Is this again a misuse of english words from my side? Sometimes i dont know when things are read different in english than i would say it in my mother language.
I meant i write relatively often with ukyo. And i have the impression he is after it and tries to solve things on different levels. Of course thats no evidence, only an impression. Though i think its more than a claim of thiefery that has nothing backing it.

Have some fucking patience, you started bitching about the transfer 3 hours after you sent the email. Seems to me you just like to bitch. Give it 24 hours before complaining.

So? I had to use a very special email format to a special email address just for this transfer. Including certain subject and all. Of course i thought ken sat up a script that automatically handles the transfers. Especially since others claimed they got their shares pretty fast. And youre wondering that im worried something went wrong?

And why the heck do you claim im not allowed to ask back? In the last day the shareprice dropped hundreds of percents. And i didnt even know if i maybe made an error in my mail.

By the way... its over 24 hours...

And the payment processor? Do you see a sense in ken's claim? I dont understand you. Either you want to hold your shares, then i would await that you want ActM sells miners or you want to dump if you dont believe in it anymore. I dont want anything different.

And yes... im angry having lost so many bitcoins in this venture. And having to watch how the shareprice halves and halves and halves even more while others have the chance to trade. Sorry i vent it on you now but being told i have to be silent on this topic is a bit much to demand.

I think its clear that either this project manager is one day a month guy or Ken is a one day a month guy. Two questions:

1) Ken how many days per month do you spend working for this company?

2) Do you own/run any other companies and how many days a week do you work for them?

I work full time, 7 days a week.  I have 1 other company, it runs itself.
So then why does it take over a month to fix the website? Why can't you sign up for Bitpay and install their prestashop plugin in an hour to automate bitcoin payment?

First of all, I don't want to do business with bitpay because they are in bed with BFL.  Second, there are a lot of other things going on in the background that need to be taken care of, i.e datacenter, cash flow, lawyers, MSD, customer service, just to name a few.

So you say only because a company, that you dont like because of their business ethics, is using the same payment processor, means that you cant use them now? I dont see the sense in that.

And what about the shares? Do you have thousands of shareholder requests or why is my mail without effect since 16 hours?

"Why would somebody work for free..." I fear that shows more about your character than ukyo's. Only because you cant imagine that there are honest people that try to solve thingsthat they crashed doesnt mean there arent such people.

Get in contact with ukyo and speak with him. And try not to let your fears go amok. As long as you dont have evidence for the claims of stealing its useless to claim that he stole anyway. Because you wont get it back then anyway.

Sollte es wirklich mal nennenswerte Einkommen erzielen würde ich auch empfehlen eine offizielle Anfrage bei der BaFin einzureichen.

Da ich dafür nichts verlange, gibt es auch kein Einkommen.  Wink

In diesem Fall halte ich es wie in anderen Dingen auch. Solange keine eindeutigen Vorschriften da sind, halte ich die Augen offen und lasse es darauf ankommen. Wenn mir dann ein Richter mit ein per kreativer Auslegung der Rechtslage aus "politischen Gründen" ans Bein pinkelt, dann ist es eben so. Gegen Willkür gibt es sowieso keine Absicherung.


Auch keine Spendenmöglichkeit? Das kann auch als Einkommen aus dieser Tätigkeit gelten. Ich frage mich in wie weit es für dich riskant wäre wenn zB illegale Geschäfte mit Hilfe des Services getätigt werden. Man hat mir gesagt ich solle aufpassen da nichts zu begünstigen. Da du vermutlich nicht weißt um was es bei den Trades geht frage ich mich ob das ein Risiko ist. Eventuell könnte es sogar reichen wenn du entsprechende Regeln aufstellst um dich selbst abzusichern?
So genau bin ich auf den Punkt aber nicht eingegangen beim Anwalt. Eine Verurteilung bedeutet auch immer einen Eintrag ins Führungszeugnis. Und das ist dann, glaube ich, nicht mehr so super.

So how do you think will that work? I mean some percent above chip production price is ok but the millions for creating a working design and the chips has to be spent too. You need a mass of people to invest. And the question is how long will the chips be worth something after that.

I only have a hard time imagining how this could work financially. I mean the big guys with the thousands of bitcoins most probably came together to create their own chip. If they hadnt enough they created something like 100TH IPO, gave some breadcrumbs back to their investors and had their own mining chip practically for free at the end.

I'm surprised some people still don't seem to get it.

Ukyo stole all your money.  Move on, it's long gone now. His loan site and your loan shares don't mean anything.  It has just been a red herring to pretend like he actually cares or is doing anything towards getting you your money back (as I've been saying for like 5 months now).  Really you got to wake up and smell the coffee. Move on or do something about it.  It's pretty much already too late.

If you think Ukyo is just going to magically one day pay you back... well its just not likely. What would be the point of stealing your money in the first place if he intended to give back to you. It's incredible, to me, how people buy his bullshit.  You know what would mean something? If he gave your money back. The loan site doesn't mean shit.

As for the IRC chat, sure he is there, but he has said a single fucking thing of any substance in months on it. It's always nebulous uncertainities dolled out each time. Seriously, try to look at the situation objectively. The guy ripped us off for millions and if you think he's going to pay you back at this point, many months later.... I dunno what else to say, you'll believe anything.

So you gave up. Or do you try to sue him? For what if you want to do this?

Anyway... i dont care about the percent of chance. Ukyo is still speaking... and my impression is that he works on things. If you have proof or a hint that he stole the coins then sue him. Without that its only an accusation out of your anger.

Dann wird es mit meinem Multisig Escrow Angebot wohl noch unwahrscheinlicher, dass mir einer ans Bein Pinkeln kann. Hier bekomme ich im Ernstfall nicht mal mehr mit, dass mein Multisig-Schlüssel zur Treuhandabwicklung genutzt wird. Da ich auch nie Zugriff auf das Geld habe, sehe ich die Sache hier sehr entspannt.


Kann sein. Ich würde aber sicherheitshalber das Geschäftskonzept noch mal beschreiben und von einem Anwalt begutachten lassen. Sollte es wirklich mal nennenswerte Einkommen erzielen würde ich auch empfehlen eine offizielle Anfrage bei der BaFin einzureichen. Du musst ja nicht erwähne dass du das schon machst falls die Antwort am Ende negativ ausfällt.

What i would like to know now is what income we made from selling miners, what funds are left from IPO and what part of all that, including mining income, will be given out as divs. Would be important to judge the shareprice. Future profits have to be guessed, until ken doesnt come with infos, too.

I hear you - and I am also not looking for an argument.

If you want to define dividends as Profit made by the company then even if shares came out, you do agree that there has been no profit from this company so far yes? So either way there will be no dividends even from the mining sales as they have definitely not made up all the money that has been spent & lost. (They probably haven't even covered the money lost to Mt. Gox or the money lost to eAsic). So if dividends are the profit of the company then it is effectively zero. At this point I don't even think a financial report is necessary to see that this is the case but (@ Ken) a financial report is still necessary for company clarity.

On the other hand, if you don't want to define dividends as Profit and instead want to define it as mining income, then we have an address where we can see all of the mining income. Which has yet to go untouched. So this is a no issue, Ken could have a plan for this money that doesn't involve shareholders but I do not think that it is the reason we have gone 5 months without having shares - Now it could be a reason as you save for us to lack access to our shares, but I see no evidence to alludes to this.

As you can see, at this point. There really is no way for a shareholder to expect to receive a dividend that includes money made from selling hardware. The company is in a deficit, worst case the company is sitting on less than 350BTC to continue operations and make a turn around. I don't see how one would expect to receive any dividend, let alone a dividend from newly sold hardware. I could be ignorant (and probably am) of a few other failures and/or success from the company that can have that 350BTC be way off (140BTC~ from the Mining address + last I heard 200BTC from the AMC/VMC address + w/e we sold so far), but from the information I've seen this is accurate.

Who knows why Ken hasn't done shares yet. For all intents and purposes it could be that hes just lazy. I can not recall ever arguing as to why we don't have shares ( but yes, I have stated my opinion on the matter ), I've only wanted people to be clear of where our mining income has gone to and made sure that they understand that Ken hasn't been stealing it. It's still there after all these months, it's been in limbo as long as our shares.

It maybe depends how one sees ActM... if there are less than 350BTC and ken tries to make a profit by buying miner for enduserprices then those 350 will be gone too at some point and ActM runs dry. I wonder if im correct that ken simply is denying being beaten and tries everything to push the end further away. If true we sit between getting some satoshis per share or waiting till ken spent the last coins on ventures without chance of success. Maybe i lost hope only but i think we dont have a chance anymore except ken brings out a real jewel of a chip soon. I dont see that coming so it comes down to me to the 2 choices.

Im angry that ken dont come clean and stops everything when there is no chance anymore. Maybe he hopes for the eASIC-Coins though i dont see that happening. I cant believe eASIC made such a big error that they pay the coins back.

And im angry that ken didnt take the chance to let us trade when he brought out the hashfast miners. Everyone believing could have bought, everyone else sell. I doubt the market looks as optimistic anymore now.

Whatever... i guess i should stop bothering about this all and take it as a loss.

Kam bei der Escrow Anfrage etwas raus, was von allgemeinem Interesse sein könnte und was Du hier (als Deine Einschätzung nach dem Gespräch, da Du ja keine Rechtsberatung machen darfst) schreiben kannst?!


Naja... allgemein gesagt... es ist in einer Grauzone aber unterliegt vermutlich nicht der Erlaubnispflicht durch die BaFin solange kein Markt geschaffen wird. Markt wird keiner geschaffen da die Geschäfte ja ohnehin ablaufen würden. Der Escrow hilft nur das Geschäft sicherer zu machen.

Ich würde aber... wenn jemand versucht das richtig aufzuziehen oder feste Gebühren zu verlangen doch eher noch mal nachfragen und das Geschäftskonzept erklären. Auch sollte man darauf achten welche Geschäfte man unterstützt da diese strafbar sein könnten wenn man dabei hilft.

Ich hatte für mich eigentlich erwartet damit aufhören zu müssen. Dass es quasi nur richtig professionell gemacht werden darf. Daher war ich dann schon überrascht. Ist natürlich seine Einschätzung zur Lage. Er hat sich da wohl eingelesen und geschaut ob es verschiedene Gesetzesfelder tangiert. Wenn sich das ändert höre ich natürlich auf. Lohnt ja nicht wenn man sich dafür strafbar machen würde.

Das sollte man natürlich nicht als Rechtsberatung oder irgendwie verbindlich ansehen. Graubereich meint dass es noch keine festen Regeln gibt. Es aber auf dem Wissen was es bisher schon gibt so aussieht. Eventuell macht ja jemand irgendwann eine verbindliche Anfrage bei der BaFin zum Thema... dann wüsste man es sicher.

JoTheKhan... i dont say or think you defend Ken. I only say that the little bit of mining income that is untouched yet doesnt proof Ken isnt needing and using the profits yet. I think the income from miner sales should be way higher than the 139BTC and we dont have an overview about these sales. 139BTC are nothing compared to the 10000000 shares they will be split through... and only 50% of it are paid out. So please take my point that this little profitpart isnt either helping the shareholders nor proof that ken doesnt need our divs. Its like saying "look, theres a city in the us that isnt highly in debt, its prove everything runs fine" while the whole country in fact is bankrupt because all is spent.

There has to be a reason why ken isnt allowing us to trade. The only reason i can think of is that ken would have to pay out divs and in order to do that give out more clear numbers how it stands for ActM. I fear that it doesnt look good. The eASIC-Deal is gone and its open if the coins for that are gone too. We dont hear anything about our own chip project so the question is what happened. Instead we now turned to being a enduserminer... which is a way we never can make profit at the end.

Lets not fight... i dont think that you defend ken. I think there are unexplainable things where the only explaination i can guess is that ken wants to keep us in the dark about company profits and the status of the company funds. I wish he would come clear and speak with us. I wonder if its impossible to go against ken because he prevents us from trading our shares. Its like i gave him something in escrow and he denies to give it out so i can sell it. I wonder what a lawyer would say to that behaviour. I mean he could even show that ken is trading shares anyway... only not those of the main investors.

If you still not want to take the point i want to make and insist that the 139BTC are proof for anything i will stop the discussion here.

Die Themen waren Bitcoins und Steuer in Deutschland bei Frau Hakert und Escrowtätigkeit bei Herrn Weerda. Beide waren gut informiert und haben während es Gesprächs einen guten Eindruck gemacht. Die Email werd ich natürlich nicht anhängen, nur so viel... ich war positiv überrascht von der rechtlichen Einschätzung zu Escrowtätigkeiten in Deutschland... Ich fänds schon gut wenn Winheller in Zukunft verschlüsselte Emails benutzt. Ich meine was nützt das Anwaltsgeheimnis wenn man weiß dass alle Emails eh erstmal abgefangen werden.

Shenka89... na eigentlich war ich ja auch sicher einen Festpreis vereinbahrt zu haben. Ich habe zwei Sachen unterschrieben. Jeweils bei jedem der Anwälte. Einmal eine Vergütungsvereinbahrung in der allgemein Stundensätze aller RA und RAinen, Steuerberater, Consultants usw geregelt waren und einmal jeweils einen expliziten Auftrag zur telefonischen Beratung mit Uhrzeit und Datum. Daher bin ich nicht wirklich auf die Idee gekommen dass da noch irgendwas dazukommt ohne dass ich vorher darauf aufmerksam gemacht werde. Dass es mal eben so gemacht wird bis ich dann davon überrascht werde.
Allerdings muss ich zugeben dass in dem Auftrag nur die Zeit angegeben ist, nicht die Dauer. Ein echtes Festpreisangebot müsste sicherlich noch mehr enthalten und mündliche Vereinbarungen reichen eventuell bei einem Streit nicht aus um rechtssicher zu sein. Ich denke man sollte verlangen dass man einen Auftrag bekommt der auch wirklich den Endpreis enthält wenn man sicher gehen will. So ist es vermutlich teilweise nachlässig darauf zu verzichten, auch wenn ich es schade finde wenn das bei einem klappt und beim anderen nicht. Immerhin war es ja so abgesprochen und im Voraus bezahlt.

Na ich denke das nächste mal werd ich auf Nummer sicher gehen... Wink

dooglus... cant you change just-dice so that its possible to create... lets say 10 new deposit addresses each month or week? That way it cant really be misused but it wouldnt be so easily possible to determine the riches one has. I mean it seems to be relatively easy to find out what a jd-address is. And when you know... through a transaction... that a jd-address belongs to a certain user you can now relatively good observe his jd-investments... or even more when transactions involving that address happen. I think such static addresses arent really good.

And another question... is there somewhere a list with all 1.1billion bets and their results available?

Did you check the legal status for the shows and legal requirements and all? Having it closed because something wasnt checked wouldnt be fun i guess.

I guess another important question is what the total amount of share at the end will be. I mean when one buys now a share he gets 1/250000 of 15% of the total tips. So its important to know how many shares you will sell later. If you would sell another 250000 shares later then the same old share only would get 1/250000 of 7.5% of the total tips. And so on. So i think its important to know what you plan later in order to know how devalued the initial shares could become.
