     中国大批律师受到拘捕的情况成为星期三
美国参议院一场听证会的关注重点。美国官员和非政府组织领导人讨论,是否应该用强制的经济制裁手段来惩戒侵犯人权的行为。
   
     美国国会参议院星期四举行听证会,审议全球人权问题,并讨论“全球马格尼茨基人权问责法案”(Global Magnitsky Human Rights Accountability Act)。法案主要目的是授权美国总统限制那些侵犯人权和涉及重大腐败行为的外国个人和实体入境美国,并对他们的财产实施制裁。


   
    中国最近百名维权律师受到刑拘、失联、和传唤的这一情况在听证会上受到关注。出席作证的美国国务院主管民主、人权、劳工事务的助理国务卿汤姆•马利诺夫斯基说:“在最近几天,我们看到中国有一百多名维权律师被关押;我们也看到了中国几部已经通过或提议中的针对非政府组织和有关国家安全的法案,这些法案不仅将授权政府管控人权组织,也将限制众多活动,从商会到学生交流组织、以及环保工作等所有不受政府直接控制的方方面面。官方所谓美国和国际社会的‘文化渗透’论调越来越强硬,为上述做法提供正当性。”
   
    马利诺夫斯基说,他将继续在这些问题上与国会合作,但是对全球人权问责法案不持支持或反对的立场。他说,美国政府一直利用各种场合在人权问题上向中国表达关切。他说,克里国务卿在最近的美中战略与经济对话期间非常强硬地向中方施压。
   
    非政府组织“自由之家”(Freedom House)主席马克·拉戈(Mark Lagon)在听证会上说,中国在人权问题上根本肆无忌惮,美国应该立法实施制裁。
   
    他说:“数百名维权律师和活动人士受到拘捕关押显示出,中国领导人在与美国进行战略与经济对话这样的交流时有多少畏惧,丝毫没有。我们需要加强对人权的重视,而且需要公开。反腐被看作是习近平执政的核心,他的反腐是‘以法治国’(rule by law)的最佳体现,而不是‘依法治国’(rule of law)。习近平和他的小圈子想除掉的人成了反腐目标,那些对他有用的人即使腐败也可以高枕无忧。这正是全球马格尼茨基制裁法案适用的地方。这将是一个凸显腐败、曝光那些侵犯人权罪行的绝佳方式。”
   
    不过,国务院助理国务卿马利诺夫斯基说,本届政府的立场是,对侵犯人权的外国个人和组织强制实施制裁将带来一些问题。“第一,有针对性的经济制裁不能解决世界上所有的侵犯人权行为。如果法律要求我们这样做,这个过程将非常主观,律师会说如果有证据,你们就必须行动。第二,涉及的资源将非常庞大,特别是对那些使领馆规模很小的国家来说,当事件达到这一立法的潜在证据标准时,它们将不得不逐一审理。”
   
    一起出席作证的“人权观察”组织华盛顿办事处主任莎拉·马贡(Sarah Margon)对美中对话的效果表示怀疑。她认为,全球人权问责法案将会是一个有效的工具。
   
    她说:“最近的美中对话提到了人权问题,但问题是,我们只看到提出问题,并没有后续。而且经常不是在公开场合提及。我也认为,如果能够得以执行,全球马格尼茨基法案将是一个非常有效的工具。表面上看,既然中国国家主席也致力于铲除腐败,他也应该欢迎这样的做法。”

美国非政府组织“现在自由”要求获得联合国咨商地位认证的申请遭非政府组织委员会拒绝后,在美国代表的要求下,该委员会的上级机构将在7月20号对此进行投票表决。“现在自由”组织官员认为,此次被拒与他们关注各国良心犯有关,包括中国良心犯刘晓波案等有关,导致不少联合国“非政府组织委员会”成员国不满。

美联社7月16号报道,上个月,联合国非政府组织委员会(UN NGO Committee)经投票,拒绝给予总部设在美国华盛顿的非政府组织“现在自由”(Freedom Now)联合国“咨商地位”认证。不过,美国决定提请联合国非政府组织委员会的上级部门—联合国经济及社会委员会(Economic and Social Council)对此进行复议。

“现在自由” 执行主任特纳(Maran Turner)7月16号接受本台记者电话采访时介绍说,该组织长期致力于通过法律、政治、公关等手段推动全球良心犯获得自由。2009年,该组织向联合国非政府组织委员会提交“咨商地位”认证申请,并在随后5年多的时间里,为此做了积极认真的准备。不过,上个月,由19个成员国组成的联合国非政府组织委员会投票否决了这一申请,包括中国、俄罗斯、伊朗、古巴、苏丹、阿塞拜疆在内的11个国家投了反对票,美国、以色列、希腊、委内瑞拉等4国投了赞成票,印度弃权,几内亚、毛里塔尼亚、土耳其3国代表没有到场。

特纳说,联合国非政府组织委员会对于否决“现在自由”咨商地位认证,并没有给出官方理由。不过,联合国与该项投票结果相关的公开记录显示,一些到场投票的成员国称,该项投票不符合联合国非政府组织委员会的章程和工作方法。联合国非政府组织委员会主席当场驳斥了这种说法,指出该项投票遵循了联合国非政府组织委员会的所有章程和工作方法。

特纳认为,“现在自由”组织未能获得联合国非政府组织委员会咨商地位认证,其真正的原因,并不是该组织没有满足联合国咨商地位认证的要求,而是因为该组织致力于推动全球良心犯获得自由,引起一些国家的担心。

“我们最著名的案件,就是中国的刘晓波。我们向联合国人权委员会‘任意拘押工作小组’提交了刘晓波的案件,该独立机构给出了有利于我方的意见,结论是:刘晓波被监禁,确实违反了他的基本自由权利,刘晓波是良心犯。”

美联社的报道说,美国常驻联合国代表萨曼莎·鲍尔(Samantha Power)上个月在美国国会听证会上表示,拒绝给予“现在自由”组织联合国咨商地位认证的联合国非政府组织委员会“充斥着一群自己都不容忍本国非政府组织的国家……但我们不会放弃”。

目前正在纽约大学“美国亚洲法律研究所”做访问学者的北京非政府组织“益仁平中心”负责人陆军对此评论说:

“中国政府对NGO的态度,其实地球人都知道,一直以来都很不友好,尤其是对待权利型NGO、独立NGO、草根NGO。最近两年这种情况又有所恶化。去年开始,中国发起了一个针对NGO的镇压运动。到目前为止,据我们所知,已经有10多家权利型NGO被搜查,或者成员被抓捕,还有10多家服务型NGO也被搜查、调查。很明显,中国对NGO很不友好。联合国确实需要慎重考虑,中国是不是适合作为联合国非政府组织委员会的成员。”

据美联社的报道,联合国非政府组织委员会的上级部门---联合国经济及社会委员会由54个成员国组成,联合国经济及社会委员会将在7月20号投票,决定是否给予“现在自由”联合国“咨商地位”认证。

I do not think a boycott against Germany change the current situation in Greece. The German people is not guilty, the IMF is guilty.

taxpayers from Germany have donated much money to Greece since 2010 as far as i know,  including me

Even in his dictatorship between 1949-1976, no such case happened.  BUT now is 2015 !!
My understanding is that there is slightly more religious freedom than in the past 30 or so years, but I don't know from first hand experience. Perhaps the phenomena of the "christian rich" is being seen as a threat?

maybe, many so called middle class chinese are Christian but the main reason it should be that the chinese Communist party has great fear on the rapidly growing amount Christian in China, Zhejiang province is the no.1 among 30 provinces in China.

Info: She was identified by exile sources as Tseypey, the fourth of six children from a family in Meruma township, and the same sources say that she died on the scene.

Tseypey was described by Tibetans who knew her as “well-behaved, honest and gentle”, according to Kirti monks in exile in Dharamsala. She had not received a formal education but grew up working as a herder with her parents. According to the same sources, her 60 year old father and 50 year old mother have reportedly been taken away by police, but it is not clear whether they have been detained.

浙江台州温岭东海教堂的十字架周二下午遭到警方暴力强拆,多名信徒在抵抗强拆过程中受伤。教堂信徒告诉本台,他们教堂是温岭118座教堂中最后一座被拆十字架的教堂。有评论认为,当局疯狂强拆十字架源于他们对基督教的无知。

东海教堂的一名信徒周三告诉本台,他们教堂是温岭地区最后一座被拆十字架的教堂。原本官方称会在大家同意的情况下才拆除十字架,结果却出尔反尔,提前派遣数百名武警、特警及村、镇干部将教堂团团围住,当时教堂正在聚会,信徒们不愿离去,结果遭到了暴力清场。

“本来这个十字架没有违建的,政府强迫要拆我们的十字架,他们没有通知单,就是口头通知。13号那天他叫我们两个代表过去,他们就用威吓的话跟我们讲,如果不给我们十字架拆掉,我们的教堂全部都要没收。温岭有118个教堂,我们是最后一个。13号说,我们给你们两天时间,你们向我汇报,有什么要求你们提过来,有谁谁不同意的,和我们说,我们工作肯定做得很细节,都给你们满意了,拆你们的十字架。他们是这样讲的。然后14号中午大概两点40几分钟他就打电话过来,我们教堂刚刚在聚会、祷告,我们没接他的电话,他马上就过来了。我们两个负责人就出去了,他叫我们开门给他拆十字架,信徒不愿意拆十字架,就不开门。我说你们晚一点,给我们时间,他不和我们讲理,说‘给你们时间了’。其实14号那天,他说今天(7月15日)过来,然后他们提前了。他全部都已经安排好了,强制我们(离开)。我们信徒把门关了,他就从窗户里面进来,特警就把我们教堂里面所有的凳子全部翻掉了。”

记者:“昨天受伤了大概几个人?”

对方:“受伤的好多人。一个人是胸骨断了,一个人是脚骨扭断了,还有一个手上缝了8针,还住在医院。最可恶的是,有一个心脏病的,200万都医不好的,她说医生都不能救我,耶稣救了我,他要拆十字架,我肯定不愿意的,我肯定要护卫十字架,那是我的本分。她晕倒了,跟他讲了,特警根本不理我们。还有一个弟兄,根本没有说什么话,被他们推出去的时候,还要再拉进来用绳子绑住,是这样凶恶的。”

记者:“所有的信徒都是在阻挡特警拆十字架的时候被他们弄伤的。”

对方:“对,对。我们想不通,你没有文件、没有政策,为什么要给我们拆掉?”

上述信徒表示,在十字架被强行拆除后,她曾质问镇政府官员,得到的答复是,所有的安排均是市里决定,他们无权过问。

关注浙江拆十字架潮的基督徒律师杨兴权周二接受本台采访时表示,强拆源于当局的无知。

“拆十字架肯定是对基督徒和信仰方面的亵渎。我认为还是他们对这方面的无知,缺乏基本常识。对十字架本身的意义、十字架的涵义,它给社会带来的文明的发展,起到这么大的作用,推动整个全世界文明发展,这么大的情况他们不了解。”

北京基督徒律师张凯日前发布“护卫十字架律师团公告”,认为浙江地区出现大规模的强拆十字架事件,与普世的宗教自由原则相背离,也与国家的《行政处罚法》、《行政强制法》等多部法律相背离。律师将身体力行,帮助教会积极使用上帝及国家法律赋予的各项权利,强烈抵制非法的行政手段及政治运动,监督行政机关及行政官员是否善用自己的权柄。

日前,首批律师团成员已抵达浙江湖州,将会为守护扎村基督教堂十字架进行一系列活动,包括提起行政诉讼,要求信息公开,申请游行示威等。

“Lawyers need to be protected not harassed” – UN experts urge China to halt detentions

GENEVA (16 July 2015) – United Nations human rights experts* today called on the Chinese authorities to stop what appears to be targeted police harassment and intimidation of lawyers and those working closely with them. “Lawyers are essential to ensure the rule of law; they need to be protected not harassed,” they said.

The independent experts expressed dismay at the ever growing number of lawyers and persons associated with their work, including law firm personnel, legal assistants and human rights defenders, who have been arrested and detained, including incommunicado, or summoned and questioned since 9 July 2015.

More than 100 lawyers have been arrested and detained or interrogated over the last few days in direct connection with their professional activities, according to the information received by the experts. Most of the lawyers are believed to have been working on human rights-related cases, in particular cases where they represented well known political dissidents, journalists and artists.

“If no charges are pressed, the authorities should immediately release all persons detained; alternatively, if they are officially charged with criminal offences, all due process guarantees should be provided, in particular the immediate and adequate access to an independent legal counsel,” they stressed.

“We are particularly concerned about the physical and mental integrity of 10 individuals, including 6 lawyers, who are currently held in police custody or under ‘residential surveillance’ in unknown locations, in most cases incommunicado since their arrests,” they said.

The experts expressed further concern that these persons may have been arbitrarily arrested and detained in contravention of not only the UN Basic Principles of the Role of Lawyers and the Universal Declaration of Human Rights, but also the Chinese Criminal Procedure Code.

“The fate and whereabouts of another 12 persons, including 3 lawyers, who have disappeared in unknown circumstances, are also worrying,” they noted.  “We call on the Chinese authorities to investigate these cases urgently and provide full disclosure on the results.”

“In societies governed by the rule of law, lawyers advocate within the legal system on behalf of clients, even where their personal views may differ from the clients’ views,” the independent experts stated. “Lawyers should never have to suffer prosecution or any other kind of sanctions or intimidation for discharging their professional duties.”

The experts underscored that, “as one of the three main actors of an independent justice system, lawyers have an essential role to play in protecting human rights, in particular due process and fair trial guarantees, and ultimately contribute greatly to ensuring respect for the rule of law.”

The experts are in contact with the Chinese authorities to clarify the issues in question.
