As my government is finally started to show some progress in effort to become EU member, there is a plan to soon have local notaries, meaning that the price of getting affidavit should become reasonable (at least reasonable for me). However, as I missed this deadline

VPS will keep the claims process open for another three months through May 23, 2013.
What path could we take now?  Undecided

To be fair, to put a a scammer label on somebody you need to have intention as a starting point.
In the case of gigamining I don't see clear intention.
However, James did change the rules and I'll have to wait before I made my final judgment about him.  Undecided

Regarding FinCEN paper http://www.fincen.gov/statutes_regs/guidance/html/FIN-2013-G001.html

I assume that there will be no change in the rules because it will not be fair to others who went trough affidavit process.  Undecided

As claim process will end soon, it is obvious that I will not going to make it (not that I don't want to - but for me US Embassy is far away, both in terms of distance and money).

James, what will happen now with my shares and dividends?

I'm trying to make some calculation, will my shares and payments cover the affidavit expenses of legal translator, notary fees, apostille fees, mail, unforeseen fees of dull government...
What is currently the total sum that I have for my 27 gigamining bonds/shares/contracts?  Huh
