@SebastianJu was the escrow for two large (80 BTC total) buying groups for miner Titan and Neptune from KnC Miner company, led by user anykeywhy (account later removed and recreated as akwtemp). What we were told as participants to the group buy, was that the miners were never shipped or had been delivered late, when no more profitable. It would appear that user anykeywhy has taken legal action (whether individual or as a class action is unknown) against KnC Miner. As participants in the buying group, we have repeatedly asked for concrete evidence of: - purchase order
- communications with KnC Miner for refund requests or otherwise
- evidence of legal action taken (as stated by user anykeywhy and confirmed by escrow)
It has been 10 years, what we are simply asking for is to have concrete evidence that this was not a scam, but that we were all victims of KnC Miner's fraudulent behavior. But no such proof is available to us. @SebastianJu, I'm asking you, once again, to provide us any evidence or proof or contact details with anykeywhy (as he is long gone from the forum). You all have to know our investigation never stopped. |

I have personally tried multiple time with the escrow @SebastianJu to get some kind of contact with akw without success.
No info, no updates, nothing at all

I tried multiple times to get some info (contact, details of payment, etc) from the escrow, without success.
I asked many times to provide a secure communication channel with akw just to have a chat with him. Same result.
In the end I think all the GB participants are just asking to aknowledge if KNCMiner frauded akw (and ultimately anyone of us) or we were scammed.

- the other account was blocked (one of the forum db hacks caused a lot of issues...)
- apologies for the delayed update
[recap/update]
- nobody ever touched the funds. they were sent to the company.
- company started misbehaving
- we started suing them (ndas, and so on..)
- several jurisdictions and laws apply
- company went bankrupt
- customers have the lowest priority among all the creditors
- remaining assets of the company went sold (including equipment, stock, parts,...)
- they were not labeled, in any way, they went sold in "some sort of" auction
- other creditors had more priority, we appealed, we lost
- actions still continue on more fronts
- among the rest, the judges decided to review one of the closed cases
- they will update about the above in 2018 or hopefully in several months, beyond possibly having updates on other fronts too
- they said that eventually, in case of "success", some sort of refund would apply
- as there will be further substantial or final updates, they will be reported here in the forum somehow

- please identify the correct subject responsible of this whole situation: the company
- we, us, the escrow, have no responsibility at all over their behavior, actions and so on
- the whole thing is publicly known, we are not an exception, search the web please
- someone is still paying for and following all the legal actions and such, as always...
- nobody of you helped, in any way, never
- obviously, whatever success we would eventually achieve will be shared among all here, less the legal expenses

- we are not in the "far west" but in some developed country, laws apply...
- personal direct or indirect harassments, accuses, damage or whatever else not appropriate or polite will not be tolerated anymore
- privacy in europe is something extremely important, as well as for other rights and so on...
- we, me and the escrow have no personal responsibility at all over what happened with the company
- nobody will break the laws, as always, and nobody will damage itself more than already done
- please eventually select the correct subject/s in your communications and content
- all the communications not compliant with the laws will be at least ignored

I can confirm that this user is the new account of the real akw that started the groupbuy back then. I'm in contact with the original user through his email address we wrote through. Is there any news/rumours about what's going to happen now that the deadline for claims has been reached and on a side note (not strictly related) Tokyo court has promulgated a guilty verdict against Karpeles?

my last knowledge is that the lawsuit is still going on and they try to draw it as much as possible. Before it ends there will be no news because of confidential agreements that had to be signed.

Io ho scritto in privato più volte all'escrow SebastianJu, chiedendogli di fornirmi un contatto di anykeywhy (email, telefono, ecc) ma non ho mai ricevuto altra risposta che non fosse "c'è un indagine in corso blah blah...". Queste le sue precise parole, tanto non c'è nulla di segreto: Well so far I only know that everything depends on the bfl case. And he is not allowed to say anything about it. So even when I would give out the details he would or most probably can not legally provide you more information.
I think everything depends on the case ending. Se a qualcuno viene in mente qualcosa che si possa fare, contattatemi. Grazie |

Hi,
yesterday, after quite some time, I did a payment with the offcial client (not updated to the latest version, I was running on 0.13.2)
After many hours I saw I had no transaction confirmations.
I have then executed the bitcoin-qt with the -zapwallettxes option to remove such unconfirmed transaction.
Procedure worked flawlessly.
I then upgraded to the latest release 0.14.1, re-executed the same transaction and again no confirmations.
This morning I have tried to withdraw from the exchange I'm currently using and even for withdrawals I get 0 confirmations.
Any advice on what to do?

Ciao,
oggi, dopo molto tempo dall'ultimo pagamento, ho fatto una transazione in uscita con il client ufficiale che era non aggiornato alla versione 0.13.2.
Dopo molte ore ho visto che non avevo ancora neanche una conferma.
Ho allora di nuovo lanciato bitcoin-qt, questa volta con l'opzione -zapwallettxes per eliminare la transazione non confermata.
La procedura ha funzionato correttamente.
Spento il client.
Aggiornato all'ultima versione 0.14.1, rieseguito la stessa transazione e di nuovo mi trovo senza neanche una conferma.
E' la prima volta che mi capita questa cosa.
Suggerimenti? Da cosa può dipendere?

Oggi è successo anche a me provando a fare un bonifico da una bcc. La cosa che mi ha sorpreso è leggere nella motivazione che la disposizione di pagamento è stata scartata, cito testualmente, " come da indicazioni ABI perchè l'IBAN del beneficiario è segnalato nella black lista da parte di ABI."  Domani proverò da altra Banca. |

Sicuramente non rivedremo più niente, sicuramente NON è una truffa però fino a che qualcuno direttamente interessato non risponde continuerò a rompere i coglioni.

Io propongo di chiedere collettivamente il contatto all'escrow per avere delle informazioni. Magari tramite AlexRossi che se non sbaglio aveva dato la sua disponibilità. Sono d'accordo. |

It means every claimant? I mean only those who were rejected or also the ones being accepted?
And where are we supposed to find a japanese speaker/writer within the next week?

A prescindere da quanto uno ci abbia investito, sarebbe cosa giusta far chiarezza su questa situazione. Io voglio ancora sperare (faccio l'ottimista) che non si tratti di una truffa, certo gli elementi che non fanno pensare bene non sono pochi. Io ogni tanto chiedo news qui https://bitcointalk.org/index.php?topic=522707.320 e l'utente che aveva fatto da escrow per tutti i group buy sembra che sia in contatto con akw, ma non mi pare abbia ricevuto risposte fino ad ora (o quantomeno risposte con informazioni salienti). Capisco i problemi di riservatezza se ci fosse davvero in corso un'azione legale, ma almeno qualche notizia ai diretti interessati potrebbe essere data. Nessuno qui sul forum conosce akw/ha suoi contatti diretti? Ciao |
