Are you modifying their refund request form or filling it out but putting the btc value instead of USD. I refuse to sing the refund form they sent as long as it contains the " at the exchange rate quoted by Bitstamp on the day HashFast provides such Bitcoins" clause.

I'm not touching that refund form with a 10 foot pole. The original contract is clear and valid. No need to voluntary waive your rights.

I simply sent them my own notice of failure and cancellation & refund letters. Here are some snapshots of the scans:

This is what my order confirmation says:

So if payments are due in the amounts, in the currency, and at the time stated in the order or confirmation. Then full refund of the payment is due in the amounts and the currency stated in the order or confirmation.

In summary:
1) payment in BTC: check
2) full refund of the payment in BTC: check
3) HF failed to deliver by December 31, 2013: check
3) Filed refund request before Jan 15, 2014: check

Am I reading/interpreting this incorrectly? Seems pretty clear to me.

Edit: Cedivad pointed out that you need to file your request as a hardcopy so will do that as well. (I have only filed an online refund ticket sales@hashfast so far). From the ToS:

I guess an email is not 'written' but a print out is?

That said, I do believe it should be possible to add another zero to the value of the top 3 cryptos by EOY 2104.

You and I both know this is just propaganda. At the same time they announced they were shipping to the world they sent out the letter to customers stating that they were not shipping. It is just for show, so it appears they met their targets and demonstrate a best effort to deliver if they end up in court.

This is the problem. Most people buying miners are first time buyers that do not do their homework. As such companies like BFL and HF can stay in business because they feed off the ignorance of newbies.

I don't know what the AdWords policy is exactly, but I'd be curious to see what their stance is towards pre-order products.

If the current 30 day delay is because of needing to book new slots with CIARA for assembly then why not just ship out the bare modules and/or kits?

Perhaps customers that opt in to self-assemble a kit can actually get some hardware shipped now?

I have come to believe that Eduardo is a man with integrity, driven by the goals and beliefs of a true Bitcoiner, i.e., a belief in transparency, openness, honesty, and hard work.

I believe that Eduardo's goals are noble and that you will believe this also once he announces publicly his plan for buyer refunds and the Miner Protection Plan.

Their goal is to under promise and pleasantly surprise.

So how is that working out for you?

STOP treating your customers as tools and pawns. We are customers, not captives.

Regarding the mining with customer hardware accusations - HF should have seen this coming from miles away and did nothing to mitigate these issues. So the fact that this is happening is their own fault. Not the customers.

In fact I warned them against this scenario back on August 11 and they decide to ignore it. Neither did they mine on testnet like most responsible hardware companies do when testing pre-production hardware or doing customer equipment burn-in tests.

Cointerra seems to be making good progress recently. Their ASICs have finished packaging and the PCB is ready.

Also, my unit is not a developer sample. I paid for it (HashFast is probably the only business ASIC manufacturer so far which hasn't provided a sample unit for BFGMiner dev).

The fact that only Luke-Jr confirms shipping does sound a lot like BFL. In order to win a bet that BFL would ship the first units before April 01 2013 they sent 1 unit to Luke-Jr. However it was never actually shipped because Luke decided to leave it at BFL. I only say it how it is.
Neither BFL's developer-friendliness nor HF's lack thereof are at all relevant to the fact that FedEx called me and (among other things) gave me a tracking number.

Sure, and I didn't mean to pick on you personally, just wanted to point out some similarities to the BFL delivery claims. Thanks for sharing!

im sure if hashfast has a workign miner that is using 450w instead of 350w   it wont be a deal breaker for anyone that has been waiting on the Oct delivery of units Smiley

they will just be glad they got something.....

2014 will likely be the year where the power efficiency before a determining factor in the long term profitability of mining hardware. So yes it does matter to me and was one of the reasons I chose HF to start with. Remember, If you have MPP you will (hopefully) get 4 more modules. So the full system will consume an additional 500W in this case.

Also before HF ships anything, they really should publish the final specs and tell us exactly what they are shipping. If they don't deliver what they promised the customer has the right to return the product and request a full refund.
