sooo mtgox "free trade" should be legal :p

MtGox has had plenty of time and opportunity to operate within the law.

Wasn't the FinCen guidance which changed the definition of bitcoin to be considered a currency thereby changing gox's role to that of an MSB only published in April. and then the warrant was issued... what, like 3 weeks later?. plenty of time, really?

So what i have gathered so far seems to be indicating that gox is being investigated for operating a money transfer service and this has been defined by the FinCen guidance (and explicitly described in the warrant) as involving an alternative currency (BTC). Therefore if Gox are found in court to have broken this law there would be a legal precedent that Bitcoin is recognised as a currency.

Could any one with better undertanding of this matter please correct me if I am wrong.

ANYONE mwho sell Bitcoins or any other cryptocurrency for fiat money is now considered a 'Money Service Business' and has to register as such with finCen or be subject to the same sort of penalties as Mt.Gox, including fines and up to 5 years in prison.

For real... can anyone point out why I'm wrong on this one? I desperately want to be wrong.

Anyone = All people of all countries
FinCen etc blah blah = US of Amerika

I can only assume they have taken my money and run. No contact from them since my order in july 2012 (apart from a couple of news letters) and no response to my emails. They dont even sell the product I ordered now.

It's a list I've put together from what people have sent me.  Someone just sent me 500 more shares, so the total is about 800 shares more than I had tallied before GLBSE went down... /sigh

well, i have shares for bfls and bfls.rig that i have not claimed too.
