Secretary”). This isn’t an article about records retention and access and possible motivations around that. And it’s not about questions of the law.

This article is about actions that we know the Secretary of State took, and what it means from the point of view of information security.

Information security is the most important point in this whole situation, in my opinion. And because of the usual political nonsense, it’s getting lost and we can’t afford for it to get lost: it relates directly to critical matters of national security.

From this point of view, the facts are nearly undisputed. The Secretary of State did not use an email account that was hosted on an official State Department server. Instead, she used an email account on an outside server. All accounts indicate that this email account was used exclusively: the Secretary never used an official State Department email account hosted on State Department servers. And reports indicate that this email account was hosted on a physical server that was not physically under government control or protection. Some reports have even indicated that it was located in the Secretary’s personal residence. Some reports have characterized this as a “homebrew” server, and that’s apt and accurate.

These are the facts that we need to focus on from an information security point of view. Because if these facts are true, this can represent one of the most serious breaches in data handling that we’ve ever heard of.

This matters for three reasons.

The Secretary of State is a very “high value target” from the standpoint of nation-state threat actors. The President, Secretary of Defense and the head of the CIA would also qualify in this top tier. These individuals handle the most important, most sensitive, most dangerous and therefore most interesting information to foreign intelligence.
Nation-state threat actors represent the top of the food chain in terms of adversaries in information security. Nation-states can bring the most talent and resources to bear in this arena. For all the worry about cybercriminals and terrorists, everyone in information security looks at nation-state threat actors as the most advanced and sophisticated threat to defend against.
Take #1 and #2 together and you have a situation where the very high value targets are threatened by the most advanced and sophisticated offensive information security capabilities out there. Put another way, the best of the best are gunning for those people to get their information.
The third point is critical: if the best of the best are after your information, you need the best of your best protecting it. And there is simply no way that a “homebrew” server is EVER going to have the security and resources appropriate to defend it adequately.

Looking at it this way, a “homebrew” server was the worst possible choice. Even using a webmail system like Gmail, Outlook or Yahoo would have been better because those companies have the expertise and capability to meet at least some of the threat this class of information would face.

This is the most important point. You can liken this to the CFO of Chase taking billions of dollars in cash home and storing it in the mattress. It’s so inadequate to meeting the risks that it would be laughable if it weren’t so serious.
Unless we learn that this server was being protected by the government using the same levels of protection that official servers are, we have no choice but to assume that this server has been compromised by foreign intelligence agents. And let’s be clear, this isn’t just hostile governments: if the Snowden disclosures have shown us anything (reminded us, really) it’s that everyone spies on everyone, friend and foe alike. To put this in the starkest terms: we have to assume the Russians, the Chinese, the Israelis have had access to the Secretary of State’s official email.

In any data breach like this, one of the questions we raise is whether this kind of action represents a failure of policy. Did the State Department have clear security policies and procedures that were communicated to its employees about the appropriate use of systems? This is important because it helps us understand if this is the failure of a single individual or if we have a bigger problem where others (including other Secretaries of State) could be creating the same kinds of risks.

The press reports haven’t delved into this question adequately, being focused on other questions. I have the benefit of having a friend who was a political appointee to the State Department under a Secretary of State prior to the one in question. I asked this friend if there were clear guidelines that would make clear this was inappropriate, and I was told that everyone knew you only used your Blackberry for work, and only for work. Based on that, it would seem this was an intentional violation of security policies and procedures by this Secretary. The good news here, I suppose, is that we would seem to not have to worry that our ambassador to Russia is using Gmail or that John Kerry has his own server in his house.

But the fact remains that, unless we learn otherwise, this Secretary of State took actions that endangered the security of critical information in their trust and so the security of the United States. Regardless of one’s political affiliation and support that is a very serious violation, much more serious than the other violations being discussed.

What needs to happen is there needs to be a full investigation of the security piece of this. How secure was the server? Who was protecting it? Was there any evidence that it was compromised (though the best compromises are never detected)? Assuming that it was compromised, what information was on it and now has to be assumed to be lost?

But right now, the discussion isn’t focused on this. Where security is being raised it’s peripheral. These questions are secondary to other ones. And that is a problem.

This potentially could be the most serious national security data breach that we’ve heard of. The pieces are in place for it to be that. And part of the problem right now is we just don’t know and no one is focusing on those questions appropriately.

Hopefully calm heads will prevail and an appropriate investigation will occur so we can understand this situation better. But for now, I’m not hopeful that will happen. This critical piece of this situation may get lost in the shuffle as people focus on other, more interesting, but less important points.

Besides exclusively using a secret email account to conduct official government business, it’s likely that Hillary Clinton also used unauthorized electronic equipment—an iPad and an iPhone—as Secretary of State after being warned not to, a veteran State Department official told Judicial Watch this week.

On at least half a dozen occasions Clinton’s top aides asked the State Department’s Office of Security Technology to approve the use of an iPad and iPhone, according to JW’s inside source. Each time the request was rejected for security reasons, the source confirms. The only mobile device that meets the agency’s security standards is the BlackBerry, JW’s source said, adding that the Office of Security Technology—Bureau of Diplomatic Security’s Directorate  of Countermeasures must approve all equipment such as cameras, phones and communication devices for all officials.

Evidently set on using the popular Apple devices, Clinton repeatedly challenged the ban and asked management in the Office of Security Technology to allow their use. The executive secretariat responsible for all communications and information technology always rejected the requests, JW’s source affirms. “From day one Hillary was trying to get the iPhone and the iPad approved,” the State Department official told JW. “She kept trying and trying to get us to approve the iPhone and the iPad, but we wouldn’t do it. Technology security experts tested the iPhone and the iPad several times because she constantly wanted them approved, but it never happened.”

The longtime State Department employee reveals that it’s common knowledge among government security tech experts that Apple devices don’t meet strict security standards so agency insiders were puzzled that the Secretary of State was hell-bent on using them. “There was a lot of head-scratching,” JW’s source revealed. Every State Department employee goes through a rigorous security training that includes strict warnings about using non approved equipment or personal email like Clinton did throughout her tenure as the president’s chief foreign affairs officer, the agency insider said.

Clinton’s persistent efforts to persuade the State Department’s technology security experts to approve the use of her favorite Apple devices led those in the division to conclude that she did in fact go through with it. “My guess is she did it and wanted approval after the fact,” JW’s source said. “But no waivers were ever issued.” JW reached out to the State Department for a comment on this latest potential scandal surrounding its former leader, but failed to get a response.

In the meantime, JW has launched a full-scale investigation into Clinton’s secret email system and has filed a number of Freedom of Information Act (FOIA) requests that will likely end up being litigated in federal court. Prior to the email scandal JW already had nearly a dozen active lawsuits in federal court that could be affected by Clinton and her staff’s use of secret email accounts to conduct official government business. Among them is a public-records request for communications between the former Secretary of State and her Chief of Staff, Huma Abedin with Nagla Mahmoud, wife of ousted Egyptian President Mohammad Morsi.

AP Suing State Dept To Force Release Of Hillary Clinton Emails, FOIA Request From 5 Years Ago Still Unfulfilled…




The Associated Press filed a lawsuit Wednesday against the State Department to force the release of email correspondence and government documents from Hillary Rodham Clinton’s tenure as secretary of state.

The legal action comes after repeated requests filed under the U.S. Freedom of Information Act have gone unfulfilled. They include one request AP made five years ago and others pending since the summer of 2013.

The lawsuit, filed in the U.S. District Court for the District of Columbia, comes a day after Clinton broke her silence about her use of a private email account while secretary of state. The FOIA requests and lawsuit seek materials related to her public and private calendars, correspondence involving longtime aides likely to play key roles in her expected campaign for president, and Clinton-related emails about the Osama bin Laden raid and National Security Agency surveillance practices.

“After careful deliberation and exhausting our other options, The Associated Press is taking the necessary legal steps to gain access to these important documents, which will shed light on actions by the State Department and former Secretary Clinton, a presumptive 2016 presidential candidate, during some of the most significant issues of our time,” said Karen Kaiser, AP’s general counsel.

“The press is a proxy for the people, and AP will continue its pursuit of vital information that’s in the public interest through this action and future open records requests,” she said.

Clinton hides emails from period when account was reportedly unencrypted



Since the revelations involving former Secretary of State Hillary Clinton’s private email server exploded last week, questions have swirled regarding her account’s level of information security. “I did not email any classified material to anyone on my email,” Clinton averred at a brief press conference on Tuesday.

Some are… skeptical about the assertion that the nation’s top diplomat never received any classified material via her email account at an agency that is often criticized for over-classifying information.

“I would assume that more than 50 percent of what the secretary of state dealt with was classified,” said an unnamed former official who spoke to The New York Times on the condition of anonymity. “Was every single email of the secretary of state completely unclassified? Maybe, but it’s hard to imagine.”

Indeed, it is. At the very least, the nation’s chief diplomat spent much of her time dealing with sensitive information. Presumably the secretary of state’s “homebrew” server at least had some rudimentary security protocols in place to prevent hackers or cyber espionage agents from infiltrating the system. And Clinton’s email server did have a data encryption system in place… two months after she took office.

According to The Wall Street Journal’s reporting, Clinton’s emails lacked comprehensive data protections until weeks after she took office:

Mrs. Clinton took office in January 2009 and began using her private email system for both work and personal matters. Her office said the system used “robust protections” and “additional upgrades and techniques employed over time as they became available.”

Kevin Bocek, a vice president at the Internet security company Venafi, said the Clinton server was encrypting data it sent and received as of March 29, 2009, about two months after she took office, based on a search he did of Internet records. During the first two months of her tenure, however, it doesn’t appear that Mrs. Clinton’s email had such protections, Mr. Bocek said.



It is unclear if Clinton’s emails were entirely unsecure in the period from when she took office in January of 2009 to the end of March of that year, but this report indicates that her emails at least lacked comprehensive protections.

If that’s true, State Department investigators don’t have the ability to scrutinize even the text of the emails sent during this period, much less the metadata associated with those communications, because they were among the majority of the email that Clinton withheld from investigators:





Anyone who is more concerned with America’s diplomatic security than they are with Hillary Clinton’s viability as a presidential candidate cannot help but be shocked by this revelation. The secretary’s cavalier approach to security in the preservation of her own level of “convenience” is reckless in the extreme. At a period in the secretary’s tenure when she was negotiating the “Reset” with Russia, a nation with one of the most sophisticated cyber intelligence operations on Earth, conducting official American business over unsecure channels is nothing short of a dereliction of her responsibilities.

Of course, we don’t know if she did. We may never know what the former secretary discussed via her email account in that two-month timeframe. That’s simply unacceptable. It might even be disqualifying.

I think Psaki’s actually trying to help Hillary in saying this, strange as that may seem. Remember when Her Majesty said at her press conference that she thought it’d be inconvenient to carry separate Blackberries for her personal and work e-mail? And we all laughed at the suggestion that modern smart devices could only handle one dedicated e-mail account? There’s a reason she said that, says Psaki — until last year, if you wanted to access State Department e-mail remotely, you needed a secure Blackberry issued by State for that purpose. And that Blackberry only handled department e-mail, i.e. State e-mail accounts actually did require a dedicated device. Apparently Hillary was right in thinking that, if she wanted to read private e-mail too, she really would have had to carry a second device.

But rather than do that and endure the hardship of fitting two four-ounce smartphones in her purse instead of one, she chose to defy security protocols and conduct all of her business, work and personal, from her unsecured private device. She didn’t care enough about security to have an official State e-mail account created for her in the first place so why would she care enough to read sensitive messages on an official, secured State Blackberry? That adds a whole new level of risk to her e-mail habits, actually, since she was presumably using her personal Blackberry for work during overseas trips, when she was at greater risk from foreign surveillance. Between that and the fact that State IT techs warned her about the vulnerability of her private server, there’s really no question that she knowingly, willingly created a major hole in national security simply because her selfish political desire to keep her messages away from the voting public was more important to her.

And contrary to popular belief, Hillary didn’t say at her presser that she had never accessed classified information from her private account. She said she never sent classified “material.” What does that mean, wonders Andy McCarthy:


First, since we’re dealing with Clintonian parsing here, we must consider the distinction between classified documents and classified information — the latter being what is laid out in the former. It is not enough for a government official with a top-secret clearance to refrain from storing classified documents on private e-mail; the official is also forbidden to discuss the information contained in those documents.

The fact that Mrs. Clinton says she did not store classified documents on her private server, which is very likely true, does not discount the distinct possibility that she discussed classified matters in private e-mails. We would not be able to judge that absent reviewing the e-mails. If any of the 31,830 withheld e-mails from the private, non-secure system — involving America’s top diplomat who was in constant discussions with other important diplomats, top military and national-security officials, her trusted advisers, and even the president of the United States — touched on classified matters, that could land Mrs. Clinton in very hot legal water. It would be a powerful incentive to hit the “delete” key.

Did she or even her staff scroll through her sent items scanning emails about “yoga routines” or “family vacations” before deleting them? Nope. No one looked at them. The Clinton campaign said those emails that did not crop up in a keyword search performed by her team were automatically deleted. No eyes. No one to be subpoenaed. Just highlight all and press delete. That method seems better for missing emails than to finding them. And it would sound reckless and haphazard coming from another politician. State Department spokeswoman Jen Psaki couldn’t tell reporters on Thursday if Hillary Clinton signed an official records form presented to all employees as they leave the department — a crucial question in determining whether the former Secretary of State committed a felony by failing to turn over government e-mail records.

Former Department of Justice lawyer and National Review contributing editor Shannen Coffin noted this week that Clinton should have signed form OF-109 as part of her standard exit from the department. That form declares that she turned over all relevant records at the time of her departure — and stipulates that any failure to do so could result in felony fines and jail times.

Clinton did not turn over her government communications to the State Department until asked for them late last year.

A former DOJ attorney has asked if, under department policy, Secretary Clinton — like all officials here in this building, when they depart or separate from this office, has to sign something called a form OF-109,” a reporter asked Psaki on Thursday. “It’s a separation statement declaring that when you leave office, you turn over not just classified materials, but any documents for official purposes. Did she sign –”

Hillary Rodham Clinton is an ancient presidential candidate. Not age-wise. Attitude-wise.

Staggered by self-inflicted wounds, the former secretary of State faced a choice between the right way and wrong way to manage a public-relations crisis in the post-Internet era, when the 1990s tactics of deflection, deception, and victimization are far less effective. She chose the wrong way.

Rather than be transparent, completely honest, and accountable, Clinton doubled down on the 1990s. She refused to turn over her emails stored on a secret service in violation of federal regulations. She defended contributions to her family's charity from foreign nations that discriminate against women and support terrorism, a brazen contradiction to her public profile.

"I fully complied with every rule I was governed under," she said, a legalistic dodge that rivals Al Gore's lame defense of his fund-raising shenanigans in 1997: "There is no controlling legal authority."

She dodged legitimate accusations, parried accusations that were never in play, and coolly laid out a defense that you could boil down to five words: "Trust me, I'm a Clinton."

Clinton had a four-point response:

1. She decided to use her personal email account for both work and private business as a matter of convenience. "Looking back," she said, "it would have been better had I simply used a separate account."

That was as close as Clinton got to contrition, and even this talking point was misplaced. Nobody questions her right to use a personal account for work-related matters. Nobody seeks to make truly private emails public. The issue is Clinton's clear violation of federal regulations requiring her to store official emails on government servers. For reasons she left unsaid, Clinton went rogue.

A home-brewed server gives her full control of government records. Theoretically, she can delete or withhold public documents without the public ever knowing.

2. The "vast majority" of her emails went to government authorities, which means they would be captured by people who (unlike her) followed federal rules. Clinton didn't put a number to "vast majority" or characterize what material was contained in the "minority" of emails lost. Presumably, though, they're on the server she won't cough up.

3. After she left the State Department, House Republicans investigating the Benghazi attack discovered that they had none of her emails and notified State. The agency asked all former secretaries of State to turn over their emails. Obama senior adviser Valerie Jarrett leaked to the press details of Hillary Clinton’s use of a private e-mail address during her time as secretary of state, sources tell me.

But she did so through people outside the ­administration, so the story couldn’t be traced to her or the White House.

Obama Determined to Defeat Hillary…Valerie Jarrett Launches 6 Investigations of Her



Noted veteran journalist Ed Klein is revealing the results of his recent investigation.  Klein is fresh of his Number 1 best seller “Blood Feud” that chronicles the feud between Obama and the Clintons.  The ironic thing is that both Bill and Hillary worked hard on Obama’s reelection with the understanding he would back her in 2016.  They have learned what America already knew.  Obama cannot be trusted.  Apparently, Obama is so serious about it that he has had his top adviser, Valerie Jarrett working almost full time, finding fault with Clinton’s time at the State Department.

Currently, Clinton is looking very beatable by a republican but Warren and O’Malley are far behind in all the polls.  O’Malley has the added disadvantage of being a huge tax and spender.  His tax increased were so egregious that a republican was able to win his seat vacated through term limits in the extremely blue state of Maryland.

When someone uses a Spam Filtering service they point their MX records to that service and all email for that domain goes to the spam filtering service first – they clean it – and forward the good email on to the recipient server which is secret to the world.

Internet —–> MxLogic ——> Hillary’s Server

What this means is that when Obama or anyone in the State Department emailed Hillary, the email went to MxLogic. It was then decrypted, checked for spam and viruses, and then reencrypted and sent over the open internet to Hillary’s server. While it was at MxLogic it could be read, tapped, archived, or forwarded to anyone in the world without anyone knowing.

We all know that the only reason you would deliberately and premeditatedly set up a private email address and server is to have total control over your communications — to keep people away from those communications and to retain the ability to edit and delete your content.

In Hillary Clinton’s case, given her long history of concealment and duplicity, total control was the system’s purpose, not to keep track of Chelsea’s bridal gift registry.

First, a step back: In order to understand this Hillary scandal, you must understand her pattern in past scandals. And you must understand the man at the center of so many of them: Sidney Blumenthal.

Mr. Blumenthal is the Clintons’ longtime and fiercely loyal political hit man. He orchestrated many of the sleaziest attacks on Clinton opponents, including smearing Monica Lewinsky as a “stalker” at Mrs. Clinton’s request. His mastery of the dark arts was so notorious that it may have been the reason Mr. Obama pointedly denied Mrs. Clinton’s request to appoint him to a special, official role in her State Department.

But Mrs. Clinton has never been one to take “no” for an answer. It now appears that despite Mr. Obama’s order, Mr. Blumenthal may have still served Mrs. Clinton’s political and policy needs, but in a shadowy, non-official capacity.

Mr. Blumenthal apparently sent numerous emails to Mrs. Clinton immediately after the Benghazi attack on Sept. 11, 2012. Those emails were hacked allegedly by the hacker Guccifer (whom some claim is actually Romanian intelligence) in March 2013.

Guccifer released a screenshot of what it claimed is Mrs. Clinton’s private email inbox, chock-full of emails from Mr. Blumenthal to her hdr22@clintonemail.com address. The website Gawker then published the screenshot, complete with subject lines and dates of the Blumenthal emails. Gawker noticed that Mrs. Clinton was using a private account and alerted the State Department.

When the scandal first broke about the Clinton Foundation taking millions from foreign governments while Hillary Clinton served as Secretary of State, Clinton apologists took an end-justifies-the-means defense. Sure, the foundation took $500,000 from Algeria without notifying the State Department, but it went to Haiti to help the poor! Why would anyone object to helping the poor, after all?

According to the Washington Post’s Kevin Sullivan and Rosalind Helderman, many Haitians would challenge the premise of that defense. In fact, they see the Clintons as “part of the elite class who are operating to exploit the Haitian people,” and not without reason:


Controversy surrounding the Clintons only deepened with the recent revelation, contained in an upcoming book by Peter Schweizer, that Tony Rodham — Hillary Clinton’s younger brother — serves on the advisory board of a U.S.-based company that in 2012 won one of Haiti’s first two gold-mining permits in 50 years. After objection from the Haitian Senate, the permits have been placed on hold.



The Clintons come in with one hand to help out, and with another to help themselves, in other words. There aren’t too many ways to exploit a nation more clearly than to take its gold out its ground for the benefit of politically connected outsiders. It’s also not the first time Tony Rodham has been connected to attempts to exploit his sister’s political connections for his own benefit. Rodham’s Gulf Coast Funds participated in GreenTech Automotive, which Terry McAuliffe ran, and which came under scrutiny for its connection to Alejandro Mayorkas and an alleged corruption of investor-visa applications.

In January, Haitian expatriates picketed the Clinton Foundation’s New York headquarters, demanding to know why more progress has not been made with the billions in international aid pledged after the quake.


The Post’s reporters paint a nuanced picture of the Clintons’ efforts in Haiti. There have been success stories as well, attempts to harness market forces to produce charitable ends, some of which have panned out. Others have been less successful, but seem to have been an honest attempt to create more opportunity. It’s worth the time to read the entire report to grasp both the scope of the effort and the scope of the despair in Haiti, 20 years after Bill Clinton ordered American forces to Port-au-Prince to reverse a coup.

The focus on building high-end luxury hotels, and especially to get Haiti’s gold into Tony Rodham’s pockets, looks like something else entirely.  Those projects appear ready made to both burnish the Clintons’ standing with the “elites” by catering to them at the expense of ordinary Haitians, and in the case of the gold, to burnish a few family bank accounts along the way. Sullivan and Helderman explore this latter effort in more detail separately:


Tony Rodham’s involvement with the mine, which has become a source of controversy in Haiti because of concern about potential environmental damage and the belief that the project will primarily benefit foreign investors, was first revealed in publicity about an upcoming book on the Clintons by author Peter Schweizer.

In interviews with The Washington Post, both Rodham and the chief executive of Delaware-based VCS Mining said they were introduced at a meeting of the Clinton Global Initiative — an offshoot of the Clinton Foundation that critics have long alleged invites a blurring of its charitable mission with the business interests of Bill and Hillary Clinton and their corporate donors.

Asked whether he attends CGI meetings to explore personal business opportunities, Rodham responded, “No, I go to see old friends. But you never know what can happen.”


Well, literally, thanks to Hillary’s choice of e-mail systems. This kind of commingling of interests is why the Clinton Foundation and especially its CGI offshoot is a much bigger problem for Hillary in the long run than the e-mail scandal, which is bad enough and potentially connected to the Foundation. (How many of those 32,000 “private” e-mails discussed CGI business?) Both scandals, though, point to one overriding conclusion about the Clintons expressed this morning by Ron Fournier:




Indeed. In fact, Hillary all but explicitly stated that in her press conference last week, claiming that her “convenience” trumped the law and communications security. The Haitians have learned it the hard way. Hopefully, Americans will recall when we learned it the hard way, too, fifteen years ago.

Hillary Clinton Aides Reportedly Emailed Her From Personal Accounts



Hillary Clinton’s top aides used their personal email accounts to correspond with her about the attack in Benghazi while she was Secretary of State, the New York Times reported Monday.

That detail comes after Clinton, earlier this month, held a news conference to address questions about her use of her personal email account to conduct official business while she was in office. During that event, she said “vast majority of my work emails went to government employees at their government addresses, which meant they were captured and preserved immediately on the system at the State Department.”

Critics said the likely presidential contender’s use of her personal email account may prevent official records from becoming public. Clinton’s email was run from its own server out of her New York state home, and she has said that she deleted thousands of emails she deemed personal.

About 300 emails have been turned over to the Congressional committee investigating the Benghazi attack, the New York Times reported. Some of those emails, according to people who saw them and described them to the Times, showed Clinton and her staff reacting as the Obama administration’s explanation of what happened in Benghazi changed from a “spontaneous” attack – as then-United Nations Ambassador Susan Rice called it – to a planned act of terrorism.

Jake Sullivan, Clinton’s foreign policy adviser, kept her updated on the developments, the Times reported:
Two weeks after that first email assessing Ms. Rice’s appearance, Mr. Sullivan sent Mrs. Clinton a very different email. This time, he appeared to reassure the secretary of state that she had avoided the problems Ms. Rice was confronting. He told Mrs. Clinton that he had reviewed her public remarks since the attack and that she had avoided the language that had landed Ms. Rice in trouble.

“You never said ‘spontaneous’ or characterized their motivations,” Mr. Sullivan wrote.

For those new to how the Clintons operate, back in the 90s Bill had a pointman as head of the Commerce dept which would grand export waivers to sophisticated technology/communications and weapons manufacturers so they could sell their products to the Chinese military in return for donations to his reelection fund as well as to his legal defense fund. So basically, the Chinese were getting encryption pinpointers that they could use to develop a more accurate weapons system which would be treason and bribery on this side of the pond yet all Clinton was impeached for was perjury and other minutia. The New American magazine documented all this stuff but the republican prosecution team, for some reason, let this guy off scott free. Since he got away with that plus many other things, Hillary knows she's in the driver's seat on this email thing.

Trey Gowdy: Hillary Clinton wiped her server clean

Hillary Clinton wiped “clean” the private server housing emails from her tenure as secretary of state, the chairman of the House committee investigating the 2012 terrorist attacks in Benghazi said Friday.

“While it is not clear precisely when Secretary Clinton decided to permanently delete all emails from her server, it appears she made the decision after October 28, 2014, when the Department of State for the first time asked the Secretary to return her public record to the Department,” Rep. Trey Gowdy (R-S.C.), chairman of the Select Committee on Benghazi, said in a statement.

Clinton was under a subpoena order from the panel for all documents related to the 2012 attacks on the American compound there. But David Kendall, an attorney for Clinton, said the 900 pages of emails previously provided to the panel cover its request.

Kendall also informed the committee that Clinton’s emails from her time at the State Department have been permanently erased.

Senate GOP Asking Questions About Huma Abedin’s Email Account












Senate Republicans are renewing efforts to learn why Huma Abedin, a top assistant to then-Secretary of State Hillary Clinton, was allowed to keep working at the agency under a special, part-time status while also being employed at a politically-connected consulting firm.

The new requests are being made by Iowa GOP Sen. Chuck Grassley, chairman of the Senate Judiciary Committee, following revelations that both women used a private Internet server and email accounts for State Department correspondence.

Grassley says the earlier requests to the department have been largely ignored, so the new ones have gone to the department’s inspector general and to Secretary of State John Kerry, seeking their involvement.

Ex-FOIA Official: ‘There’s No Doubt’ Hillary Clinton Knew She Was Circumventing The Law


Former Freedom of Information Act official Daniel Metcalfe said that he had been part of so many Hillary Clinton scandals that he stopped counting at 23.

Metcalfe said that if the FOIA officer received a request for Clinton’s email correspondence that could include either her sending an email to State Department employee or receiving an email, the officer would go up to the secretary’s office and say that they would have to search through her emails. In Clinton’s case, the search would not take have taken long because there was nothing there.

The only result the search would reveal would be if she had sent an email to a State Department employee.

“I have referred to her ‘regime,’ so to speak, as a prescription for the blatant circumvention of the Freedom of the Information Act,” Metcalfe said.

Metcalfe also said that anything that is labeled as a scandal or “supposed cover-up” has records pertaining to the issue. From there, it becomes a legal issue.

“I do know that Secretary Clinton indeed had knowledge of how the Freedom of Information Act works,” Metcalfe said.

Wikipedia is complete BS. I was one of the earliest editors in Wikipedia and was active there until 2011. Once they got popular, Jimbo Wales started showing his true colors. A lot of the senior editors quit in disgust. Organized Cabals are controlling edits in some of the politically charged sections. All I can say is that Wikipedia is entirely unreliable, for subjects such as Politics, History, Religion.etc. And now they are begging for money....

Report: Hillary Clinton’s Server a “Conterintelligence Disaster” – Magnet for Foreign Spy Services



Hillary Clinton’s private email server was a spy magnet for the Russian, Chinese, Iranian and other intelligence services, say current and former intelligence officials.

As secretary of state, Clinton routed all her government-related email through the server, based in her house in Chappaqua, New York. She reportedly hired a Cablevision (NYSE:CVC) subsidiary to run the server, with antivirus protection from Intel’s (NASDAQ:INTC) McAfee. And she registered her domain name, clintonmail.com, through Network Solutions.

Intelligence professionals fear that the use of the privately installed server, free of certified government defenses against foreign interception, has been a boon to foreign cyberspies.

“By using her own private server with email — which we now know was wholly unencrypted for the first three months of Hillary Clinton’s tenure as secretary of state — she left this easily interceptable by any decent 21st century SIGINT service,” said John Schindler, a former National Security Agency counterintelligence officer. SIGINT is shorthand for signals intelligence, or electronic spying.

“The name Clinton right on the email handle meant this was not a difficult find,” Schindler said. “We should assume Russians, Chinese and others were seeing this.”

‘Epic’ Counterintelligence Disaster

“In all, this is a counterintelligence disaster of truly epic proportions, not to mention that, since Clinton admitted she did not use higher-classification email systems at all” — systems like SIPR and JWICS, Schindler said — “we have to assume some bleed-over into her unsecured private email too, which makes this even worse.”

SIPR is the Secret Internet Protocol Router network that the Department of Defense runs to ensure secret communications for the U.S. military, other agencies and certain allies. JWICS is the Joint Worldwide Intelligence Communications System for top-secret government communication. Both provide secure communications for the State Department and secretary of state. Clinton’s private server was not protected by the Department of Homeland Security’s Einstein intrusion detection system, which relies on NSA systems, for official State Department emails.

“She may have deleted 30,000 e-mails before turning her files over to the State Department, but that doesn’t mean that the Russians and the Chinese don’t have them,” said Michelle Van Cleave, former U.S. National Counterintelligence Executive.

Darrell Issa asked Hillary Clinton about her personal email use in 2012



A House committee sent a letter to Secretary of State Hillary Clinton more than two years ago asking if she used a personal email account for official business, but never received a direct answer to the question.

The correspondence — first reported Tuesday night by The New York Times — shows Rep. Darrell Issa asked Clinton about her personal email use on Dec. 13, 2012, writing in his capacity as chairman of the House Oversight and Government Reform Committee.


“Have you or any senior agency official ever used a personal email account to conduct official business?” Issa wrote Clinton. “If so, please identify the account used.”

The letter also asked another question that turns out to be a pointed one in light of Clinton’s acknowledgement last month that she left office with tens of thousands of work-related emails in a personal account and did not provide copies to her former agency until last year, after an official there asked four former secretaries to turn over any such records.

“Does the agency require employees to certify on a periodic basis or at the end of their employment with the agency they have turned over any communications involving official business that they have sent or received using nonofficial accounts?” Issa asked in one of a series of eight questions sent to agency chiefs and obtained by POLITICO.

At the end of January 2013, about six weeks after the letter was sent, Clinton stepped down as secretary. The letter was answered in March of that year by State Department legislative affairs official Thomas Gibbons, who didn’t say whether Clinton had used personal email as secretary.

Gibbons said any State employee “should make it clear that his or her personal email is not being used for official business.”

Issa’s letter to Clinton, who formally announced her bid for the Democratic presidential nomination on Sunday, was one of a round of more than a dozen such inquiries he sent to agency chiefs across the government after it was disclosed that officials at the Environmental Protection Agency and elsewhere had conducted official business on private email accounts and government email accounts created under fake names.

Former Issa aide Kurt Bardella said State’s response fuels questions about Clinton’s handling of her email as secretary.

“Why did the State Department wait until after Secretary Clinton left office to respond to the Issa letter? Were Secretary Clinton’s efforts to deliberately conceal her official activities through use of her private email prompted by then-Chairman Issa’s request?” Bardella asked. “As is status quo with the Clintons, there are far more questions than answers and it’s likely that these revelations of her secrecy are just the tip of the iceberg.”

A State Department spokesman defended the agency’s response.

“The Department responds to thousands of Congressional inquiries and requests for information each year,” spokesman Alec Gerlach said in a statement. “In its March 2013 letter, the Department responded to the House Oversight Committee’s inquiry into the Department’s ‘policies and practices regarding the use of personal e-mail and other forms of electronic communications’ with a letter that described those policies in detail. We continue to work closely with Congress on various issues on the Department’s policies and procedures.”

The emails Clinton turned over to the State Department in paper form in December totaled about 55,000 pages. She said at her news conference last month that she deleted another set of emails, which aides said was of comparable size, after her lawyers concluded they were not work-related.

State Department officials have pledged to publicly release a redacted version of the emails Clinton turned over. That process is expected to take several months, but officials have declined to commit to a specific date.

This makes all emails much harder to obtain for a prosecuter. This makes any attempt at running for president impossible. Democrats are embarrassed. The ones that matter.

This is stupid.
If her private email gets hacked, she has nobody but herself to blame.



I believe you are missing the bigger picture, explicitly or not. The point is she did ALL STATE BUSINESS on her private email... Ok... But with whom?


You need both party to agree to use the back channel. If she is guilty, how come everyone who dealt with her emails aren't?

Very valid point. To do business via mail, you need two parties. But this is really interesting that people on such high level can be that much innocent to not to know the implications of such acts of theirs.
