中国の弁護士の一斉連行を憂慮し、弁護士の職務活動の保障等を求める会長声明

 
 
中国において本年７月９日以降、人権活動に携わる多数の弁護士らが一斉に連行され、その数は一時的な連行・拘束も含めて２００人以上に及ぶとも報道されている。今回の一斉連行は、報道によれば、弁護士の職務や活動を問題にしてなされたとのことである。

１９９０年に第８回国連犯罪防止刑事司法会議が採択した「法律家の役割に関する基本原則」は、「法律家は、裁判所、法廷その他の法的・行政上の機関において、書面や口頭の主張または専門的外観において善意でなされた関連する発言について、民事及び刑事上の免責を享受するものとされる」（２０条）とし、また、法律家の表現の自由をはじめとした諸権利を確認した上で、「法律家が適法な行動や適法な組織に参加したことの故をもって、彼／彼女らの弁護士としての活動が制限されることがあってはならない」（２３条）と述べて、法律家の職務及び表現活動を保障している。上記弁護士がその職務活動及び表現活動を理由に捜査を受け、勾留されているとすれば、上記の基本原則に明白に違反するものである。

日本弁護士連合会は、今回の中国の弁護士らの一斉連行の報道に接し、深く憂慮する。弁護士の独立は、弁護士が法の支配を促進する職責を全うするために重要なものである。当連合会は、上記基本原則に照らし、弁護士の職務活動及び表現の自由が保障されるべきであり、これに対する不当な制約がなされてはならないことを強く訴える。

Activist in Bid to Find Whereabouts of Detained Chinese Rights Lawyer Wang Yu

A Chinese lawyer has filed a formal information request to police in the northern city of Tianjin in a bid to find out the whereabouts of his lawyer, detained rights attorney Wang Yu, who has been held at an unknown location since the start of a nationwide crackdown on the legal profession.

Yu Wensheng filed the freedom of information request online on Saturday, calling on Tianjin police to reveal her location, and what crimes she is suspected of committing.

“Nobody knows what has happened to Wang Yu, and we only know that she was criminally detained through the media,” Yu told RFA. “Even her relatives and her defense attorneys don’t know.”

“Wang Yu was also my defense attorney, and because I am currently out on bail, from a legal perspective, I have an interest in her case, and I also believe I have a duty to understand her whereabouts and the nature of the charges against her,” he said.

“That’s why I filed the freedom of information request with the police.”

Since Wang’s detention amid a night-time raid on the Beijing-based Fengrui law firm on July 10, at least 255 lawyers, paralegals and legal support staff have been detained or questioned by Chinese police, the Hong Kong-based Chinese Human Rights Lawyers Concern Group said in a statement on its website.



Lawyers in undisclosed locations

Of those, 230 have since been released, but 12 lawyers and three non-lawyers are still being held in undisclosed locations, including Wang Yu, her husband Bao Longjun, and Fengrui colleagues Wang Quanzhang, Huang Liqun and Zhou Shifeng, it said.

China’s tightly controlled state media has accused the Fengrui lawyers of “troublemaking” and seeking to incite mass incidents by publicizing cases where they defend some of the most vulnerable groups in society.

According to Yu, the lack of information about Wang’s whereabouts contravenes China’s Criminal Procedure Law. “Such a large-scale detention of lawyers is also in breach of legal procedural regulations,” he said.

“I think they are trying to create a climate of fear for lawyers, so that some of them won’t dare to speak out, or may not take on human rights cases,” Yu said. “But I don’t think they will succeed in their aim.”

“Maybe some rights lawyers will be silenced, but even more will rise up in opposition, and still more will want to enter the profession of human rights lawyers,” he said.

Rights lawyer Chen Jiangang said that information on the whereabouts of detainees should be given to relatives and lawyers as a matter of course.

“Nobody should have to apply for it,” Chen said. “The police should formally notify the families within a time period specified by law, but China’s police don’t abide by the law at all nowadays.”

“Every step they take is against the law now.”



Fearless 'warrior' Wang

An officer who answered the phone at the Tianjin police department declined to comment on the case.

“For freedom of information requests, you need to contact the complaints department, or you can call them and try,” the officer said. “I don’t really know about this.”

The overseas-based Chinese Human Rights Defenders (CHRD) group said Wang Yu is described by those who know her as a courageous and fearless “warrior.”

“She has raced to the front lines of rights defense work in China to provide legal aid to those in need, regardless of how difficult or politically sensitive a case is,” it said in a statement on its website.

Wang has represented activists, scholars, members of the banned Falun Gong spiritual group, farmers who lost their land, forced evictees and petitioners seeking to protect their rights, those of women and children, and the right to freedom of religion, housing and of expression, CHRD said.

“Wang Yu has frequently been harassed, threatened, searched, and physically assaulted by police since she began to take on rights abuse cases in 2011,” it said

Meanwhile, authorities in the southern Chinese province of Guangdong detained rights activist Jia Pin after he tried to attend the subversion trial of the Guangzhou Three rights activists last week.

“Jia Pin turned out in support at the trial of Tang Jingling, and he was taken away by police at the gates to the court along with a lot of other people … from across the country,” a friend of Jia’s who asked to remain anonymous told RFA. “They are all safe and we have heard from all of them now, except for Jia Pin.”

“He was taken onto a train by six state security police officers, for escort back to his hometown, and we were able to talk with him by phone while he was on the train, but after he got off the train, they moved him to a state security police building in Nanyang, Henan province,” the friend said.

“There has been no word from him since, and we are all very worried; Jia Pin has done a lot of rights activism and the state security police from Nanyang have never come looking for him before, so we think things could go very badly for him this time,” the friend said.

'Chanting Monks' Deployed in Standoff Over Cross Demolition in China’s Zhejiang

Officials in China’s eastern province of Zhejiang sent in monks to burn incense and chant Buddhist scriptures as a “provocation” as Christian believers faced off with a government-backed demolition gang intent on removing a large cross from the roof of their church, church members told RFA on Monday.

The monks came in and chanted prayers, burning incense at the door of the Jinjia’er church in Zhejiang’s Huzhou city, where believers had been staging a sit-in in the hope of blocking access by the demolition gang for several days, a church follower who asked not to be named told RFA.

“We are Protestant Christians, so by sending monks to chant sutras they were trying to get us riled up,” the Jinjia’er congregant said. “They blocked the main door, and they were detaining anyone who got physical with them on public order charges.”

“They were trying to make us angry so that we would retaliate against them. They think that anyone who opposes the government is a traitor, or someone trying to overturn the Communist Party,” he said.

“Anyone who opposes them risks being stuck with this label.”

The authorities had also moved quickly to delete any social media posts about the standoff on China’s Twitter-like platforms, and from social messaging app WeChat, he said, adding that the cross was eventually demolished by the government on Sunday.

The demolition came as the authorities target churches in Zhejiang, and Wenzhou city, which has been dubbed “China’s Jerusalem” owing to its large proportion of Protestant believers.



Tearful congregation sings

The provincial government has kept up the "Three Rectifications and One Demolition" campaign, which claims to target all illegal structures, for several months now, rights groups say.

Local officials are required to take action to "demolish illegal structures that violate laws and regulations, occupy farmland, affect public safety and major construction, seriously affect urban and rural planning, and those that are located on both sides of main lines of transportation," according to guidelines published last year on the provincial government’s website.

In Wenzhou, a member of the Yuyangtaitou church in Wenzhou’s Pingyang county said their church’s cross had also been demolished by the authorities on Monday.

Video footage shot by congregants and seen by RFA showed government officials lowering the cross gradually to the ground using ropes, watched by a tearful congregation singing hymns.

“The cross is gone; they took it down this morning,” the Yuyangtaitou church member said on Monday. “Why did they demolish the cross for no reason? This was pointless. It’s not like it was getting in the way of anything.”

“This church has been in our village for several decades; I knew it while I was growing up.”

Local media reports said the Pingyang county government had announced that all visible crosses in the county would be removed by Aug. 5.

Zhejiang authorities are also taking draconian steps to manage online references to the cross demolition campaign.

Protestant believer Zheng Xianghuang said he had received a visit from Zhejiang state security police at his home the southwestern province of Sichuan after he posted a photo of a cross demolition on a social media site.

“A few hours after I posted it to my microblog account it had been retweeted more than 1,000 times, and had been viewed tens of thousands of times,” Zheng told RFA on Monday. “Maybe it touched on somebody’s vested interests … or perhaps it prompted some kind of campaign, because they came here … all the way from Pingyang county.”



Police plant malware

He said that, before they left, police admitted having placed surveillance malware on his computer.

“My QQ [chatroom account], my WeChat and my microblog accounts are all being monitored,” Zheng said. “When the police were here, they clearly indicated that the [malware] had been installed by them.”

Meanwhile, Zhejiang-based Protestant pastor Zhang Chongzhu said the demolition program shows no sign of abating.

“As well as the cross demolitions, the government is carrying out ideological work with all parties,” Zhang said. “It’s not just the crosses that they’re targeting.”

“The government wants to turn the Protestant church into a truly Chinese institution, which is to say that it wants it to become a tool of the party.”

“They have already begun this work of reclamation in the bigger churches; those that have more than 100 or 200 members,” he said.

President Xi Jinping warned Communist Party ideologues earlier this year that the development of religion in China, which is already closely controlled by an army of religious affairs officials, should be "independent of foreign influence."

Citing the rapid expansion in Christian believers after churches began to re-open in the wake of the political turmoil of the Cultural Revolution (1966-1976), Xi has described religion is a tool that can easily be used "by hostile foreign forces."

浙江湖州、温州十字架连续被拆 信徒网上发帖被以“造谣”行拘

浙江湖州金家兜教会十字架周日遭到拆除。此前，信徒连续多日守护十字架，政府则派和尚在教会外诵经、烧香。温州平阳县榆洋镇台头教堂十字架也于周一遭强拆。此外，据大陆媒体报道，有基督教信徒因在微博发布龙湾双村教堂十字架被拆的帖子，被以“造谣”为名行政拘留5天。

浙江当局强拆教堂十字架的行动持续进行。湖州金家兜教会信徒为了阻止教会十字架被拆，此前连日轮流守护。不过，周日（7月26日），信徒们守护了多日的十字架最终仍然遭到拆除。

当地一名信徒告诉本台，政府在强拆前，曾派和尚前往教会诵经，或意在激怒他们。而她将有关情况发布到网上后，不出一日就遭到屏蔽。

“搞了和尚啊、村民、老太婆在教堂门口烧香，强拆（十字架）。”

记者：“他们为什么要找和尚来念经？”

对方：“这个道理么，就是我们基督教的嘛，找和尚来念经，你们不是很反感。把大门堵住了，你要跟他发生肢体冲突的话，他们就把你拘留起来，说你扰乱治安罪。就是激起你的怒气，和他们去对抗。主要的目的，他们可能也是想借着把你们十字架拆掉——就好比一个国家的国旗，对信徒来说，就是这么看待十字架——如果你们不服政府，你们就是叛国、就是乱党、就是对抗共产党。所以弟兄姊妹，不管你怎么欺压他们都不跟他们发生冲突，因为如果再反对的话，帽子扣上去还要大。现在微博都屏蔽掉了，24小时都不到，微薄已经屏蔽掉了，有关这个话题，微博也好、微信也好，转发马上都屏蔽掉。我们也很无助，我们只有求靠神。”

上述信徒感叹，他们始终是弱势群体，无法与政府对抗，也无法守住他们的十字架。

此外，浙江温州平阳县榆洋台头教堂十字架周一上午也遭到强拆。从信徒提供的视频可见，政府人员用电锯将十字架缓缓锯下，信徒们则在教堂内含泪唱诗。

一名台头村民当天接受本台采访时表示，被拆的教堂已有几十年的历史，无法理解为何政府一定要拆除十字架。

“（十字架）拆掉了，拆掉了。”

记者：“已经拆掉了？”

对方：“嗯，早上拆掉的。无缘无故把十字架拆掉干嘛，这个没道理的嘛，它又不妨碍什么。”

记者：“这个十字架大概有多少年的历史？”

对方：“我们村老的这个教堂几十年了，我从小就知道了。”

此前，平阳县当局曾表示，要在9月底前拆光教堂十字架。无独有偶，一名瑞安信徒日前告诉本台，地方政府已经放话将于8月5日前拆除当地所有的十字架。

另据《温州日报》日前的报道，苍南县港籍青年林某某（系基督教信徒）因在微博上发帖散布涉宗教场所“三改一拆”严重不实言论，被处以行政拘留5日的处罚。报道称，7月22日，新浪微博里出现“龙湾永强双村基督教堂十字架被强拆”的网帖，并配发了一组照片。该微博被多次转发后，引起宗教界对党和政府宗教自由政策的误解，从而产生了较大的社会负面影响。7月24日，林某某被依法传唤到案。经教育，林某某表示，网帖内容自己未经核实，与真实情况严重不符，之所以这么发帖，是为了发泄不满情绪。

报道没有提及林某某所发布的网帖具体内容。不过，本台记者曾于7月22日采访了双村教堂的牧师，证实强拆十字架确有其事。

报道引发一些基督徒的愤怒，质问究竟谁在造谣？

Tibetan Political Prisoner Dies After 14 Months in Custody

A Tibetan village chief being held in prison for his role in protests against a Chinese gold mine died in a Lhasa hospital,  a Tibetan source living in exile told RFA's Tibetan Service.

Lobsang Yeshi, a father of eight in his 60s, died on July 19 at Lhasa Hospital, where he had been taken after his health deteriorated in Ngulchul prison in Lhasa, the source told RFA.

The cause of the man's death was not immediately clear. But the website of the Central Tibetan Administration (CTA), the Tibetan exile government in India, said he had been tortured since his detention in May 2014 after a protest in his village.

"Due to severe beating in the prison, Lobsang Yeshi sustained grievous injuries and suffered dizziness as a result of poor health," said the CTA report.

Lobsang Yeshi, who was the head of Gewar village in (In Chinese, Changdu) prefecture of the Tibet Autonomous Region, near where a Chinese mine was being built, and two other village men were sentenced to two years in jail for their roles in protests that rocked the village a year earlier.

On May 7, 2014, Gewar village resident Phakpa Gyaltsen died in a solitary protest after stabbing himself and jumping from a building in Tongbar town to oppose Chinese plans to mine gold in an area of Dzogang (Zuogang) near Madok Tso called Ache Jema, according to Tibetan sources at the time.

"At that time, the Tibetans, led by some elderly Tibetans including Lobsang Yeshi who was head of the village, protested at Dzogang county center. The protest continued even after threatening warnings given by Chamdo and Dzogang police," the exiled Tibetan source told RFA.

"The leader and others continued with frequent protests and refused to budge under the threat. The tension was eased when the county level officials tried to mediate between the police and the protestors and allowed the Tibetans to go home without any action," the source added.

Later, however, Lobsang Yeshi was one of seven Tibetans taken into custody by the authorities and detained in Dzogang county for almost one year, he said.

Tibetan areas of China have become an important source of minerals needed for China’s economic growth, and mining operations have led to frequent standoffs with Tibetans who accuse Chinese firms of disrupting sites of spiritual significance and polluting the environment as they extract local wealth.

“None of the relatives and friends of Lobsang Yeshi was allowed to see his body. Only a monk was finally allowed in to see his body and conduct prayer," the exile source said.

Lobsang Yeshi's body was cremated on July 21, with two of his brothers attending the cremation, the source said.
