Wikileaks release of TPP deal text stokes 'freedom of expression' fears

Intellectual property rights chapter appears to give Trans-Pacific Partnership countries’ countries greater power to stop information from going public


Wikileaks has released what it claims is the full intellectual property chapter of the Trans-Pacific Partnership (TPP), the controversial agreement between 12 countries that was signed off on Monday.

TPP was negotiated in secret and details have yet to be published. But critics including Democrat presidential hopefuls Hillary Clinton and Bernie Sanders, unions and privacy activists have lined up to attack what they have seen of it. Wikileaks’ latest disclosures are unlikely to reassure them.

One chapter appears to give the signatory countries (referred to as “parties”) greater power to stop embarrassing information going public. The treaty would give signatories the ability to curtail legal proceedings if the theft of information is “detrimental to a party’s economic interests, international relations, or national defense or national security” – in other words, presumably, if a trial would cause the information to spread.

A drafter’s note says that every participating country’s individual laws about whistleblowing would still apply.

“The text of the TPP’s intellectual property chapter confirms advocates warnings that this deal poses a grave threat to global freedom of expression and basic access to things like medicine and information,” said Evan Greer, campaign director of internet activist group Fight for the Future. “But the sad part is that no one should be surprised by this. It should have been obvious to anyone observing the process, where appointed government bureaucrats and monopolistic companies were given more access to the text than elected officials and journalists, that this would be the result.”

Among the provisions in the chapter (which may or may not be the most recent version) are rules that say that each country in the agreement has the authority to compel anyone accused of violating intellectual property law to provide “relevant information [...] that the infringer or alleged infringer possesses or controls” as provided for in that country’s own laws.

The rules also state that every country has the authority to immediately give the name and address of anyone importing detained goods to whoever owns the intellectual property.

That information can be very broad, too: “Such information may include information regarding any person involved in any aspect of the infringement or alleged infringement,” the document continues, “and regarding the means of production or the channels of distribution of the infringing or allegedly infringing goods or services, including the identification of third persons alleged to be involved in the production and distribution of such goods or services and of their channels of distribution.”

TPP is now facing a rough ride through Congress where President Obama’s opponents on the right argue the agreement does not do enough for business while opponents on the left argue it does too much.


Obama has pledged to make the TPP public but only after the legislation has passed.


Michael Wessel was one of the advisers who was asked by the US government to review what he said were woefully inadequate portions of the document. Wessel said the thrust of the TPP does nothing for Americans. “This is about increasing the ability of global corporations to source wherever they can at the lowest cost,” he said.

“It is not about enhancing or promoting production in the United States,” Wessel said. “We aren’t enforcing today’s trade agreements adequately. Look at China and Korea. Now we’re not only expanding trade to a far larger set of countries under a new set of rules that have yet to be tested but we’re preparing to expand that to many more countries. It would be easier to accept if we were enforcing today’s rules.”

Wessel said that ultimately, the countries currently benefiting from increased outsourcing of jobs by American firms aren’t likely to see wages rise above a certain level. “If you look in other countries, Mexico and India and others – there’s been a rise in the middle class but there’s been stagnation for those we’re hoping to get into the middle class,” Wessel said. “Companies are scouring the globe for countries they can get to produce most cheaply.”

That, he said, results in constant downward pressure on American wages. “Companies are not invested here the way we’d like them to; they’re doing stock buybacks and higher dividends,” Wessel continued. “They may yield support for the stock-holding class but it’s not creating jobs.”

I've looked at the title of this thread for months but never opened it until now. It just seems like a provocation... a hot-button topic. an argument for the sake of arguing.

today i opened it up... FORTY ONE PAGES! almost every post is hundreds of words long! damn people sure  get riled about this stuff!

well here's my take; I dont think everybody hates environmentalists and feminists. I dont even think many people hate either group. certainly no one sane and good hearted does. I love women and EXPECT every one to be a feminist. I dont respect women who aren't intelligent and strong. who would?

and the environment is in dire straits, we should all be environmental, if you aren't you are akin to committing crimes against humanity. isn't it obvious how polluted the world is? isn't it obvious we need to take better care of the planet?

there are people who resent both groups, but they are a very loud minority. the best defense against these fools is to ignore them. they're just mad because they never get laid (unless they pay for it)

You should read the first post. Better yet go to the link on the first post. This thread is about why a very open liberal website had such title and why they were right about it.

Nope, not all feminists are women. I'm a testament to that. I believe in equal rights for both sexes.

If you believe in equal rights for both sexes that just makes you a normal person. You dont need a label for that. That's pretty much a description of almost everyone. Atleast in the west. Modern feminists aren't about rights, they are about enforcing equality of outcome which requires different people to have different rights. So for example if men and woman having equal rights leads to men making slightly higher wages on average than females, than feminists are not satisfied with this and will seek to enforce equality of outcome by giving woman special rights that men don't have.

When the sun isn't striking the lunar surface but is hitting the earth, the Moon is often faintly visible from reflected light - Earthshine. 

From an orbiting ISS or satellite, one can point a telescope with sensors at the Moon.  At appropriate times, it shouldn't be a problem to measure Earthshine.  Since the lunar surface, unlike that of Earth, never changes, this gives you a direct measure of the outgoing radiation from the Earth.  Hence you can measure albedo of the planet in it's entirety and over time, figure the radiation balance and whether it is going in the direction of cooling, or warming.

Maybe that's a bit technical but I'm wondering why no one has done it....
You can measure it directly, no need for using the moon.
NASA's CERES is doing that.



The thing my little brain does not get. What is the "base" for the average temperature of the earth? The blue curve is beautiful. It goes up and down... And I see a zero line in the middle. That's cute too...

Trevor Noah’s “Daily Show” ratings are much more amusing than Trevor Noah. Jon Stewart never had very good ratings. With fewer than 1% of America very tuning in, because they could use him as a bludgeon against the political right, the media turned Stewart into a Potemkin Phenom. Noah’s glaring lack of talent, charm and intelligence has driven his debut ratings even lower.

Despite all the free hype from every corner of the left-wing national media, Noah bombed during his first week with an average of just 1.02 million viewers. That’s down a breathtaking -33% from this same time last year. And at this same time last year we were not in the middle of a historic presidential election delivering all-time high cable news ratings during the debates.

The best news is that young people have abandoned the show in droves. Among teens, the “Daily Show” ratings are down an incredible -59%, from 56k average viewers to just 23k.

Trevor Noah sucks. Everyone knows it. He’s a left-wing extremist like self-proclaimed socialist Jon Stewart, but Noah has no talent. He’s creating the GOP-hating content the national media desperately desire, but the content is so bad, the media isn’t re-running it endlessly.

When CNN isn’t using your left-wing propaganda, you suck like nothing ever sucked in the history of suck.

The stealthy, Eric Schmidt-backed startup that’s working to put Hillary Clinton in the White House


An under-the-radar startup funded by billionaire Eric Schmidt has become a major technology vendor for Hillary Clinton’s presidential campaign, underscoring the bonds between Silicon Valley and Democratic politics.

The Groundwork, according to Democratic campaign operatives and technologists, is part of efforts by Schmidt—the executive chairman of Google parent-company Alphabet—to ensure that Clinton has the engineering talent needed to win the election. And it is one of a series of quiet investments by Schmidt that recognize how modern political campaigns are run, with data analytics and digital outreach as vital ingredients that allow candidates to find, court, and turn out critical voter blocs.

But campaigns—lacking stock options and long-term job security—find it hard to attract the elite engineering talent that Facebook, Google, and countless startups rely on. That’s also part of the problem that Schmidt and the Groundwork are helping Clinton’s team to solve.
The Groundwork is one of the Clinton campaign’s biggest vendors, billing it for more than $177,000 in the second quarter of 2015, according to federal filings. Yet many political operatives know little about it. Its website consists entirely of a grey-on-black triangle logo that suggests “the digital roots of change” while also looking vaguely like the Illuminati symbol:





“We’re not trying to obfuscate anything, we’re just trying to keep our heads down and do stuff,” says Michael Slaby, who runs the Groundwork. He was the chief technology officer for president Barack Obama’s 2008 campaign, a top digital executive for Obama 2012, and the former chief technology strategist for TomorrowVentures, Schmidt’s angel investment fund.

He explained that the Groundwork and its parent company, Chicago-based Timshel—named for a Hebrew word meaning “you may” and devoted to “helping humanity solve our most difficult social, civic, and humanitarian challenges”—are “all one project, with the same backers,” whom he declined to name.

Schmidt did not respond to several requests for comment. But several Democratic political operatives and technologists, who would only speak anonymously to avoid offending Schmidt and the Clinton campaign, confirmed that the Groundwork is funded at least in part by the Alphabet chairman.

The Groundwork was initially based in an office in downtown Brooklyn just blocks from the headquarters of its biggest client: the Clinton campaign. There, a staff made up mostly of senior software engineers began building the tools and infrastructure that could give her a decisive advantage.

Slaby has a reputation for being able to bridge the cultural divide between politicos and techies. And sources say the Groundwork was created to minimize the technological gap that occurs between presidential campaign cycles while pushing forward the Big Data infrastructure that lies at the heart of modern presidential politics.

There is also another gap in play: The shrinking distance between Google and the Democratic Party. Former Google executive Stephanie Hannon is the Clinton campaign’s chief technology officer, and a host of ex-Googlers are currently employed as high-ranking technical staff at the Obama White House. Schmidt, for his part, is one of the most powerful donors in the Democratic Party—and his influence does not stem only from his wealth, estimated by Forbes at more than $10 billion.

At a time when private-sector money is flowing largely unchecked into US politics, Schmidt’s funding of the Groundwork suggests that 2016’s most valuable resource may not be donors capable of making eight-figure donations to Super PACs, but rather supporters who know how to convince talented engineers to forsake (at least for awhile) the riches of Silicon Valley for the rough-and-tumble pressure cooker of a presidential campaign.

“There are a lot of people who can write big checks,” Slaby says. “Eric recognizes how the technology he’s been building his whole career can be applied to different spaces. The idea of tech as a force multiplier is something he deeply understands.”
The technology that helped re-elect Obama

Although Obama’s technology staff downplays credit for his election victories, there’s no doubt they played a crucial role. One former Obama staffer, Elan Kriegel, who now leads analytics for the Clinton campaign, suggested the technology accounted for perhaps two percentage points of the campaign’s four percent margin of victory in 2012.

The 2012 campaign’s analytics team constructed a complex model of the electorate to identify 15 million undecided voters that could be swayed to Obama’s side. They drew on databases which compiled a comprehensive record of voters’ interactions with the campaign—Facebook pages liked, volunteer contacts, events attended, money donated—and assigned them a score based on how strongly they supported Obama.
Those carefully constructed models and databases paid dividends for everything from advertising and campaign fundraising emails—which were rigorously A/B tested to determine the optimum wording and design (subject lines that said “Hey!” were found to be annoying but effective)—to voter polling and get-out-the-vote efforts on election day

Perhaps the standout innovation from the Obama campaign was known as “Optimizer,” a tool that allowed the campaign to deploy carefully targeted television ads. Rather than rely on broad demographic data about programs and time slots, the Obama tech team accessed detailed information from TV set-top boxes to identify the most cost-efficient ways to reach hard-to-reach voters. The campaign’s top media consultant, Jim Margolis—now Clinton’s top media consultant—estimates Optimizer saved the campaign perhaps $40 million.
After the campaign, Optimizer became the cornerstone of a new startup called Civis that spun out of the Obama campaign—and it had its genesis in an election day visit by Schmidt to Chicago.

Senate Democrats gathered Thursday on the steps of the Capitol surrounded by about a dozen armed guards to announce a new push for tougher gun-control laws.

The officers from the U.S. Capitol Police, who carried sidearms, were in addition to the regular detail paroling the Capitol ground due the large number of elected officials attending the event, according to a officer on the scene.

About 27 Democratic senators attended the event.

REPORT: Donald Trump Stopped Baseball Bat Beating on New York City Street in 1991


NEW YORK — Call it The Donald to The Rescue.

When he saw "a big guy with a big bat" bashing another fellow, Donald Trump did what any self-respecting billionaire would do: He ordered his driver to pull over.

"I'm not looking to play this thing up," Trump said yesterday. "I'm surprised you found out about it."

Witnesses said Trump, with Marla Maples tugging at his arm to try to stop him, leaped from his black stretch limousine Monday evening during the Manhattan assault.

"Someone in the car looked over and said, 'Gee, look at that, it's a mugging,' " Trump said. "I said to my driver to stop the car because it was brutal-looking."

Trump was at first reluctant to discuss his daredevil deed, but then he warmed to the task.

"The guy with the bat looked at me, and I said, "Look, you've gotta stop this. Put down the bat,"' Trump said. "I guess he recognized me because he said, 'Mr. Trump, I didn't do anything wrong.' I said, 'How could you not do anything wrong when you're whacking a guy with a bat?' Then he ran away."

Trump said the incident occurred at 8 p.m. as he, Maples and another couple were heading toward the Lincoln Tunnel on their way to the Meadowlands in New Jersey for a Paula Abdul concert.

Kathleen Romeo, a 16-year-old student at St. Michael's Academy in Manhattan, said cries of "There's Trump!" went through the crowd of onlookers when the erstwhile deal maker emerged from his limousine in front of a Smiler's deli.

"A lot of people were surprised that he got out to see what was happening," Romeo said, adding that the bat-wielder ran off just before Trump actually appeared, and that Trump, "just looked around and went back into his limo."

But another witness, who asked not to be identified, supported Trump's tale.

"All of a sudden, a big long limousine pulls up on an angle, and Donald Trump pops out with the blond, too," the witness said. "There was a guy with a bat, hitting a guy over the head, and Trump yelled, 'Put that bat down. What are you doing?' The guy dropped the bat, came over and started talking to him."

Trump said the bat-man delivered at least "five or six good whacks" before he interceded.

Trump said he left the site only after he saw a man who appeared to be a doctor treating the victim and heard that an ambulance was on its way.

A Midtown North Precinct spokeswoman said the attack was not reported to police.

The incident may have been a karmic sequel to the Oct. 31 mugging of Trump's mother, whose attacker was chased and caught by bread deliveryman Lawrence Herbert.

"I was sort of lucky because of this gentleman Lawrence Herbert who helped us," Trump said yesterday. "So I thought about that afterwards."
