This is just getting ridiculous.

Tom is a scammer. I don't believe he set out to scam, but he has failed to repay his investors when things fell apart and has lied about relevant facts.

Dave has helped many people get their money out of this collapsing company. I've seen zero evidence that he's stolen anything from anyone. Matter of fact he seems to have contributed his time for free to help some people get out. Can we just stick to what we know and at least give Dave the presumption of innocence unless and until we know something to the contrary?

Nope...nothing. In fact I beleive the last time I got an email from anyone at BTCFPGA/bitcoinasic was 11 Dec 2012 sent from Dave Carlson [dave@bitcoinasic.com].

So is this a proposed criminal case or a civil suit? Of course Dave had something to do with it...he was hired by a scammer, when it went south it appeared as though he was the one sounding the alarm and warning Tom's customers to head for the hills. IE he suggested they do chargebacks rather than request refunds, presumably because he feared they'd not be repaid.

If I'm on the jury I calmly thank the plaintiff for bringing the case against Dave and then suggest the plaintiff be tossed in the can for foolishly wasting the court's time.

Umm...really? That's just silly.

Dave assisted Tom by doing the job he was paid to do. When things fell apart he was the only one that got funds back to where it belonged as far as I can tell.

We all know that there's no chargeback system built into the BTC blockchain, so whether CC orders were refunded or no the BTCs paid to BTCFPGA were always at risk.

Many of the ordering problems disappear when you register with wordpress and login. Sadly I've only seen this described by customers and not by anyone associated with Avalon. The entire process is a messy minefield that wasn't explained before hand and hasn't been completely fixed even now. The near complete lack of communication is mind boggling.

sorry bout if someone was to take this thing to court all they would have to do is show that dave was willing helping tom to get rid of the cc refunds so he could run with the btc. and with most of the post on bitcion talk and the logs that otheres have of btcfpga website woudnt be hard to due.

Now when you say "get rid of the cc refunds" you mean to return the funds to those that paid and later requested a refund correct? Dave has maintained all along that BTC refunds were not his to administer and he was required to submit them to Tom. If that's true then what was he(Dave) supposed to do? Are you suggesting he was wrong to do his job and return funds via CC because Tom still owed BTCs? I'm as peeved about this whole thing as anyone, but I don't understand the animosity being (mis)directed at Dave. If someone has some information that indicates Dave was more than just an employee of Tom's or that Dave acted inappropriately at some point then I'd love to see it. This just comes off as a witch hunt otherwise.

ASICs are kind of a big deal for BTC mining and therefore BTC in general so I don't think it's much of a surprise that interest is huge or that questions are being raised from many vectors.

I logged in at btcfpga.com and noticed my Order Status was changed to: Payment Address Requested

But I never received this email. I also checked the logs of my mailservers.

Did anyone receive this request ?


That is how my status looks as well doggie. Order history says "refund requested" details for the order say payment address requested. I believe this was Dave's doing before he left, I'm sure he will correct me if I'm mistaken. Upon seeing this I immediately sent a BTC repayment address(the same one I paid with) to BTCFPGA, this was on Jan 28. I've received no response of any kind since.
