Are you sure about that? Its not that people invested fiat into ken, they invested bitcoins. So in case they would have given him gold instead of bitcoins he would need to give back gold i guess.

The Government doesn't recognize gold as a currency, you would have to refund people in cash.  For instance, in court cases that involve broken engagements, a court cannot force one party to return an engagement ring.  Instead the court fines that person in cash.  The courts deal with cash.  Property sometimes, but that is usually auctioned off for cash.  At no point does the court say, "You gave him a 1978 Jeep.  You need to return him a 1978 Jeep."   Never happens.  The refund will have to be in cash.

Yes, the US doesnt recognize them as a currency... yet. But wouldnt that mean Bitcoins are a thing that you gave him? I give you a painting of picasso and you give me 100 shares. He breaks his part of the contract so in theory the contract is invalid. Things have to be given back. I guess that would mean the painting has to be given back. If he sold it in the meanwhile he would have to make up for the value of the painting. Though i wonder if the current value or the value of the exchange time would matter.

But thats only how i think it would work. If Bitcoins are no currency then they are a thing. And the thing has to be returned or the value of the things has to be paid.

Anyway... its most probably totally useless anyway to think about what might happen in a nice situation. This is no nice situation and ken hasnt nearly enough to hold its last promise in any way. He might surprise us but since he wasnt able to surprise positively in the last months... he most probably cant surprise now too.

Im already feeling stupid answering this but thats all he did? You look way worse in this log. Your trustrating doesnt speak for you as well. I suggest you take this somewhere into private to continue this fight. This seems not connected to his IPO or his honesty in any way.
I guess if you have something substantially ok, but this looks simply like a personal fight.

No there is much much much more that he did I apologize for not having the full logs I'm trying to get them off the Game Creator Di (Andrew Tepper).

3. Trying to Sell IPO Shares to New Players

Ok. I admit that i would wish Klye wouldnt throw words around so easily. But even when he fighted with you... it wouldnt have much to do with his business. I wonder whats the base of your fight is.

The law would not tell Ken to refund people in Bitcoin.  They don't recognize Bitcoin as a currency.  So the refunds would be in cash.  If you paid $140, he'll have to refund you $140.  Based on what you paid in cash is what you will get reimbursed.

He really offered to reimburse? I cant imagine where he would get the funds from. Its impossible so it sounds to me like the next promise ken gives in order to allow him "trying" to make all good again. Theres no reason that this promise is worth more than the other refund promises. I guess thats how he is.

I wonder what all these informing of police, interpol and so on will lead to. Not only to ActiveMining i mean. For ActiveMining i think its totally useless to go that way. Sueing ken? For what? You saw what amount of bitcoins are in the known addresses? Then add the outstanding refunds and everyone should realize that sueing would most probably cost more than it could gain.

What im more concerned about is what will all those projects going down left and right will mean for the involvement of government. I mean first everyone is happy and invests in unregistered shares but when it goes wrong he calls for government. I cant blame anyone for that of course because most projects seems to be run by guys that lack knowledge in one part or another. So that things go wrong. But when practically every second, or even more, project ends in complaints and cries for government... what will that mean for Bitcoin one day? Will Bitcoin look like a shark pool or a den of thieves? So that government will suppress it? Or will they regulate it only?

The best outcome would be that the people doing business know what they do and do business wise decisions instead basing decisions on other things. But why should that change now for some reason?

I tend to sigh in the last time when i think about bitcoin projects... Bitcoin gains trust again, showing it in the shareprice, but i wonder where it leads too with all those investors wanting the government involved.

I wasnt able to withdraw coins a week ago. The support told me that the wallet went offline. They have email alerts for this case but this time the wallet went offline another way so the email wasnt happening.

Lets hope this isnt similar to the wallet problems weexchange got... the amount of bitcoin addresses were too much to work with at one point in time.

Best bet is to send them a ticket or email...

wow, you still keep funds at cryptostocks; They have already 'lost' more than 3.8 million $ of users funds down the back of the sofa, what more will it take? You must be a glutton for punishment., after all your previous losses you are warned about long ago in advance.

Best advice is to withdraw at first opportunity.If you are successful never look back. Of course it's similar, the least they are doing is playing fractional reserve with users balance for long time.

I dont have coins there but i have shares that are only traded there. So i need to withdraw sometimes.

I only mentioned it because i had a similar problem that was solved.

Schau mal im letzten Absatz. Bitcoin.de rät dazu services wie bitpay.com zu nutzen da die in den USA sitzen. Da der Empfänger am Ende nur Bargeld aufs Konto bekommt ist die USt wohl kein Problem. Das gilt dann auch für lobbycontrol da sie bitpay nutzen.

Das stimmt aber nur, wenn Bitpay seine AGB anpasst:

"You authorize us to receive, hold and disburse funds on your behalf and to take any and all actions that we think are necessary or desirable to provide the Services and to comply with applicable law."

Bitpay hält also die Bitcoins DES HÄNDLERS und verkauft diese für den Händler. Ergo: Umsatzsteuer.

Ich muss wohl doch mal einen Blogpost dazu schreiben, auch wen den eh keiner liest.

Man könnte aber vielleicht argumentieren dass man keine Bitcoins erhält die bitpay halten würde. Bitpay erhält Bitcoins und der deutsche Shopbesitzer erhält Euros. Er besitzt praktisch nie Bitcoins weil die sofort in Euro umgetauscht werden. Die Möglichkeit in Bitcoins zu bezahlen sollte damit risikolos sein da der Shopbesitzer nie Bitcoins besitzt. Natürlich muss er dann auch eingestellt haben dass die Bitcoins nicht als Bitcoins gehalten werden sollen.

Bin natürlich kein Jurist. Ich hoffe auf jeden Fall dass das geklärt wird. Ist doch balla balla diese Einstellung. Die hätten mal die Profis von der Bafin fragen sollen anstatt irgendwelche Parteideppen im Finanzministerium. Die Regierungsparteien sind ja nun wirklich nicht für ihre Innovationen bekannt... Stichwort Neuland.

Ui... das wäre übel. Bitcoins wie eine Ware oder Dienstleistung behandeln würde Bitcoins unnütz als Zahlungsmittel machen. Immerhin reden sie von gewerblich. Ich frage mich ja was kraken dazu sagt. Die handeln ja definitiv gewerblich mit Bitcoins.

Sorry für Spaßbremse sein. Was ist mit Umsatzsteuer? Wurden die Bitpay AGBs angepasst? Wenn diese Frage überrascht, mache ich mal einen Blogpost zu dem Thema. Nicht dass 19% der Spenden an den Staat gehen...

Solange die Bitcoins gekauft sind ist die USt kein Problem da sie als Währungseinheiten eingeordnet wurden. Beim Mining ist es wohl noch nicht so ganz entschieden aber vermutlich macht es auch da keinen Sinn zu verlangen dass USt auf geschürfte Coins anfallen da das ja dann bei jedem Verkauf weiterlaufen müsste.

Soweit ich weiß hat lobbycontrol das so eingestellt dass die bitcoins gleich in fiat umgetauscht werden und, vermutlich minus die bitpay-gebühr, direkt aufs bankkonto geschickt werden. USt ist da kein Thema.

Ansonsten kriegt man wohl auf Anfrage oder ausreichender Spende am Anfang des nächsten JAhres eine Spendenbescheinigung. Solange man natürlich nicht anonym gespendet hat.

Ah... alles klar. Gut zu lesen. Smiley Hoffentlich bleiben uns diese Freihandelsabkommen wie TTIP(TPP), TISA, CETA usw usf erspart. Mit den enthaltenen Investionsschutzabkommen und Schiedsgerichten sind sie ein echte Demokratieproblem und bedeuten eine Verschiebung der Macht hin zu Konzernen die dann demokratisch beschlossene Entscheidungen kippen können... wenn Gesetze ihre Gewinne schmälern.

I always lose my comprehension when good people claim they have to go because there are bad people. Letting the whole thing rule by these "bad people" at the end. Thats not a smart move in my eyes and those leaving people look to me like they are one of the reasons when things go bad afterwards.

Yes. But what is more important? Bitcoin or the idea that it was built upon? The US Constitution or the ideas that it was written upon? (Forgive the country-centric view point.)

The bitcoin foundation wont vanish until most miners drop their support. And i dont see that coming. So at the end leaving the foundation is like those guys that dont go voting. Its useless to vote in the US because of their voting system but other countries have other systems. If someone isnt voting he often claims he dont want to support the system. But he isnt changing anything with it. Even only 13% voting peoples in the last european parliament vote in slovakia didnt change anything about that the election was valid. Even worse... each non voter means this vote voted 30% winning party, 20% second winning party and so on. So non voters even support the system because they dont vote small parties instead that want to change things.

So no... i dont think that the winning parties will cry about it. They are happy about them in fact.

The same goes for the foundation i think. If one leaves because things go wrong... means the remaining members have more power to make it the bad way.

Only saying. I dont wont to force anybody in when he doesnt feel like it of course. Its only factual not a good move.

I wonder if the talks about italy police are correct. Maybe its better to target the chinese police. I mean they seem to like bitcoins as topic and busted already scammers. Maybe he really tries to hide in hong kong...

If he really feels as confident as this looks then its not a good sign.

I vividly imagined how you go through the streets getting slapped by girls calling you a pervert... sounds like a hard job... Wink

I like how cautious you are. Even getting a refund for hosting and putting it back into IPO-Account. Smiley

And i think it was a good move to not buy that camsite. Besides the guy being strange... the chance is high that he was a scammer. Normally websites sell for 10 to 12 months worth of profit. Theres a chance he artificially raised the traffic and the income in the last months in order to show good revenue. When he stops doing it the website might make practically nothing. And you might get complaints because he spammed guestbooks or whatever technique he used. That all only if these images were real and not manufactured or unrelated.
Next thing might be the domain is stolen and and and... domain market is a shark pool and a big part of it are persons that churn out domains, market it and sell them in masses. Once they are sold the new owners wonder why the great turnkey business doesnt work as promised.

So i think a buy should be carefully checked...

Maybe ill buy some shares once this moves on... observing Smiley
