Calling for the U.S. government to cancel Chinese President Xi Jinping’s visit to the U.S.
Since the morning of July 10th, the Chinese authorities have begun a large-scale crackdown on human rights lawyers and activists in China. Within two days, over 60 human rights lawyers and activists have been forcefully taken away by the police or “disappeared”. The number is still rising.

Since Xi Jinping came to power, China’s human rights record has kept worsening. Under his reign over 1000 dissidents have been arrested. We urge President Obama and the U.S. government to investigate this case of severe human rights infringement, and, on humanitarian ground, take strong measures to intervene. Xi’s state visit to the U.S. scheduled for September this year should be cancelled, and all official exchanges with the Chinese government should be suspended until this matter is resolved.

现在有一个旨在时刻关注数字货币——比特币的价格走向的基金,如果你持有一个在线经纪账户,就可以购买其股票。但是,你要做好心理准备,因为过程可能会很坎坷。

比特币是一个投机性很强的投资项目——很多金融专家都表示,投资人应当在自己可承担的风险范围内进行投资。但也有一些分析师认为,这个新成立的基金能够使得这种数字货币被投资者更广泛地接受。为了实现这个目标,该基金还需要克服很多困难。

4月份,这支名为比特币投资信托(Bitcoin Investment Trust)的基金开始在美国柜台交易市场(OTCQX)进行交易,股票代号为GBTC。它并不是专门的交易型开放式指数基金。(第一个官方比特币交易型开放式指数基金——文克莱沃斯比特币信托,美国证券交易委员会正在审核其申请。)

比特币投资信托的规模还很小,截至六月底,其净资产仅价值35.6百万美元,已发行股票仅有140万美元。它与比特币的价格不一致,股票价格与资产总值的差距也很大。而且,上月月底,股票价格由第一天的30.12美元跌至42美元,下降了28%。

激发兴趣?

尽管如此,很多分析师还是认为这支基金能够激发一些对于比特币投资的兴趣,就像十年前的黄金ETF(Gold ETFs)的建立一样。

吉尔•卢里亚是韦德布什证券公司(Wedbush)的证券分析师,在比特币市场发展初期他就加入了,他见证了比特币发展成为金融主力的一大步——比特币投资信托的成立。最近还有很多具有里程碑意义的事件:纽约州金融服务局决定管理itBit Trust Co.——一家小型比特币交易所;还有高盛集团经研究公布了比特币在未来金融发展中的地位。

“美国柜台交易市场的清单也是一大进步,”卢西亚说道。“它至少使得一个比特币代理股权适用于所有机构和散户投资人。”每个人都可以直接购买比特币,但是这需要安全交易的专用软件。

2004年11月,全球最大的黄金ETF基金(SPDR Gold Shares)成立,黄金期货交易约为每盎司400美元。于是,基金的流行也成了黄金热的一部分,而且在之后的七年里,价格竟然涨了5倍。“历来,投资者都会尽量控制直接购买和获取黄金的费用,”卡梅隆•文克莱沃斯说道,他是文克莱沃斯比特币信托的创办人之一。“我们相信,对于比特币和比特币交易所交易基金,很多投资人都会有同样的态度。”

与黄金相比,由于正处于鼎盛时期,再加上直接买卖不好掌控,因此比特币的不稳定性更高。而且,比特币市场远比2004年的黄金市场要小和幼稚得多。当然,我们也有足够的理由去相信比特币的用途会更广泛。最近,高盛集团对752名千禧世代进行了调查,结果显示:有44%的人表示他们正在使用、也会继续使用比特币。它还表示,不管是个人还是企业,全球已有超过10万名商家都在一定程度上接受了比特币支付。

股份短缺

除了投资人对于这种电子货币的态度,比特币投资信托还在努力克服一些现实问题。一方面,这支基金的股票交易存在相当大的溢价——7月一号达到19%。这主要是因为该基金发展自一个私人的信托。

私人信托的投资人可以在12个月的套牢之后将自己的股份售出。自5月4日开始,但是股票只能被逐步卖出。这种股份的短缺在一定程度上提升了其市场价值。

然而,卢西亚希望所有的股票都可以在9月份之前被全部售出,从而造成一种所谓的“临界质量”,或者尽可能将基金股票的价格与比特币市场贴近。

这支基金的费用还很高,有2%。而且,很快它就会与文克莱沃斯建立竞争。目前,在斯德哥尔摩证券交易所,纳斯达克(Nasdaq)也推出了一种交易票据,以跟踪比特币的价格走向。

然而,从投资者的角度来看,很多资深经理人都认为这支基金是一个脆弱的高风险产品。

“我认为比特币交易基金对于比特币和交易基金的意义都十分重大,”埃里克•马歇尔表示,他是达拉斯的霍金斯资本管理公司投资组合经理。“现如今,任何事都需要交易基金。”

事实及理由:

原告是谢燕益的合法妻子,在2015年7月18日夜里11点钟通过网上看到新华网的一篇《北京锋锐律所案追踪》一文中提及9名律师等人被依法采取刑事强制措施中包括谢燕益律师,谢燕益并不是锋锐律所的律师也没有任何业务上,金钱上的来往。从这时起,我的电话,微信等就没有停止过,有来至双方父母的哭声,来至朋友的质疑,来至因为电话铃声被吵醒两个不到10岁孩子听到爸爸被抓的害怕,恐惧,此事严重影响整个家庭的生活。谢燕益给家人,朋友的感觉不是麻木不仁者,也不能是一个愤青,而是一位心怀天下,充满智慧,立志高远,时时给人以信心,力量与勇气的人。同时我认为更应该是,出手不凡,超然卓绝的男神!

该文发出后被告责任方竭力掩盖事实真相,通过舆论阵地等违法手段压制真相,给警方对事实真相的披露造成重大困难。在没有任何事实,我作为家属没有收到警方的任何通知的情况下,被告作为全国有重大影响力的媒体,公然歪曲事实作恶性报道,其精巧设计精心编制用心良苦一目了然,在掩盖大量事实的情况下,刻意放大谢燕益作为职业律师应有的,依法,理性代理各种案件,而被告以刑事强制措施进行丑化,企图用舆论掩盖事实真相,把一位律师合法代理案件编造成其他非法事件,不仅误导了公众而且使原告及家人朋友承受舆论的颠倒黑白,对法制国家的质疑。

Lawyer's Teen Son Missing in Widening Crackdown on China's Rights Attorneys

Police in the northern Chinese city of Tianjin have taken the 16-year-old son of detained rights attorney Wang Yu from his home amid an ongoing crackdown on the country's embattled legal profession, lawyers told RFA on Friday.

Wang's detention on July 9 came amid a raid on her law firm, Fengrui, and kicked off a nationwide police operation that has targeted more than 200 public interest and human rights attorneys.

At least 222 lawyers, law firm employees and rights activists had been detained, summoned for questioning, or were incommunicado or held under house arrest by Friday, the Hong Kong-based China Human Rights Lawyers Concern Group (CHRLCG) said in a statement on its website.

Wang's son Bao Mengmeng was taken away by police shortly after apparently texting lawyers who were en route to offer him legal assistance that they shouldn't come, Beijing lawyer Chen Jianggang told RFA.

"They took Bao Mengmeng away as soon as they knew the lawyers were on their way," Chen said, adding that he had received a text message from the teenager's phone.

"We received a text message of just a few words saying thank you, but please don't come here," he said. "I think the phone was shut down as soon as he sent it."

Chen said it was unclear whether Bao himself had sent the message.

"We have no way of knowing whether the phone was even in his hands," he said.

Chen said he too is expecting a visiting from China's state security police "at any time."

"I'm not sure I will be able to remain in contact, even if I wanted to," he said. "I don't know when I'll be detained too."

Lawyer Feng Yanqiang, who had been on his way to assist Bao, said the authorities have refused to answer any questions regarding the whereabouts of Wang and the others.

"What is going on with Wang Yu, and which department has detained her, and on suspicion of which crimes," Feng said.

"We don't even know where she is being held, and there's no way for us to find out right now," he said.

"We went to the Tianjin police department and district detention centers, to district police stations and to the courts, to inquire, but we haven't heard any news," Feng added.



'Grim' outlook for rule of law

Feng said he has been asked to resign from his own law firm because he is trying to help Wang, who has been accused by state media of taking part in a "criminal operation" spearheaded by Fengrui and allegedly aimed at undermining social stability.

State media reports have accused the lawyers of "colluding with petitioners to disturb social order and to reach their goals with ulterior motives."

Many lawyers have told RFA they have been summoned for questioning by police and warned not to publicize details of 'sensitive' rights cases online, nor to speak to foreign media organizations.

While many were later released, dozens of lawyers remain in detention, including Wang, her boss Zhou Shifeng, and colleague Huang Liqun from Beijing's Fengrui public interest law firm, which defended jailed Uyghur scholar Ilham Tohti.

Meanwhile, China's powerful propaganda department moved this week to curb coverage of the detentions in the country's tightly controlled media.

"All websites must, without exception, use as the standard official and authoritative media reports with regards to the detention of trouble-making lawyers by the relevant departments," according to a directive dated July 14 and leaked online.

"Personnel must take care to find and delete harmful information; do not repost news from non-standard sources," said the directive, which was translated and published by the U.S.-based China Digital Times website.

Rights groups and overseas agencies have continued to call on Beijing to disclose the whereabouts of nine detained lawyers, saying they are at "grave risk" of torture or other mistreatment, and two non-lawyers who went missing during the operation.

Among those "disappeared," and believed detained, are Beijing lawyers Li Heping, Xie Yanyi, Li Shuyun and Liu Yingxin, as well as seven other activists and paralegals.

U.N. human rights investigators demanded an end to crackdown, saying it may have broken the U.N. Declaration of Human Rights, the U.N. Basic Principles of the Role of Lawyers and China's own criminal procedures.

"Lawyers should never have to suffer prosecution or any other kind of sanctions or intimidation for discharging their professional duties," they said in a statement issued by the U.N. human rights office.

In Hong Kong, the Foreign Correspondents’ Club (FCC) said it was "gravely concerned" at the crackdown.

"Freedom of speech and of the press can only be guaranteed when there is the clear and unfettered rule of law," the FCC said in a statement on its website on Friday.

"By attacking lawyers who are dedicated to defending civil liberties, the Chinese authorities are clearly undermining the rule of law and sending a very chilling message to both journalists and lawyers working in China," it said.

The overseas-based Observatory for the Protection of Human Rights Defenders said that the future of rule of law in China now looks "grim."

"Our organizations call on the Chinese authorities to immediately disclose the whereabouts of the detainees, ensure their right to access to a lawyer and respect their rights including those stipulated in the UN Declaration on Human Rights Defenders and the UN Basic Principles on the Role of Lawyers," the group said in a statement on its website.

According to Australian China expert Geremie Barmé, two influential articles in state-run media in 2012 specifically mentioned rights lawyers as a potential threat to the incoming administration of President Xi Jinping.

One, penned by Yuan Peng in Communist Party mouthpiece the People's Daily in September 2012, identified five categories of people that could pose a threat to the regime because they were being infiltrated and manipulated by the United States.

The categories comprise rights lawyers, underground religious believers, dissidents, Internet opinion leaders and vulnerable groups who petition against official wrongdoing, Barmé wrote on The China Story website in 2012.

Police in southwestern China’s Sichuan province have detained the sister of Tenzin Delek Rinpoche, a popular Tibetan monk who died last week in unexplained circumstances in a Chinese prison, also taking into custody the woman’s daughter, Tibetan sources said.

Dolkar Lhamo, 55, and Nyima Lhamo, aged about 25, were detained in the provincial capital Chengdu at about 8:00 a.m. on July 17 by police sent from their native Lithang (in Chinese, Litang) county, a Tibetan living in India told RFA’s Tibetan Service on Friday.

“No reason was given for their detention, but local people believe they were suspected of having shared information related to the death of Rinpoche with other people,” Geshe Lobsang Yonten said, citing contacts in the region.

Separately, Geshe Jamyang Nyima, another source in exile with connections to the family, confirmed the women had been detained.

No information was immediately available on their current whereabouts.

Tenzin Delek Rinpoche, 65, died on July 12 in the 13th year of a life sentence imposed for what rights groups and supporters have described as a wrongful conviction on a bombing charge. He was widely respected among Tibetans for his efforts to protect Tibetan culture and the environment.

Around 140 Tibetans—including family members, monastic representatives, and residents of Tenzin Delek Rinpoche’s home county of Nyagchuka (Yajiang)—later gathered in Chengdu to demand return of his body.

His remains were cremated by prison authorities on July 16 against the wishes of his family


'Actively involved'

Dolkar Lhamo was “actively involved in the case of Tenzin Delek right from the day he was initially detained and sentenced,” Yonten said, adding, “She was the first one to see her brother in the jail and also the main person to appeal for his release.”

In the days following the popular Tibetan monk’s death in prison and before his cremation, Dolkar Lhamo had presented a five-point appeal to authorities calling for an explanation of the circumstances surrounding his death.

She had also submitted  abstracts from China’s constitution on required procedures following the death of a prisoner belonging to a minority nationality group, Yonten said.

“But the authorities refused to accept those representations.”

Many now suspect that the cause of Tenzin Delek Rinpoche’s death "has some connection to the prison,” the India-based Tibetan Centre for Human Rights and Democracy (TCHRD) said in a July 17 statement.

“There is no evidence of any Chinese legislation that the body of a deceased prisoner cannot be taken home by their family members,” TCHRD said.

“If the prison authorities cannot explain clearly the reasons for the death, there must be an investigation of Rinpoche’s death in accordance with his family’s and followers’ wishes.”

大陆当局对维权律师的打压已持续一周,海外继续发声谴责,包括设于美国的组织“人道中国”成立基金,协助事件中受影响的人士。而大陆官媒再次发声,指部分涉事律师是“害群之马”。(文宇晴报道)

总部设于美国三藩市的民间组织“人道中国”,当地时间周三(15日)公布成立“中国维权律师专项基金”,呼吁社会各界捐款。

“人道中国”主席葛洵接受本台访问时表示,成立基金是为帮助被抓捕和逼害的大陆维权律师及其家人,因为他们在遭受到逼害时,不仅是身心受到伤害,经济上也可能因为失去执业条件,而蒙受重大损失。葛洵又说,不怕基金会被大陆政府视为外部势力。

葛洵说:中国政府他经常是用这样的语言,我们是一个美国的基金会,他们要是用这样的语言来诬蔑我们,我们也没办法,没有甚么好担心的。

葛洵又指,曾经帮助过不少在大陆被逼害的人士,清楚大陆政府一直以来的打压的手段。由于基金才刚成立,目前不太担心会成为加害维权律师的另一个理由。

“人道中国”由89民运学生领袖周锋锁等三位前清华大学学生,于2007年创建,非营利组织。

澳大利亚悉尼组织“中国民主论坛”负责人秦晋表示,不管是任何的声明或成立基金会,都会被说成是外国势力,尽管海外的声援微弱,但仍然非常需要。

秦晋说:海外呢,能发声音,有自由,但是声音还是很弱小。国内(大陆)能发一些很弱小的声音,但很快就会被中共扑灭。中国政府方面一定会把这事作为,国际势力的介入。但并不是中国政府这样说了,海外就不要去做。

连日来海外均有行动声援大陆维权律师,其中在澳大利亚人墨尔本,周四(16日)下午有十多人在街头集会,并在当地华人集中的街道,透过游行方式把事件公开。

参与活动的当地民主人士阮杰说,他们稍后亦会举不同的活动,例如再到中国驻当地领事抗议,或到市中心进行接力演讲等,继续声援大陆的维权律师。

阮杰说:主要在大街道和唐人街游行,然后也当地徵求人签名。估计有数十人到上百人签名。我觉得可以让更多人知道中国的事情,让他们支持我们的工作也更重要。

香港一批律师周四发表声明,表示对羁押和失踪的维权律师,表示极度关注。

台湾亦有律师团体发起联署,声援大陆被打压的律师。声明中引述法国启蒙思想家伏尔泰的名言“我不认同你认为你该说的意见,但我誓死捍卫你表达意见的权利。”强调维护人权法治是律师的天职,就算讲了执政者不中听的话,也不应该因此受苦受罚。认为要站出来支持人权与法治,是一个价值选择的对错问题,沉默就是加入共犯结构。

发起团体又计划于下周一(20日),在台北市的白色恐怖政治受难者纪念碑附近,举行声援的活动。呼吁出席的业界反穿律师袍,抗议大陆镇压式逮捕。

国际特赦组织发声明,表示对被捕的律师或涉事失踪者的情况,感到忧虑。指出大陆当局逐步加大对维权律师,以及人权者的打压。当中至少3人以危害国家安全理由扣留,这罪名一旦罪成,或面临最多15年的刑期。

英国律师协会也去函李克强,对逾百名的律师遭到抓捕和传唤表示关注。

这边厢国际社会的持续关注,大陆当局则利用官媒进行舆论反驳。

《解放日报》周四发表文章,指一个“律师问题”骤成热点,网上网下,众说纷纭,域内境外,众声喧哗。文章中说,“害群之马”似乎首先是指极少数的“死磕派”,走向了“广场派”,除了庭上哗众取宠,而不顾当事人权益外,开始把“战场”转往街头或网络。

形容整肃“害群之马”,也要两面讲。律师作为法律人,更要带头守法,更要自律,更要依法行事、依法做人,律师队伍的整体职业形象才能得到保护。

(维权网信息中心报道)以下是警方对王宇、包龙军的孩子大搞株连的事实经过,中共当局以此野蛮方式折磨未成年人严重违反了国际《儿童权利公约》,本网对包蒙蒙的境况高度关注,将持续报道。

据悉,王宇和包龙军之子包蒙蒙,时年16岁。7月9日被关押近两天后,被亲属接走,然后又接连被传唤3次。 7月17日上午9时许被派出所带走,警察警告他: ①钥匙不给,护照不给,出国上学别想了;②不能接律师电话,不能给律师打电话、发信息;③你爹妈在哪里,别问了;④手机要换号;⑤不许给你爸妈请律师;⑥同时包蒙蒙奶奶家警察已经上岗值勤。

中国是国际《儿童权利公约》的缔约国。该《公约》第37条规定 “缔约国应确保: (a) 任何儿童不受酷刑或其他形式的残忍、不人道或有辱人格的待遇或处罚”。 “(b) 不得非法或任意剥夺任何儿童的自由”。 “(c) 所有被剥夺自由的儿童应受到人道待遇,其人格固有尊严应 受尊重,”“(d) 所有被剥夺自由的儿童均有权迅速获得法律及其他适当援助,并有权向法院或其他独立公正的主管当局就其被剥夺自由一事之合法性提出异议,并有权迅速就任何此类行动得到裁定”。

介于警方继续对包蒙蒙进行威胁、软禁并拒绝退还他的护照,任何公民都可以追究法律责任,要求联合国“儿童权利委员会”和“酷刑和其他残忍、不人道或有辱人格的待遇或处罚问题特别报告员”关注此案。

不幸从这里开始。2015年7月9日,包蒙蒙和父亲包龙军到北京「首都机场」准备飞往吉隆坡再到澳大利亚留学。憧憬美好未来的包蒙蒙,怎么也没有想到,在过安检口的那一瞬间,突然冲出来一群绑匪,把他们父子分开,倒背手绑架,此时的蒙蒙想喊,暴徒们捂住他的嘴,更有一帮暴徒抢他们的包裹行李。就这瞬间,蒙蒙经历了从天堂到地狱般的感受。

也就是这一瞬间他和父亲包龙军被分开。让蒙蒙不解的是,这群绑匪操着浓浓的天津口音。蒙蒙被从航站楼的侧门押到一辆车上,坐在车的后排,两边但有人把他夹在中间,去向未知。爸爸的去向就更不知道了。蒙蒙想逃离虎口,但没有机会。

几个小时过去了,蒙蒙被强行逮到天津市河西区宾友道汉庭大酒店的8111房间。六、七个人看着他。此时蒙蒙以他幼小的身躯反抗!“我要找爸爸妈妈!我要上学!你们这样做是非法的!”随之而来的是恐吓、威胁及暴力。“你老实点,否则没你好果子吃。听我们的话老实待着”。仅仅16岁的蒙蒙没有屈服,他拿起房间的电话,给爸妈打,那绑匪狠狠的打蒙蒙的手,电话被抢走了。  在被绑架的房间里,蒙蒙要去厕所,几个看押他的匪徒蜂拥而上,蒙蒙拒绝他们进入厕所,被那恶匪连推带打重重的摔在床上。16岁的包蒙蒙被脱离了自己的监护人,又失去了自由。爸爸妈妈是法律人,是律师,确保护不了他。

无助的蒙蒙又困又累,疲倦不堪他支持不助了,躺在了床上蒙上头,偷偷的掉眼泪。不知不觉睡着了的蒙蒙又被恶梦惊醒。爸爸妈妈你们在哪里!?蒙蒙站在窗前向外遥望,就这一点点权利又被剥夺了。这群诬赖匪徒给蒙蒙调换到8118房间。包蒙蒙思念父母,已是20多个小时没有进食了。宾馆里来了几个女匪一直劝蒙蒙吃点东西。为了应付劫匪,他简单的吃了点儿糕点。挂念父母安危的蒙蒙,以新的策略向绑匪们反抗:“我闷死了,我要出去透透气”绑匪经过请示允许蒙蒙到走廊,继续抗争!最后终于到宾馆外,蒙蒙记住了这个汉庭酒店。但他没有半点机会逃离魔掌。

11日晚,蒙蒙被姑姑从天津市公安局河西分局天塔派出所接了出来。回到亲人身边的包蒙蒙回忆被失踪的40小时时说,在机场绑架他时有一警号是290920的匪警。  时间过去了多日,但蒙蒙那不是中国梦的留学梦破灭了,心灵的创伤无法弥补,谁能抚平这从天堂到地狱般的流血伤口?

「被失蹤」的北京維權女律師王宇及其丈夫包龍軍律師,其兒子包蒙蒙亦慘遭誅連,據維權網引述陳建剛律師消息指,「王宇律師的兒子給我發了訊息,隨即關機……包蒙蒙(昨日)上午9時許被派出所帶走,至今没有消息。」

DAV fordert Aufklärung durch chinesische Behörden

Berlin (DAV). Die Situation von Anwältinnen und Anwälten in China hat sich in dramatischer Weise verschlechtert. Im Zuge eines landesweiten Vorgehens sind zahlreiche Kolleginnen und Kollegen, die sich für die Menschenrechte anderer engagiert haben, inhaftiert worden bzw. „verschwunden“. Auch sind mindestens drei Anwaltskanzleien nach Informationen von Amnesty International durchsucht worden. Der Deutsche Anwaltverein (DAV) ist in großer Sorge, dass die chinesischen Anwältinnen und Anwälte Opfer von Folter und Misshandlung werden könnten.

„Das rigorose Vorgehen der chinesischen Behörden gegen Anwältinnen und Anwälte und andere Vertreter der Zivilgesellschaft hat mich – offen gestanden – zutiefst erschrocken. Wir werden nicht aufhören, den Schutz der Menschenrechte und der Menschenrechtsverteidiger einzufordern“, sagte DAV-Präsident Rechtsanwalt Ulrich Schellenberg. Erschreckt zeigt sich der DAV-Präsident, dass diese Inhaftierung kurz nach dem 15. Deutsch-Chinesischen Rechtsstaatsdialog am 6. und 7. Juli 2015 in Peking erfolgte.

In einem Schreiben bat Schellenberg den chinesischen Minister Song Dahan um Auskunft über die Gründe der Festnahme und der Durchsuchung von Anwaltskanzleien sowie den Verbleib der Kolleginnen und Kollegen. Zugleich forderte er die Einhaltung der internationalen Standards im Umgang mit Anwältinnen und Anwälten, für die sich die Volksrepublik China auch rechtlich verpflichtet hat.

Der Präsident des DAV appelliert an Bundesjustizminister Heiko Maas, sich für die chinesischen Kolleginnen und Kollegen einzusetzen. Besonders wichtig sei aus Sicht von Schellenberg, dass dem Einsatz für die Schaffung der anwaltlichen Unabhängigkeit und für sonstige Rahmenbedingungen, die Anwältinnen und Anwälten eine wirkungsvolle Vertretung der Interessen der Mandanten ermöglichen, auch auf politischer Ebene eine höchstmögliche Priorität gerade und insbesondere im deutsch-chinesischen Austausch eingeräumt wird.

Die Behörden werfen den Anwälten vor, eine „kriminelle Vereinigung“ gebildet und „ernsthaft die öffentliche Ordnung“ gestört zu haben. Ihre Maßnahmen stützen die chinesischen Behörden offenbar auf das jüngst erlassene neue „Gesetz zum Schutz der nationalen Sicherheit“, welches international starken Protest ausgelöst hat. Der UN-Hochkommissar für Menschenrechte, Zeid Ra’ad Al Hussein, kritisierte das Sicherheitsgesetz als Einfallstor für Einschränkungen der Bürger- und Menschenrechte und Menschen, die sich für die Rechte anderer auch beruflich einsetzen wie Anwältinnen und Anwälte.

Law Council deeply concerned with ‘crackdown’ against lawyers in China 

The Law Council of Australia has expressed deep concern at reports of a “major crackdown” in China, resulting in the mass arrest and detainment of lawyers, law firm staff, and activists.  Many of the lawyers apprehended, such as Wang Yu (王宇), Li Heping (李和平), and Sui Muqing (隋牧青), are well-regarded for their human rights work. The US State Department has condemned the detentions, and expressed concern that China’s new national security laws were being used as a “facade to commit human rights abuses.”  Law Council of Australia President-elect Stuart Clark said lawyers must be able to practise without fear of retribution for carrying out their professional duties. “The reports we are getting from China are deeply disturbing,” Mr Clark said. “An independent legal profession is fundamental to the promotion and protection of the rule of law. No lawyer should have to face intimidation, hindrance or improper interference in their work. “All lawyers, regardless of the country in which they work, should be treated in a manner consistent with international human rights law and the United Nations Basic Principles on the Role of Lawyers. “The Australian legal profession has a responsibility to monitor and promote the rule of law in the region, as reflected in the Law Council’s Rule of Law Principles.  “On behalf of lawyers in Australia and our colleagues across the region, the Law Council of Australia will continue to monitor these events carefully and will consult with the Australian Government and our counterparts globally,” Mr Clark concluded.
