Arguing on the point of skill is going to be an uphill battle for you guys and it might cost you guys a lot of money in legal fees to convince them that, which may or may not work out in the end. Also, since this is considered a security-based exchange, it may be illegal in other places in the Europe which severely limits the number of countries where this is permitted.

I don't understand how prediction markets are legal in any respect in the United States.
As far as I know, prediction market is no different than buying security-based swaps.
You basically make a transaction with a prediction that something is going to happen just as you make a bet on something and expect to profit from it. SEC made very clear that if you are not eligible contract participant, you are prohibited from offering and selling security-based swaps. I think prediction market falls under the same category and might be regulated as such. Also, online gambling is legal in the US and this is technically gambling.

In the US, fantasy trading might be considered illegal by SEC. https://www.sec.gov/oiea/investor-alerts-bulletins/ia_fantasytrading.html
