So he is not issuing refunds, he isn't shipping boards, but he is mining for himself. Why do people still believe that ken will do the right thing?

So he is not issuing refunds - correct.  None and no word from him.

he isn't shipping boards, - he is but they have a 75% DOA / Failure rate with only a 10 day warranty.

but he is mining for himself - Yes if you take the shareholders as having been scammed. if the 75% DOA rate of the cards is also applying to his farm then the 200TH target will only ever get to about 50TH.

Why do people still believe that ken will do the right thing?  - he should give all money back and stop being involved in bitcoin.

@Magzy We are starting today to issue refunds including your check today.

Edit:  @Magzy  In getting your check ready, we found in our records that we have already issued our check number 123 on 2/17/14 to you.  That check has not cleared our bank, so we are put a stop payment on that check and re-issuing another check to you.

Would publishing AMC's bitcoin address add transparency since we can see proof of purchase of Avalon chips, etc.

I think it would:  Here is the address we are holding bitcoins at to purchase the chips:  16yTynjmSe5bsRGykDaaCL5bm2pxiEfcqP
We would like to purchase a full batch as group purchases have a commission of about 9.5%
----

looking forwards to financial reports, since the movement of ACTM funds is astounding, as well-blurred as anything mtgox ever did. here are some addresses to start the hunt at:

https://blockchain.info/address/1DJpsvnM7xTnQbWEhLYyCyfxQyxwupEzCa?filter=1     (all the sent funds from the current eligius mining address)
https://blockchain.info/address/16yTynjmSe5bsRGykDaaCL5bm2pxiEfcqP  (where most of these funds went, a known account of ken's that was to purchase chips from)
https://blockchain.info/address/1HtoMBUKzRgS5X9WdnwZiQKQccvWBCPGx
https://blockchain.info/address/1LJDfEYvBG18LNXUG6xeSCrs3B4sdBKb1D    (200BTC came here and then was split into 4 50BTC addresses)
https://blockchain.info/address/1MLqgV2E3GRDTXYxpDzGqTnnekuuC8i8GV (1 of said addresses - split into 4 more new addresses)
https://blockchain.info/address/1M9fztr3SKAw6iZjFeiR6V99qtmed6Ro8V  (follow the chain, one address ends here and still holds funds that were put in 3 days ago)
https://blockchain.info/address/1HpDXKMfNd5Z6rUVvk5oEdN2nRbF47D6WY (another address with 98BTC, most of which is split evenly into 4 new addresses TODAY)

who knows which of these are under the control of ACTM or hashfast?  It seems very strange that ken has no financials after the APril 1st deadline, and the funds are dispersed over a HUGE expanse of small addresses, rather than a few large publicly-known addresses for auditing purposes.

^and before anyone says a big single address is a bad idea - it isnt. Bitmain has something like 20,000 bitcoins held in a single address safely. everyone can see bitmain's holdings in a simple transparent way.

All of our holding are held in the first two addresses above.  The first being our mining account, the second being our general funds account.  Some of the other accounts are either our coinbase accounts for converting funds to pay our bills, or our vendors accounts where we paid them in bitcoins.

Are you planning to fill out the SEC's forum D, register and then pay the fee for every state you have shareholders in? Do you realize how much time and money this costs? If you are planning to go this route like it has been stated before the trading platform will not matter.. The other thing that does not matter is by allowing us to trade our shares, all your doing is giving us what we have already bought from you. How do we know coloredcoins are going to be allowed by the SEC when we already know Havelock has all its proper credentials. In the SEC's eyes this is a very minor crime and at the very worst you get a small fine.. If there has been some kind of infraction committed you have already committed it,, you can't get charged for the same crime twice.
Give us back what we own Ken, they are not your shares anymore.
https://www.sec.gov/answers/formd.htm

Why don't you pay that small fine. ($100,000) for me.  By the way Havelock does not have all the proper credentials for the SEC.

I know they are the shareholder shares, I have never claimed that I own the shareholders shares.

You don't have to register in every state if it is a federal covered security.

Explain how you were allowed to list shares on cryptotrade?

The shares was listed on crypto-trade before the MSD Investigation.

Hi Ken,

What is the time frame for listing our shares on an exchange?  Is it days, weeks or months?

I think it will be sooner rather than later; however, it is somewhat controlled by the MSD Investigation.

Quote
If there must be a further delay, will you consider completing the verification process sooner and before we have access to our shares? This will create a better mood amongst shareholders and would be a good PR move.  If this isn't going to happen please explain why it is not possible.  If it can be done, could you tell me how soon you could do it.

I am planning on doing the verification process sooner.  There are are number of events which are affecting the process.

Quote
Are you able to pay out dividends to bitcoin addresses before the shares get listed on an exchange?  This would also be a good PR move on your part.

At the moment the MSD Investigation is controlling this.

Quote

You said you are working on some ideas regarding getting us access to our shares.  Can you explain what these are please?

I can't at this time due to the MSD Investigation as they are reading the forum.

Quote
If the MSD investigation is preventing you from listing our shares then can you explain why shares continue to be tradable on two other exchanges and why you didn't cease this activity to when you became aware that you couldn't list the tendered shares from Bitfunder.

The shares on the exchanges were being traded before the MSD Investigation.

Quote
If this final question can't be answered for legal reasons, I understand, however I would really appreciate you giving as much info as you can.

I want to get the shares trading; however, I don't want to pour gas on the MSD Investigation.  I have a number of solutions to the problem, one of which is getting the shares registered.  The problem with bitcoin exchanges are that they are not registered.  So, my thinking is CC.  CC is not an exchange, it is a way shareholders can direct trade shares with each other.  So, my thinking is if I can get the shares registered, then shareholder could use CC to trade direct and the SEC would not have a problem with that as long as the shares are registered.

Thank you.

Weekly Update 4/16/2014

MSD Investigation:  I will be talking with our legal council as to what action I can take with the shares in the next few weeks.  I know everyone is ready to start trading; however, I am in a difficult position at the moment.  I am working on solutions to this problem.  Long term for shareholders, I think CC is the answer.

Can you address why you said it would be ready this week if you're lawyer hadn't said it was ok yet? If you can't do it yet, stop telling us you can do it.

At the very least you should let us confirm our holdings with you. Not necessarily put it on a exchange, just let us make sure it's ok. Then you'll also be setup to start paying dividends direct to addresses.

Can you tell us what's happening with our chips? Our we still working on our own? What's the progress with them?

What happened to the financial reports? You said you have someone else working on it. Are they still working on it? When do you expect them to be ready?

Yes, we are getting an accountant to working on our books, now that tax season is over.

Weekly Update 4/16/2014

Datacenter is up to ~42 TH/s and we have added a 150 Kva transformer for more power.  We have ordered more equipment and racks and our next expansion will be 5 more racks at ~12.5 TH/s each bringing our total to ~100 TH/s.

VMC:  We now have in stock our Gold Rush mining card which is a ~750 GH/s card, these will be available on our website soon.

Has anyone received their requested refund?  Please post --- Its been approx 4 weeks [a couple days short] since I've requested mine [and, of course, no refund].

Ken has promised me personally and publicly that the refunds will happen this week.

Yes, we will start sending out refunds this next week.  There is a queue of refunds, but we will start this week.

Can you elaborate roughly how many refund checks are to be processed?

Will you get through them all this next week?

Most likely not, but we will start issuing them.

Have anyone else , except Bargraphics , received their Prospector Boards ?

I converted my November Paid Pre-Order to Prospector boards 12 days back .
Its been showing ''Shipped'' Since 2 days , But i have not been provided with any tracking number .

What is the status Ken , Please provide the tracking info .

You should be able to contact customer service with issues like these. I'd be curious to hear how easy it is for customers to get in touch with VMC through the proper channels. Could you try and report back?

I have ask the project manager to have the staff enter the tracking information into the shopping cart.

Ken when will shares go live?

Have you verified your shares yet?

What do you mean by "verified"?  Does Ken not know who owns shares in his company? What about "Ukyo's shares", of which Ken clearly claimed to know the ownership when he dumped them on the exchange where those shares, among others, are still trading?

They have to be verified and matched to the users CT account.

I know the horse has been beaten to death. But have you put much thought into Havelock? It's been around longer than CT and AMC wouldn't be one of the only companies on the exchange.

I have thought about Havelock.  I feel that that same thing that happen to bitfunder is going to happen to Havelock.

Edit:  I think either on of these is just a stop gap until CC are ready.

Even if Havelock is a stop gap, could we use them for now?

Also counterparty seems to be more refined than CC, remember the lead dev of CC wants out.

I will be reviewing all systems that are available when they are more mature.
