Arguing on the point of skill is going to be an uphill battle for you guys and it might cost you guys a lot of money in legal fees to convince them that, which may or may not work out in the end. Also, since this is considered a security-based exchange, it may be illegal in other places in the Europe which severely limits the number of countries where this is permitted.

I don't understand how prediction markets are legal in any respect in the United States. As far as I know, prediction market is no different than buying security-based swaps. You basically make a transaction with a prediction that something is going to happen just as you make a bet on something and expect to profit from it. SEC made very clear that if you are not eligible contract participant, you are prohibited from offering and selling security-based swaps.
