Bitcoin-24... een verhaal vol frustraties. En weinig geld.

Ik hoor van verschillende mensen dat ze nog euro's moeten ontvangen van deze exchange. Zelf ben ik er daar één van. Een aantal pogingen van mij om contact te krijgen met Bitcoin24, Simon of RDP lopen op niets uit. Voor mij is vooral het gebrek aan communicatie wat er voor zorgt dat mijn vertrouwen in deze partijen elke keer een stukje afneemt.

Er zijn mensen met plannen om de krachten te gaan bundelen om samen een juridische procedure te starten. Vanwege kosten die aan een juridische optie zitten, lijkt dit me een goed plan.

Zover ik weet ik de Bitcoinkant opgelost en gaat het nu alleen nog om het innen van een vordering in euro's. Het lijkt me daarom dat bij het opzoeken van een advocaat het niet heel belangrijk is dat hij iets van Bitcoins begrijpt; al is dat wij mij betreft mooi meegenomen.

De route dit ik wil bewandelen is de volgende:
1) Inventariseren wie er mee willen doen met deze actie en inzichtelijk maken in welke orde het bedrag ligt waar het gezamenlijk om gaat
2) Uitzoeken welke advocaat geschikt is om deze kwestie op zich te nemen; ik wil hierbij afspreken dat de zaak no-cure no-pay wordt opgepakt, wat betekent dat er alleen kosten worden betaald wanneer daadwerkelijk de gelden zijn terugbetaald
3) Met deze advocaat verder overleggen wat de vervolgstappen gaan zijn

Wat betreft de kosten: ik wil uitgaan van no-cure no-pay, dus als er geen euro's uitbetaald gaan worden, dat wij hier ook niets extra aan kwijt zijn. Zelf heb ik bedacht dat de situatie nu zo lang duurt en onduidelijk is, dat ik bereid ben om een 10% verlies te nemen als dat in kosten gaat zitten en ik in ieder geval 90% van mijn euro's terug kan krijgen, maar als 't lukt wil ik voor de 100% gaan.

Dus eerst stap 1: wie wil zich bij dit initiatief aansluiten?

Ik heb een introductiepresentatie liggen die ik wel eens geef. Ik heb het met Jouke eens dat die niet geschikt is voor dit publiek, maar als je een ander publiek kent wil ik die presentatie best ergens geven. Artikel 12.7 geeft inderdaad aan dat een originele aan- of verkoopnota als bewijs van de waarde kan dienen. Er staat niets over valuta. Dit zou een vervelend spel kunnen worden, maar ik zou interpreteren dat een factuur in BTC, inclusief historische gegevens over de koers van BTC voldoende moet zijn om de waarde van het pakket in EUR te kunnen aantonen. Ik vermoed dat PostNL dit gewoon aangrijpt om te proberen onder een betaling uit te komen.

Als je overweegt om juridische stappen te zetten, zorg dan dat je een advocaat vindt die het beste met Bitcoin voor heeft of je genoeg geld hebt om een advocaat anderszins zijn uiterste best te laten doen, want een eventuele uitspraak kan ook in de toekomst impact hebben op transacties. Het zou voor Bitcoin helemaal geweldig zijn als er een uitspraak komt dat een factuur in Bitcoin wel voldoende bewijs is

Edit: ik lees nu dat je overigens geen factuur hebt. Het is wellicht interessant om eens navraag te doen wat buiten Bitcoin om de regels zijn voor onderlinge verkoop. Bijv. of een e-mail waarin je de prijs overeenkomt voldoende is. Op deze manier kun je in ieder geval die argumenten van hun kan uitsluiten, zodat 't alleen nog gaat over Euro v.s. Bitcoin.

Zojuist heb ik contact gehad met een journalist van het Brabants Dagblad. Zij wil graag iets over Bitcoin schrijven, maar zoekt mensen uit Brabant die met Bitcoin werken. Zelf woon ik net niet in Brabant, dus bij voorkeur is ze naar iemand anders op zoek.

Brabanders die interesse hebben om met haar in contact te komen kunnen het best even op dit topic een reply sturen of mij een PM sturen. Ze wil vandaag met het item verder, dus ik heb vanmiddag nog een keer contact met haar en dan kijk ik even of er reacties zijn.

Allereerst ben ik het volledig met je eens dat Bitcoin ervoor kan zorgen dat je minder afhankelijk bent van derde partijen. Helaas is het pad dat organisaties zelf Bitcoin accepteren niet eens die al heel succesvol bewandeld wordt. Ik weet dat ik ook niet de enige ben die geprobeerd heeft om instanties Bitcoin te laten accepteren. Mijn ervaring is dat veel organisaties voorzichtig en terughoudend zijn.

Wat ik met deze actie hoop te bereiken is een aantal dingen:
1) Directe publiciteit op de radio; hoewel ik niet verwacht dat de impact hiervan direct heel groot is, zorgt het er wel voor dat veel mensen (weer) een keer de naam Bitcoin horen
2) Een partij als 538 / War Child laten zien dat Bitcoin serieus genomen moet worden voor donaties door, ook als ze zelf er nog niet voor open staan, met een bijdrage te komen; een publieke demonstratie van geld dat binnenkomt kan ook door andere mensen gebruikt worden die proberen bedrijven of goede doelen over te halen Bitcoin te accepteren
3) Het feit dat er Bitcoin-donaties zijn kan positieve publiciteit opleveren voor bijv. tweakers.net, waar Bitcoin nu alleen terechtkomt als er weer een site is gehackt of een fork in de blockchain ontstaat

First, I don't really like to be called "every idiot". But hey, that's how you get called on The Interwebz when you're right, nowadays.

Anyway, what happens legally:
1. The website advertises a product and puts a price on it: USD 1,299
2. You click the "pre-order" button and go to a page to perform a pre-order. You can select quantity, shipment and payment method; at the bottom you see the grant total of USD 1,387 which is an offer for a deal the company is doing
3. Once you agree to this offer, the situation is: (a) BFL has the obligation to ship the product to you and (b) you have the obligation to transfer USD 1,387 to BFL
4. To fulfill your part of the deal, you choose to send a certain amount of BTC that is equals to USD 1,387 at the time of payment; BFL accepts this as payment to fulfill your obligation and the new situation is: (a) BFL now has the obligation to ship the product to you and (b) you have no obligations anymore
4. Now, when BFL fails to ship the product in time, you have the right to annul the voidable contract; doing so changes the situation to one where the product should stay or return to BFL and the USD 1,387 should stay or return to you; since you've already fulfilled your part of the contract, this should be reversed and therefore the new situation is: (a) BFL has the obligation to transfer USD 1,387 to you and (b) you have no obligations to BFL under this contract

BFL must now transfer USD 1,387 to you. Said in another way, they have a debt with a value of USD 1,387. They can offer you an amount of BTC, probably with the current exchange rate, and you accept those as repayment of the debt, the case can be closed. If you deny, BFL probably offers to transfer USD 1,387 to repay the debt. You're not allow to deny this offer, since USD is declared legal tender and can therefore always be used to repay any debt in the US.

When I go to Amazon.com and I order stuff, their prices are in USD. Now, since I live in the EU and Amazon.com is a nice company, they give me the option to pay in EUR instead of USD. However, the deal we made has always been in USD, so when I ask for a refund, the amount I get in EUR most probably is not the same. If I don't want this risk, I should buy forex options.

What's happening with BFL is exactly the same. They price their stuff in USD and because they're a nice company, they allow anyone the option to pay in BTC. However, the deal will always be in USD and therefore refunds in BTC most probably differ in amount.

For people doing international trade, what's going on here is logical. For people that are not used to trading in more than one currency, this may feel like cheating.

I think the idea of proof-of-stake is quite interesting...

I've read the paper on the website, but didn't have time to check the source code, yet. I do have some questions about thing the paper doesn't explain:

• Exactly what is used as input in a coinstake transaction? My best interpretation would be that all outputs in your wallet are included, such that the correct coin-age can be computed. Wouldn't this effectively kill privacy as it links all your outputs together?
• Will proof-of-stake result in the richest people having to say the most? Exactly what decision could they force by using their PPC-wealth?
• Is it possible to keep PPCoins laying around for a long time, just to build up coin-age and use this to force some decision onto the network at a later time?
• What outputs can be used in the coinstake? Must those output be consumed already or must they still be available?

As I said, I didn't have time to check the source code, so some questions may be answered that way. However, I'd like to hear your view on the questions I posed.

In any way, I think you're doing some good work in creating an implementation to start trying new ideas!

While it's good to read that the name "Bitcoin" cannot be used by some party that doesn't contribute to the community.

One question I have: does MtGox provide an official license to any party that does contribute to the community and uses the name "Bitcoin"? Preferably such a license is perpetual and can therefore never be undone by MtGox or another party.

While I understand a centralized solution is the only option in trademark registrations, this situation does pose an unknown future risk for companies that want to offer Bitcoin related services if they have no official license to make use of the name.

What I'm working on looks much like https://en.bitcoin.it/wiki/Contracts#Example_3:_Assurance_contracts and since adding an output to hold the change in the group transaction makes the protocol more complex (and making it two-phase), this is not desired. Adoption of the idea might however be difficult if it requires multiple blocks before the confirmation of tx B is finished.

Because of an invitation to a hackathon, I started thinking to work out an idea I had, so it could be implemented during the hackathon weekend.

Relevant for the idea is a question about the following scenario:

I am going to create two transactions, A and B. In B, I need an input that refers to an output with a specific amount, so in tx A I want to create that output.

1. In tx A, I create two outputs: one that holds the exact amount required for tx B and one that holds the change.
2. In tx B, I refer to the output of tx A

I now broadcast both transactions right after each other into the Bitcoin network. How will existing clients (miners) react to tx B, while it is not yet confirmed? Will both transactions be included in the same block, will tx B be rejected altogether until tx A has been confirmed or will client accept tx B, but hold it until A has been confirmed?
