Chinese Authorities Snatch Tenzin Delek Rinpoche's Ashes from Tibetans

The ashes of Tenzin Delek Rinpoche were forcibly taken from Tibetans who were carrying the revered monk's cremated remains to his home county of Nyagchuka, a Tibetan living in India told RFA’s Tibetan Service on Monday.

Tenzin Delek Rinpoche, 65, who died on July 12 in the 13th year of a life sentence imposed for what rights groups and supporters have described as a wrongful conviction on a bombing charge, was cremated by prison authorities on July 16 against the wishes of his family.

Four Tibetans who stayed in the Sichuan capital, Chengdu, to receive the ashes were carrying them back to Nyagchuka (in Chinese, Yajiang) and stopped over night at a town in Jagsamka (Luding) county on July 16.

"At that time, the Chinese authorities came to them in the night and forced them to give back the remains. They even threatened to throw the ashes into the local river in Luding," Geshe Jamyang Nyima, a source in exile with connections to the monk's family, told RFA.

"We don’t know whether they actually dumped the ashes in the river or not, but it was an unfortunate incident,” he added.

The death in prison of Tenzin Delek Rinpoche, who was widely respected among Tibetans for his efforts to protect Tibetan culture and the environment, added to simmering tensions in Tibetan parts of Sichuan and beyond.

The cremation in defiance of his family's request that his remains be returned to them was followed by the detention of the sister of Tenzin Delek Rinpoche and that  woman’s daughter. Dolkar Lhamo, 55, and Nyima Lhamo, aged about 25, were detained in the provincial capital Chengdu at about 8:00 a.m. on July 17 by police sent from their native Lithang (Litang) county.

“It was extremely horrible action on the part of the Chinese authorities. Even if the body was not handed over to the relatives and students, snatching the remains of the cremated body of Rinpoche after it was handed over was unimaginable," said Geshe Jamyang Nyima.

"They should at least leave the relatives alone in peace. But his sister Dolkar Lhamo and her daughter were taken away by Lithang police from Chengdu town on July 17, and nothing has been heard about them, too. It is sheer bullying and unreasonable," he added.

Teng Biao is a human rights lawyer and a visiting fellow at New York University’s U.S.-Asia Law Institute.

At around 3 a.m. on July 9, human rights lawyer Wang Yu was abducted from her home in Beijing. Her husband, rights defender Bao Longjun, was also disappeared. Wang is renowned in China: She represented Cao Shunli, who died after being denied medical treatment while in custody for her human rights activism; Ilham Tohti, a Uigher scholar unjustly sentenced to life in prison; and protest organizer Wu Gan. In the days since Wang’s arrest, dozens of human rights lawyers and others have been abducted, arrested and disappeared; all told, including those who have been temporarily detained or given warnings, the sweep has targeted more than 200 people in 24 provinces.

This is the biggest crackdown on lawyers in China since the legal system was reestablished in 1980 after the Cultural Revolution.

It is also just part of the purge that President Xi Jinping has carried out against civil society since he came to power in late 2012. Those hit by this comprehensive suppression have included political dissidents, nongovernmental organizations, government petitioners, underground churches, Internet users, news organizations and universities. More than 1,500 rights defenders have been arrested or thrown into jail, including well-known lawyers Xu Zhiyong, Pu Zhiqiang and Tang Jingling.

But this repression has not succeeded at forcing the lawyers into retreat. In the courts, on the Internet and in the streets, China’s human rights lawyers remain active. Since the rights defense movement emerged in 2003, their numbers have grown from dozens to a thousand. They use the legal system to protect the rights and freedoms of citizens, and wield the Internet and media to expose abuses of power and the justice system. There is little doubt that they have become one of the most spirited and active civil forces in China.

As professionals with a thorough understanding of the law and a deep familiarity with political and social conditions, rights lawyers have, case by case, brought together a disparate range of social groups: the victims of forced housing demolitions, legal injustice, forced abortion policies, pollution and poisoned foods and medication; persecuted Christians and Falun Gong practitioners; prisoners of conscience; and many others. China’s rights lawyers are the link between them all.


The Chinese Communist Party sensed from the beginning that rights lawyers were a deep threat and thus has never eased its persecution of them. The brilliant Gao Zhisheng suffered extraordinarily cruel torture after he defended Falun Gong. Others have been thrown into forced labor camps or jail while still others have been abducted or disappeared. Many have simply had their legal licenses revoked. I, too, have been abducted, locked up and tortured.

If they chose, these professionals could reap a substantial salary doing other sorts of legal work — but their belief in the rule of law and liberty and their sense of responsibility leads them to this path. It is one beset by thorns, but it is also full of honor. They win the love and respect of ordinary people and they accumulate social influence. Working together in the battle for human rights, through the relentless persecution, they have formed deep friendships. Using social media, they have brought together an informal organization that can be rapidly mobilized. Every time there’s a serious legal incident, hundreds of them take steps to publicize the matter, mobilize citizens to make their voices heard and, when necessary, dispatch lawyers to take up the case.

Over a decade ago, the Communist Party determined that rights lawyers were an enemy on par with underground religious groups, dissidents and online opinion leaders. So the current purge is no surprise. The security agencies struck just over a week after a new national security law went into effect on July 1 — as though they simply couldn’t wait.

But isn’t there a profound dread lurking behind this barbarism? President Xi has done much to bring back the ideological patterns of the Mao Zedong era, including the recycling of old slogans, the shutting of NGOs, the arrest of dissidents and enhanced controls on the spread of information — all of it is a sign of the party’s deep fear of a color revolution. But the party no longer has the ability to carry out the frantic, Mao-style mobilizations of the past. Its ideology has lost all attraction, and the public’s frustration with the party is growing. People are more willing to criticize the regime in public, and the spread of access to the Internet has stunted the effect of the party’s propaganda.

Increasingly, it’s not just those targeted by the regime that fume: The stock market’s recent crash led even the middle class to fury and disappointment. The party’s attempts to project confidence do little to disguise its panic: It is beset by economic strife, antagonism between officials and the people, corruption, ecological disasters, unrest in Xinjiang and Tibet, and its own sense of ideological crisis.


Compared with all of this, the rights lawyer and civil society activists are gaining in prestige, influence and communications and organizational capacity. Little wonder they keep the party up at night.

The arrests of the past week mark an important historical moment in China’s legal profession. It’s likely that, just as in the past, those who were disappeared are being tortured. But this crackdown won’t silence the rights lawyers, and it won’t stop the march toward human rights and dignity in China. Rights lawyers will rise from the ashes with an even deeper sense of their historical responsibility.

Not long after coming to power in 1949, the Communist Party extinguished the legal profession almost entirely — for more than 20 years there were no lawyers, and the country was engulfed in chaos. Does Xi and the party wish to relive the nightmare of lawlessness of those years? When will they release China’s prisoners of conscience?

When Xi visits the United States this year, these are the questions that President Obama ought to put to him.

Beijing’s policies in Tibetan-populated areas of China are rapidly destroying Tibet’s religion and culture and are harming the region’s environment, according to a final testament written by a Tibetan monk before his death in a fiery protest early this month in Qinghai.

Writing in a document left behind in a prayer book, and later discovered in his living quarters by his family, self-immolator Sonam Topgyal slams China’s “brutal and repressive policy aimed at eradicating and exterminating [Tibet’s] religion, customs, and cultural tradition.”

“The Tibetan people have no freedom of expression. There is nowhere we can go to lodge our complaints,” says the document, which was written on June 1 “at sunrise” and addressed to “the leaders of the People’s Republic of China in general, and to the Chinese leaders of the [Tibetan] ethnic minority in particular.”

China's policies "are also resulting in environmental destruction" in Tibetan areas, the document says.

Topgyal, 27, set himself ablaze at about 6:00 p.m. on July 9 in the central square of Kyegudo in the Yulshu (in Chinese, Yushu) Tibetan Autonomous Prefecture, prompting an immediate security clampdown, including a disruption of communications in the area, sources told RFA in earlier reports.

He died next day in a hospital in the Qinghai provincial capital Xining.

'Testimony to the world'

Following their release on July 13 after briefly being held by authorities, Topgyal’s family members went to clean his living quarters, Konchog Dondrub, a Yulshul native now living in India, told RFA’s Tibetan Service on Thursday.

“There, they found a one-page written will tucked inside his prayer book,” Dondrub said, citing contacts in the region.

Chinese authorities routinely impose restrictions on Tibetan religious and other cultural practices, says the document, a copy of which was recently obtained by RFA.

"And Tibetans who petition for the welfare of their people are met with repression and arrest,” the document says.

“The Chinese have never shown any consideration of the [Tibetan] people’s welfare or wishes by addressing their concerns."

“I had to sacrifice my life to bear testimony to the world, and particularly to the Chinese government and people, that we have no freedom to express our grievances or tell the truth,” Topgyal wrote.

“I appeal to my Tibetan brothers and sisters, who have the same lineage and blood, to muster the power of unity and harmony by working toward resolving Tibetan issues in a concerted effort.”

Topgyal’s self-immolation brings to 142 the total number of burnings by Tibetans living in China since the wave of fiery protests calling for Tibetan freedom and the return of exiled spiritual leader the Dalai Lama began in 2009.

海南警察枪杀吴英焕事件在网络引起了很大关注，网民对其中存在的疑问极多。这一事件给社会带来的恐慌性影响仍然在发酵中。因为人们不会忘记在两个月前黑龙江省庆安县火车站徐纯和被警察枪杀事件，庆安事件给社会的震惊不仅是警察当众击毙徐纯和，而且是后来全国民众如何千呼万唤地要求公布监控录像，但最后只是看到官方部分剪辑录像，而且这个经过剪辑的录像中同样出现诸多疑点，难以证明所谓的袭警事实。徐纯和事件之所以引起公民如此关注，皆因公民从这件事身上看到自身生命面临的危险。公民起来要求调查真相，目的既有为徐纯和讨说法，也有给自己的生存找依据，为自己的生命安全找理由的成份。然而，公民调查不仅没有得到应有的支持保护，相反却招来了抓捕。这给原本疑点多多的事件增添了更多的疑惑。公正和法治的基本前提就是真相，所以，没有真相就不可能有公正和法治。


 
据《海南特区报》7月15日的《海南一男子被警察叫出家门 争吵后遭一枪打死》的报道：7月14日早上7时许，屯昌坡心镇枫木村40多岁的村民吴英焕在自家门口被人开枪打死。住在隔壁的嫂子符海燕目睹了整个过程。符海燕介绍，一辆警车上下来4个人，他们把吴英焕叫出来后，双方发生了简短的争吵。突然，其中一人开枪打死了吴英焕。“我当时看到弟弟手上什么也没拿。”符海燕说。
 
然而，7月15日下午，海南省屯昌县县委宣传部称，14日早上7点15分左右，枫木村吸毒可疑人员吴英焕持刀冲出家门欲袭警。民警两次口头警告无效后，当场用枪将其击毙。
对于同一事件，海南特区报记者采访情况与屯昌县县委宣传部发布的结果截然不同。记者采访到目击者说死者（吴英焕）“手上什么也没有拿”，而宣传部说；“吴英焕持刀冲出家门欲袭警”。从警方通过宣传部门提供的证据来看，其中拍摄到一把农村家中常用的砍柴刀。
 
对照《海南特区报》与屯昌县宣传部对此事件的报道情况，可以发现如下一些明显的疑点：
 
其一、特区报记者第一时间赶到现场采访到第一目击人符海燕。她说自己亲眼看到警察是叫出吴英焕，而宣传部说警察冲入了吴英焕家中，发现吴英焕拿着砍刀冲出门来。这个情节相差较大。目击者在警车到来时就在相距10来米的地方，对车上下来警察描述非常准确，并且看到四个警察在门口叫喊吴英焕，以及吴出来后与警察发生争执，随后来人用枪将吴打死。目击者还特别强调没有看到吴英焕手上拿着什么，并且还描述说看到吴双手差腰的情节。这些情节可以说明符海燕的确就在现场，并且见证了全过程。而宣传部披露警方冲入家中，吴英焕持着砍刀冲出，这个过程与第一目击人描述完全不符。
 
其二、那把被提供出来作为袭警证据的砍刀怎么会不在吴英焕的手上？如果警方所言属实，的确吴英焕持刀袭警，那么砍刀肯定在吴英焕的手上，而作为取证定罪专业的警察，绝对不会放过这种将袭警者打死后定罪的照片——那就是吴英焕手握砍刀，横死路上。但怎么会出现那把砍刀并不在吴英焕的手中？这把刀的确是吴英焕袭警的刀吗？
 
其三、假设吴英焕确如警方所言持刀袭警，那么这把刀是如何脱离了吴英焕之手的？而在刀脱离吴英焕之手后，吴英焕面对四个警察还有威胁力吗？也就是说还有袭警能力吗？答案显然是否定的。而在一个没有威胁力的罪犯前，警察需要开枪击毙他吗？警察有这个权力，这符合使枪规定吗？
 
其四、第一目击证人的第一次陈述所见经过与后来陈述有区别。根据常识，人们更倾向于相信她第一次陈述的事实。因为在第一次陈述后，很难保证目击者后来不受到外在因素干扰。根据中国时下现实，一个农村妇女是很难扛得住来自当局的压力的，哪怕是质疑或诱导性的提示。因此，很难肯定符海燕没有受到压力而在随后的陈述中不敢如实说明。
其五、从特区报报道说死者家属承认死者生前吸毒来看，家属是诚实的，没有刻意隐瞒或歪曲的主观意愿。甚至家属都不否认自己对吴英焕的恨，说他没有责任心，不能承担一个父亲的责任。家属尽管痛恨吴英焕吸毒，无责任心，但仍质疑为什么就这样不清不楚将吴英焕打死？由此可见，家属是理性的，并没有想要因吴英焕死而弄出点什么。家属只是质疑这种枪杀方式的合法合理性。
 
海南警察枪杀吴英焕事件在网络引起了很大关注，网民对其中存在的疑问极多。这件事给社会带来的恐慌性影响仍然在发酵中。因为人们不会忘记在两个月前的5月2日，黑龙江省庆安县火车站乘客徐纯和买票进站上车遭到铁路工作人员阻止，引起冲突后，警察出来用警棒追击徐，后来徐在无处躲闪下抢夺了警棒，进而遭到警察当场击毙。
庆安事件给社会的震惊不仅在当众击毙徐纯和上，而是后来全国民众如何千呼万唤地要求公布监控录像，但最后只是看到官方部分剪辑录像，而且这个剪辑的录像中也同样出现诸多疑点，同样难以充分证明袭警事实。
 
就在民众强烈要求观看徐纯和袭警的全部监控录像后，有前往庆安调查事件真相的律师与民间维权人士纷纷被抓捕，而从民间调查的有限消息来看，与官方专业性的剪辑事实出入很大。
 
民众要求事件真相是宪法赋予公民监督公权的基本权利。《宪法》第四十一条： 中华人民共和国公民对于任何国家机关和国家工作人员,有提出批评和建议的权利；对于任何国家机关和国家工作人员的违法失职行为,有向有关国家机关提出申诉、控告或者检举的权利,但是不得捏造或者歪曲事实进行诬告陷害.对于公民的申诉、控告或者检举,有关国家机关必须查清事实,负责处理.任何人不得压制和打击报复.由于国家机关和国家工作人员侵犯公民权利而受到损失的人,有依照法律规定取得赔偿的权利。
 
对于徐纯和的死之所以引起公民如此关注，皆因公民从这件事身上看到自身生命面临的危险。公民起来要求调查真相，目的既有为徐纯和讨说法，也有给自己生存找依据，为自己生命安全找理由的成份。然而，公民调查没有得到应有的支持保护，相反却招来了抓捕。这给原本疑点多多的事件增添了更多的疑惑。
 
而就在庆安事件未了，海南又发生这种在家门口四个警察围着一个村民而将他击毙的情况，而官方的说词在本质上跟庆安事件如出一辙。在网络信息时代，媒体与民众通过各种途径所获得的信息却与官方公布的事实出入甚远。这种当场击毙下，媒体、民间与官方公布的事实相悖，所直接引起的是公民对自身生命安全性的联想，事关生活在这片土地的环境，公民有充分理由来关注与担忧。
 
有警方曾质疑，庆安事件中许多不相关人前往调查要求真相，并且没有直接经济利益，是有不可告人的目的。我今天在此告诉你们，他们的目的就是感到自身生命安全没有保障，他们是因为恐慌，为自己生命寻找安全的理由而前往调查，他们有关心自己生命安全的私心，有想活下去的欲望，有想活得踏实点的奢望。这难道有错吗？难道有罪吗？难道就应该抓捕吗？
 
寻求真相是天赋人权！每个公民有权利知道自己所处国家事关自身生命财产安全的事件的真相。他们质疑乃至前往调查，都是对自己对社会的负责，他们于法于理于情都说得过去。
 
在一个依靠谎言与恐惧维系的社会，太多的欺骗已经让公民无法相信单方的官方任何说词。公民对于那些不直接关乎自己生命安全的事已经麻木了，但对事关自己生死的事是不敢掉以轻心的。庆安事件与海南屯昌事件给民众带来的恐慌是可以想见的。民众因此期待了解真相，期待得到有说服力的事实，是本乎人的自然求生本性。
 
应该说，在世界类似警察当场击毙犯罪嫌疑人的情况并来鲜见，可以说比比皆是。但是，每一次这种击毙都应该给天下人一个真相，这是公权力的责任，也是公民的权利。诚如任何队伍中都有违法犯罪之徒，任何群体都有害群之马一样，警察误杀或者违法枪杀了民众，这在任何国家都会发生，但是究竟是合法使枪还是违法使枪不能只由官方一家说了算，必须在充分的事实真相前给天下民众一个合法合理合情的说法，让民众能够信服。
 
看看海南屯昌枪杀事件与庆安枪杀事件，民众在被严密封锁限制的信息前仍能看到诸多疑点，如何给民众解疑释惑，完全通过官方一家之口，显然难以服众。如何真正能够使事实大白于天下，使事件最终结果让人心服？这显然是社会平稳健康祥和的必备条件，是建设和谐社会的基本功课。
 
从文明世界的经验来看，公权力的为恶单靠公权力自身是无法克服的，必须有公权力之外的公民社会力量来制衡。作为公权力强力机构的警察，如何约制，显然是一个社会无法绕开的课题。警察在执法当然需要使用武器，但武器如何才能合理合法，使天下民众感到是安全而不是威胁，那就不能只是官方说了算，更不能只是警察说了算，而是应该由公民说了算。
 
针对庆安与海南两起接连发生的警察当场枪杀人的事件，公民固然对枪杀本身感到可怕，但在枪杀发生后这种无法得到全面事实真相，无法求得合理合法解释枪杀理由下，官方就一句“袭警”与“符合法规使枪”，更让民众焦虑与恐惧。
 
如果官方真是如自己宣示的为了天下民众服务，那么对于民众这种恐慌就不该视而不见，而要想消除民众这种恐慌，就得有让民众相信的事实，而要想使民众得到可信的事实，就不能单靠官方一家言说，而必须引入中立的能够代表民间的律师、人权捍卫者、公民记者等等独立力量，只有这些力量能够公开无障碍地介入事件调查，才能使民众得到全面的信息，得到对处理结果的认同。否则，只能加大民众的恐慌，加剧官民的裂痕，加深社会的不信任。那样就无法谈及和谐，也无法谈及法治，因为和谐的重要前提之一是互信，而法治的基本前提则是真相。
