Looks like the US guys are actually making progress;

The decision, according to Dore, was a victory for client Gregory Greene, the main plaintiff in the suit. In winning the temporary restraining order, he says, the plaintiffs will now be able to move forward with discovery proceedings.

"We view this as a big victory, this is often something that would take months to do," Dore told us.

"We are going to be able to unpack and examine what Karpeles and his entities have been doing and understand what the assets are," he said.


While Selachii is stuck asking for money from its "clients,"
It's concerning they are asking for bitcoins, IMO, as well.

IMO, the end result is fraud. Karpeles allowed DEPOSITS and TRADING while the exchange was knowingly insolvent. That's unacceptable. It's actually sad that he hasn't had a warrant served already.

hope the victims grouping together for a legal battle atleast show proof that the funds were still under karpales control in March. i totally facepalm the fact that governments beleive that karpales is innocent and deserves protection.

hopefully the guy at the SEC that got pirate arrested can also help, as he seems to know enough about bitcoin to see the evidence for what it is.

Nope. They have not been approved for civil rehabilitation. Also , any evidence of Fraud could get everything siezed and his personal assets could be at stake.

Mark may not have stolen 750000 coins, but I am quite confident that he took advantage of the system to make a profit for himself.

Let's say that continuing to allow deposits while knowingly insolvent, and still continuing deposits and trading while locking withdrawals, is ILLEGAL, and CLASSIC PONZI.

People who lost their coins need to get off their ass and contact authorities. Contact the suing law firms, the DOJ, FBI, Japanese police, or somewhere in their court system.

People think that because bitcoin is not regulated, they won't see anything again.
So if gold coins weren't regulated, it's ok to steal $50,000,000 of gold from someone? "lol it's not regulated"

I have confirmed by email - and opened a support case. I will give support another day before I start to shout.

Is it intentional that confirming by email prompts another full login, then actually doesn't confirm - i have to go back to the confirm email and click it again? quite annoying.

If a Japanese or American court orders MtGox not to enable withdrawals of BTC or fiat until they can prove they can cover all customers' deposits, then that is what MtGox will do. Someone just needs to convince a court to make that order. I would be shocked if a good lawyer couldn't make that case given that the collapse in price on MtGox is universally attributed to fear that they're not solvent.

MtGox may comply with an order from a Japanese court, but based on the Bitcoinica experience they're not going to comply with orders of foreign courts unless they have assets located within the jurisdiction of those courts -which at this stage seems to be Japan and Poland.

People need to remember that they're already embroiled in existing legal actions (both lawsuits and investigations related to money laundering).  Regulators could shut them down at any moment even if they are solvent and other legal actions could drive them out of business long before there's a judgement on any new lawsuit.

It's worrying that Mark is unwilling to make a public statement reassuring people that MtGox has sufficient funds to cover all users balances.  Whenever a company is continuing to allow money to come in but finding more and more ways to delay outgoing payments, the issue of their solvency is going to be front and centre and needs to be addressed urgently.  

MtGox may have no legal obligation to make its accounts public, but an auditor's statement would certainly go along way towards reassuring people that it's financially sound.  The absence of such reassurance is especially baffling given that concerns about a company's solvency can sink it even if it's viable.  It's difficult not to wonder whether MtGox isn't giving that assurance because they're unwilling to make a public statement regarding their solvency which they know to be false (not sure whether this could open them up to further legal consequences in Japan).

People who believe MtGox couldn't possibly be insolvent because of the amount of revenue they've taken in are nuts.  Billion dollar corporations have become insolvent in the past and we know that MtGox has spent large amounts of money on legal proceedings, had funds frozen by financial institutions, and had funds seized.  We have no idea how much it may also have lost to fraud and hacks.  Financial institutions tend not to make such information public because it undermines customer confidence as well as publicising the fact that they are vulnerable, but the amount of losses is not going to be zero.

I agree. If MtGox was solvent, it is highly likely they would make a statement as such. If they were not solvent, it is 99.9% likely they would NOT make a statement as such (any lawyer would recommend that.)

Yeah, but I'm just saying that it's pretty worthless if they store the logs.
And if they don't store the logs... well, that's probably illegal, at least in US and Russia Smiley

The only safe CoinJoin solution I see is p2p based, with some tricky encryption.

But still I think this will never beat services like bitcoinfog, assuming that they indeed remove the logs as they claim.
I mean: you deposit your money and withdraw ~98% of it, while your deposit is still unspent - destroying a log at this moment leaves absolutely no traces and it's actually a perfect "privacy for the real world".
Though it has two big disadvantages, over p2p coin mixing:
1) You need to trust the service to really destroy the logs
2) It doesn't come for free.

So I also find CoinJoin as a nice and possibly useful project, but IMHO centralizing it would just defeat the purpose.

Is that exactly what Darkcoin is doing? Decentralized and encrypted coinjoin.
