He doesn't want to hold the assets hostages and he doesn't plan to do so, but he needs to change the script so that all the people that paid back the double payment get their assets while the once that didn't pay it, don't get their assets.
Hence the only assets that will be held hostage is the once of the people that didn't pay back, the rest will get their assets. That's how I have understood the situation.

1) Writing or changing his scripting does not take days or weeks.
2) Why use a script at all at this point? All payments could have been done by hand in a couple of days.
3) He doesn't know exactly who paid him what, because everyone had to pay to the same address.
4) No progress, no communication, no nothing. He is acting in bad faith, as many people have pointed out.

That's how I have understood the situation.
1 I have no idea, I am not a coder.
2 Indeed, though I am not sure of how many accounts exist or how heavy the work load is but at this point it's starting to get ridiculous and should probably just have been done by hand.
3 I am pretty sure that he could tell as the exact amount returned should be the exact amount sent.
4 Yea Sad He has been really bad at communicating.

Absurd that he holds that info hostage because his script paid out more than it should. One has got nothing to do with the other ! One screw-up should NOT lead to another one !!!

Yes I have James phone number and yes I have given it to asset issuers who wish to get in contact with James under the conditions that they do not spread it or share it with anyone else and that they don't misuse it to threaten or otherwise harass James, I don't want him to have to switch phone numbers because of the mass spam to his phone or the constant threats. Then we will end up with the same thing as the forums that he goes away until things calm down and I would at least like to have a open communication line with him.

How many more coins have been recovered in the mean time?

Not being able to immediately pay the debt back to bondholders doesn't mean you should stop collecting it and holding it in the mean time... I'd suggest you name an address, sign a statement with it's private key and instruct INAU to pay back money there in the mean time until GLBSE (maybe?) releases the needed info.
About 400 coins has been recovered and about 1000 shares has been bought back by trading debt. (The amount bought back is a estimate as I don't have the actual numbers).
That's a good idea right now both IMSAGUY and INAU has instructions to send any recovered BTC to me.

I've run into so much personal problems because of my investment in this fund, and even a simple update seems to much to ask. That he hasnt received asset information from James yet, shouldn't be a reason to stop trying to recover the coins for us. I also noticed that INAU is slowly disappearing from the forums, his posting frequency has decreased so much last couple of months, that I won't be surprised if he just leaves altogether.

I am still in contact with both INAU and IMSAGUY and I talked to them a couple of days ago. The whole GLBSE has slowed down the whole process further but the recovery of the coins are still going forward.

Will SD passthru shares be paying out dividends as normal?
Should I just expect not to get dividends this month? Pretty disappointed with GLBSE overall, hoping to successfully recover my shares in SD  so it's not a total loss .

It's impossible to tell who owns what shares, so unfortunately the dividend is delayed until I can get the information from GLBSE.

Sorry but I will not be taking in any info from people that claim to be share holders as it will be hard to prove that they actually own the shares they say, that they do.

Is there any ETA on when nefario will have an asset claim system? This is turning out to be worst-case scenario.

Idea:  for those that refuse to return the double payment I think Nefario should change the payment address to one he controls and collect the dividends until he is paid back, then change the payment address with the asset issuer to the original address so that the remaining dividends go to the customer who refused to return their ill gotten gains.
Good idea, I will suggest that next time I talk to him.

Well at the moment things is starting to look a bit dire, James has not responded to anyone for several days ( from what I can patch together by the forum posts), which is making me a bit nervous if we are ever going to see the light of the GLBSE documents.

Once we decide to pay out the payouts will indeed be proportional, as for the voting it seems like a majority isn't really following this thread so closely. So I decided to wait until the general opinion was clearer.

I still have never received my package from Foxtra and it has been about a month - he did not have a tracking number for me either which was quite annoying - I would have paid extra to have it sent tracked!
I sent him a PM regarding this but no response either.
I do believe he has sent the coins however they appear to have been lost.
Still waiting on the package from Foxtra, how long did it take others to receive theirs? Patiently waiting for Foxtra to reply to private message with a tracking number.  I will post here once the package arrives.
hm seems unfortunate.
I got mine within a couple of weeks of him sending it, but it was not as long as a month.
Then again I guess it depends where you live, as I am located in Sweden it's pretty close to France.

Actually. I just realized I'm stupid. That was a separate thing that I did end up losing my bitcoins. Sorry about the mix up.

I can see how someone could easily get Gamma Malinvestment Fund and BitconMax mixed up. 

Giving bitcoins to either one resulted in a total loss.   Cheesy

Communication? He has not communicated shit to users or asset holders, except the ones in his scammy inner circle.
And we have to swallow all the shit that is posted here as "official" based on private phonecalls and other unverifiable sources.

Threats? Well, first he stabbed everyone in the back, closing and withholding all your without btc/assets without even a warning - that is worse than any threat.
And at any rate, he's resorting to threats and blackmail too, now the website says he'll only resume processing account closures when all the btc he sprayed around comes flying back.

So, no thanks, keep your details for yourself, there are enough around already.
And if James wants to talk, he's been notified by email.

BTW personally I don't think this is the way to get my assets back.
But there is no other way, so fuck it, let's get James into some hot action at least, he brought it on himself.
I am not saying he's dealing with this well, in fact I have said he has dealt with all of this pretty poorly.
I am not his messenger, I am not going to sit and defend James, but you asked for contact details, so I just added that I could give you the info Smiley

I think this is counter productive, and that trying to sue James will only lead to more delays and maybe no return of assets at all, which is why I am trying to mediate to reach a better solution.
