İsrail Mahkemesi Bitcoin (BTC) ve kripto para işlemlerinden elde edilen herhangi bir kârın vergiye tabi olduğunu belirtti. İsrail Mahkemesi Hakimi Shmuel Bornstein, Bitcoin’in vergi amaçlı bir para birimi olarak kabul edilmesinin biraz zor olduğunu söyledi.

İsrail Mahkemesi: Bitcoin bir para birimi değil, bir varlık!

Lod’un Merkez Bölge Mahkemesi, DAV vakfının CEO’su ve kurucusu olan Noam Copel’in Bitcoin’lerinden elde ettiği kârlarla ilgili taleplerini reddetti. Noam Copel, Bitcoin satışından elde ettiği kazancın, yüzde 25’lik bir orana sahip olan İsrail sermaye kazanımlarına tabi olmadığını savundu. Noam Copel, 2011 ve 2013 yılları arasında Bitcoin  varlıklarından elde ettiği 8,27 milyon kârın vergiye tabi olmadığını savunuyor. Yatırımcı kazandığı varlıkların İsrail kanunları uyarınca yasal olarak vergilendirilebilir bir ticari işlem olmadığını da ekliyor.

Noam Copel’in temyiz başvurusunu reddeden mahkeme, İsrail Vergi Dairesi’nin kripto para birimleri konusundaki tutumunu destekledi. Duruşları, Bitcoin işlemlerinden elde edilen herhangi bir kazancın vergilendirilebilir olması ve Bitcoin’in bir para birimi değil bir varlık olduğu. Hakim Shmuel Bornstein, Bitcoin’in yasal duruşunun her zaman değiştiğine karar verdi. Bu yüzden sonunda onun başka bir kripto para birimiyle değişmesi durumunda vergi amaçlı bir para birimi olarak kabul edilmesinin biraz zorlaşacağına karar verdi.
