- Kasus Pertama
Beberapa hari yang lalu, tepatnya Tanggal 10 Agustus 2021 saya menjual Sepeda motor Yamaha X-Max, pembelinya mahasiswa dan masih satu kota dengan saya dan sepakat dengan harga sekian IDR, namun dibayar dalam bentuk BTC. Tadi siang orang tua pembeli datang ke rumah untuk ambil BBKB karena kemarin saya minta waktu untuk mengurus ke leasing (BBKB sekolah biar pinter), yang jadi masalah adalah istri keceplosan bahwa motor dibayar pakai Bitcoin dan si Ibu anak tersebut yang kebetulan bekerja di Pengadilan dengan mimik wajah aneh menimpali ke saya "Bukanya itu Ilegal ya Pak?" tapi semua berlalu dengan aman-aman saja meski ke dua orang tua tersebut telihat sedikit kecewa dengan anaknya dan terlihat sangat khawatir. Sementara saya juga tidak berani untuk bercerita banyak tentang BTC ataupun Crypto apalagi berdebat tentang proses, karena yang saya hadipi sepertinya lebih faham hukum. DILEMA.

Pertanyaan saya :
1. Transaksi ini personal dan atas kesepakatan bersama, tidak melibatkan pihak manapun. apakah ini masuk pelanggaran UU Nomor 7 Tahun 2011, BAB 5 Pasal 21?
2. Jika kemudian hari ada pihak yang berkepentingan, apakah mungkin transaksi di Binance ataupun market lain bisa dilacak secara gamblang dari mulai proses bank, deposit ke market, transfer balance / WD antar akun?
3. Apakah hukum dinegara kita memungkinkan untuk aparat secara legal meminta sebagian/seluruh data profile dan dokumen (karena kebanyakn dari kita KYC) serta transaksi pengguna disebuah market / exchanger secara sebagian ataupun menyeluruh?
