Lots things to update.

1. We are currently investigating on the three or so shipments that have shown up badly damaged to the customers. They do no appear to be simple delivery damage: they are not dents but some corners of some of the units have been snapped off. It takes a great amount of force to snap 3mm aluminum that's been bolted down with 0.9mm screws in a box with foam padding. We are not ruling out the possibility of sabotage.

In future, when receiving an Avalon package, if there is any rattling sound coming from inside, open the package in front of DHL/EMS and inspect the inside, if there is damage immediately return the package to the sender. The receiver must submit the complaint so us, the shipper can receive this information from DHL/EMS and we can investigate.

Do not worry, even if DHL/EMS does not compensate for the damages, once you send the damaged unit back, we will send you a replacement free of charge.



2. Our new SMT equipment has arrived, it is expected to be tweaked and fully functional by the second week of May. Expect an updated gallery of our facility soon.[b] In the mean time we are going to send out ~20 units[/b] through our new shipping channels and test the waters. [b]We expect to go full throttle once the new SMT line comes online.[/b]

BFL just sent you a nice letter with lots of yadda yadda. The interesting part is this here:

"Please be advised that [1]due to the adjustments described above, we need your confirmation prior to release of your order into the final build queue and on to final delivery.  It may also be a good time to [2]review your purchase altogether relative to the bitcoin market as this is the last opportunity to do so.  If your order is not confirmed, it will be canceled and your money will be refunded. "

They did this because of legal reasons - to be on the save side:
[1] They screwed up power and performance, so they want to get your OK.
[2] They screwed up shipment dates - and know that it will take a long, long time before your units will be shipped - and difficulty will have sky rocketed and you only make a fraction of the Bitcoins that you would have made had BFL shipped on time. They want to get your OK for that too.

Basically it's like a blank check for BFL: "OK we screwed up big time but you have to sign here XXX and confirm that this is still OK with you".

Not that some of you guys come up with the idea of suing them ...  Wink

Your assertion seemed to be that they are dependent on new orders for continuing operation.  I seem to recall you mentioning it was the return of funds that was giving the illusion of strength.  If they stopped honoring refunds, this illusion would be broken, and the pre-order stream would dry up.  I don't see how they are able to stop refunds (no matter how much they state, "all sales are final").
I can't make any assumptions on this, my friend.

Keep this in mind: Does your (or anyones) assumption about what is "the right thing to do" have any bearing on what BFL will "actually" do? No? Then...?

What happens in a customers head is totally independent of what happens at BFL.

Customers always complain because they assume things that aren't actual. When a companies actual policy (or change in policy) contradicts what they thought should happen, they get very upset. They always lose. So I am warning people to do their checks so they don't have to feel that way. Nothing more. Better safe and informed than "sorry".

I got my refund a month or so ago, as it was clear they are going to be shipping into the difficulty high tide generated from Avalon and AsicMiner.  But had I been a believer, I don't think I would have any issues with confirming my order at this point.  If they stopped honoring refunds now, it would be give a very strong signal that they are not capable of delivering (something they are obviously trying to avoid).

I do find the timing of this campaign odd given that they just had the bad news about the unusable chip wafer.
I unfortunately assume the worst when it comes to BFL.

So they need permission to do the switch. If they actually deliver the hash power, I don't think anyone will care the form factor changed. Power consumption is disappointing, but at the current exchange rate and network hash power it is a non-issue. This is actually a sign from BFL that they are acting in a professional fashion to inform their user base.
People are ready to assume that if they do accept, they will still have the option to refund.

As a sensible customer, they need to realize that once they accept a change of hardware, they also give consent.

If people are relying on the refund window still being there without asking BFL:

"Hey, if I tap confirm, can I still refund at any time?"

Then they are asking for it to blow up in their face. BFL had little leeway in not giving customers their refund. They are obligated to do so as they have failed to deliver. Now that customers are being queried if they accept the changes, and indicate they still want their order...they are giving consent. Thereby reducing their position in asking for a refund.

People need to wise up and ask BFL (in writing through official statement and official channels) if they will still honor refunds requests after tapping "Confirm Order".

If you don't then, don't be at all surprised if BFL throws back at you the fact that you confirmed your order as a reason to deny any future refunds. You gave consent as of....May 1st 2013 to "changes" and the "status of an order". They also shipped, which means they don't have to offer you a refund anymore.

This is called Disarming the Merchant [from future excuses] and making sure you know what you are getting yourself into.

ASK questions, that is all I am telling BFL customers to do. Then, tap Confirm. Don't tap confirm like idiots on a whim or an impulse.

Eh ... I might be new to BTC, but AFAIK the preorders were also not subject to refunds, still they have done refunds. That you don't have explicit rights for refunds does not mean that it cannot happen.

My guess is that this is about the power usage and casing that is different than announced when they launched the preorders.

Offc you don't have to think about this as you never ordered or have cancelled your order long ago.
Assume absolutely nothing.

You assumptions are not enforceable and they may not be realized by BFL.

Is it possible to see/track the origins of  blocks generated by looking at BlockChain.info?

There was a guy a day or two ago on BFL forums and Reddit claiming that he saw a ton of Blocks coming from Kansas. The accusation coming from the guy on Reddit was that it was BFL using mining hardware.

You can use this site to look at the last 2000+ blocks found: http://blockorigin.pfoe.be/blocklist.php

Find the ones that were found by an "unkown" entity. Click on the blockchain link to see the information of that block located on the far right.

It says what IP address found that block on that page on blockchain.info "relayed by:  xxx.xxx.xxx.xxx".

Then you would need to proceed to look up where that IP is located at a web site like this one: http://www.iplocation.net/

Agreed to a certain extent. But still, common sense if nothing else tells you to treat people who have given you, or may give you money, with some respect.

Respect is earned and not bought, if someone behaves like an idiot I expect them to be treated like an idiot independent of the size of their wallet.

This is pretty much the long and short of it.  If you actually go back in my post history and look at the people who approach me in a rational, honest way, they get the same in response.  Approach with an irrational, trollish way, spouting lies and BS... well, you get what you deserve.  Take k9quaint and PL as prime examples.  Every post they make for the most part contains at least one lie or falsehood, doctored up to support their flawed positions and irrational hatered of BFL, so they get the same in return.  In contrast, take any post that has a mature tone and rational content, and you'll see my responses are equally rational and helpful.  The problem is, Bitcointalk has very little of the latter and is comprised almost entirely of the former.


On my tenth post in dealing with Inaba he threatened to hold a restraining order against me (on bogus trumped up charges). This was to keep me from ever referring any statements to BFL, Himself and/or keep me from interacting with the forum. He stated that my daughter and family might be incarcerated or financially held liable. This was because I dispatched an email and complained to BFL that his behavior was "unacceptable" and he was costing them money. He (Josh) in turn intercepted the emails and then stole my private information contained within the complaint.

He then addressed me to de-escalate my interactions in PM. Which I then sent the PM to TheyMos (Site Admin).

TheyMos then agreed that Josh was....I don't recall the wording exactly...but something akin to an asshole. He thought I should post it publicly. Josh (in the midst of his threatening PM) asked me not to reveal the PM at that time.

I told Josh that he could not prevent me from bringing my complaint to BFL (his employers). Since then he and I have never gotten along. Since then he and I have been cats and dogs.

For months now, Inaba has been spreading all kinds of baloney. If you believe him, without actually looking into his claims, then you deserve to be duped. Do you homework first and read up, then make your decision.

If it hasn't become pretty obvious by now, he has a pretty low standing in the community due to....all sorts of things.

The only reason why people even treat him amicably is because he has others pre-order money and probably because they REALLY (I mean REALLY) want the e-money printing machine. (Jalapeno, Little Single, Single, MiniRig)

If it weren't for their pre-order money and a hopeful promise, I doubt most customers would tolerate Josh/Inaba for any length of time.

I personally think Josh knows this, so that is why he is such an asshole. He doesn't have to be nice. Not to customers or even to prospective customers. He knows people will lose their pre-order if they lose their cool. So they don't and bite their lip. They are willful "hostages" as another BFL customer mentioned in his "quiet rage" at Inabas/Josh postings and surreal attitude.

Keep in mind what you getting into before you send funds to BFL. That is all. Read up on the past, then with that information you will make your own informed decisions.
