In the interview with 20min.ch, Mr. Masserotto says:
Nun aber sind wir seit drei Wochen auf Kurs, produzieren 200 Einheiten die Woche und sind zuversichtlich, die Verspätungen bald einzuholen.»

Translation: since 3 weeks everythings works as expected and  bitmine reached a production of 200 units per week.

Hmm, this means, 600 units should be available? 

If I am not wrong, Retrogamer had queue positions around 60 ?
Of course, there are some units used for compensation, but between 60 and 600 is a huge difference.

For me, this makes no sense

So if you don't trust Bitmine, you can turn to other three companies which buy chips from Bitmine.CH:
The rest are curently just resellers.

Why should we do so? We have contracts with bitmine, and fullfilled our part of the contract.

For what reason ever, bitmine does not deliver and the information we get from this company are useless, sometimes even wrong.

Fact is: Refund period starts soon.
Do you know, if Bitmine will be able to refund all claims ?
This for me is a more important question than the current (technical) problem bitmine currently has.

The support should be available at 10:00 - 12:00 and 14:00 - 16:00.
He tried it at 14:20 and 15:55...nobody there...I have the exact timestamps from our Facebook conversation...

sometimes you must wait 10 oder 15 minutes...

Dear Wolke, waiting 10 or 15 minutes for a bitmine callcenter agent means you are wasting 10 or 15 minutes of your live.
Talking to them is useless. Two weeks ago they told me: “Shipping end of next week”

This week they told me (at least more realistic now): “We don’t know...”
Of course, they can’t know after this what I was reading this week from Zefir:

We remember the famous posts of Mr. Massarotto: “Production started” and “First units leaving our warehouse this week”.
But what happened? After posting this relevant information they realized, they don’t have PCBs available.  They have weeks of delay and they don’t take care for all parts being available?

What will happen next? They are missing the screws or the screwdrivers?
I don’t want to waste more time, I stopped calling them.
E-mail and telephone obviously is not a proper way to communicate with Bitmine AG.

That's for the small talk. Now for the facts.

If I am not mistaking, no products were shipped last week. The plan was like this:
  • German PCB manufacturer sends PCB lot on Wednesday to Italian assembler
  • Italian assembler receives them Thursday and assembles 500 boards till Friday morning
  • Bitmine drives to Italy over night, picks boards up and start product assembly
  • first products ship Friday

Tight, but doable. This is what happened:
  • German PCB manufacturer (who was reliable to the minute before) messed it up and did not ship the PCBs on time
  • Italian assembler cancelled assembly slot



I know, it is useless to post to Mr. Massaratto, but I would like to do so for documentation purpose:
31.January: Mr. Massarotto posted: “PRODUCTION STARTED”
12. February: Mr. Massarotto posted: “FIRST COINCRAFT UNITS LEAVING OUR WAREHOUSE THIS WEEK”
19. February: we get informed by Zefir Kurtisi: “..fact that shipping did not start as expected”
(btw: Thanks Mr. Kurtisi, you are the most reliable person working for this company)

I ask myself now:
How can you start production end of January without PCB? Did you intend to mount the chips on a cardboard?

As much I understand in the moment:

* 0 units are shipped right now?
* To deliver e.g. the January batch it will take another 8 weeks (if you manage to get 10 units produced per day, which seems not to be
   possible in the moment)?
* Based on the 10 units per day you had not 10 lousy PCB’s for a first shipment ?
* The rigs are still not in rtm status, but are still sold with unrealistic delivery dates?
* Do you see a realistic chance to get just ONE unit shipped within the 61 days of your customer protection plan? How will you archive
   this?

What makes me more worry:
I expect you will get latest end of February a lot of refund requests. How long will your company be able to refund ?

Mr. Massarotto I believe this would be the perfect moment (may be the last) to communicate now in a clear and open way.

Thats my personal main reason, why i think it may be a good idea to introduce bitmine to the authorities. Well, my case is opened now. lets see, what it brings to daylight.

What i personally dont understand, why did bitmine the sharevalue increase of 500k to 1000k. but as you say, nothing makes sense anymore. perhaps zefir wants to say anything..

Guys where was you at BFL in 2012 or Avalon in 2013.  Or HF and CT very recently.  You did read the small print?

Currently I prefer reading swiss law

You know you have to pay the 70.- CHF in advance just for the 'betreibungsbegehren' to be valid paperwork and they will just object it within the 10 days. Then it's on you and you have to counter-object the objection. Even though this is the correct way to start things in a case of fraud, I think you don't stand a chance because they are secured by their TOS (AGB).
Technically it's just not a fraud (yet). It will eventually become a fraudolent contract when you request your money back and they wouldnt pay.

So, bless your heart but I just don't think you are going the correct sequence. In my eyes the correct sequence will be

Agreed Shipment + 60 days according to TOS -> Refund request -> 30 days processing time according to TOS -> No Refund received -> Start "Betreibungsbegehren" (costs you 70.- CHF upfront) at Camorino -> Camorino confirms the validity of the BB and informs Bitmine by signed letter -> Bitmine has 10 days to object -> You are informed of the objection and have 7 days to counter-object -> You may go to the police now to start a civil law sue against Bitmine, this is free -> Decision in court (duration up to several years)

I know the procedure very well as I am currently involved in such a case myself where I am the suitor and it's going on since early 2012 ...

Problem is, they do not respond to anything. If they never ship, your process doesnt work. They are in 'Schuldnerverzug' as they didnt ship since 2 months (for my situation). According OR102-109 i can start the 'Betreibung'. If the 'Zahlungsbefehl' arrives at bitmines, we will see how they react. They have two possibilities. Either way: bitmine has to do something. what we dont know right now is: is it a fraud or are they just lazy.
A) zefir has lied (assuming fraud): They will do a 'Rechtsvorschlag' and i dont see my money asap. Next step is to involve a court. (my plan in this case)
B) zefir is correct (full refund, theyre too lazy to answer my mails): they send the money and I will stop the 'Betreibung'.

we will see...

I believe, it makes no sense to make assumptions. Today I contacted my lawyer, within the next 2 days, I should know about my possibilities to start a court case against Bitmine.
The problem I have: I don´t trust Bitmine anymore, and I don’t want to wait for the “worst case”. Just checked their website: they still offer the rigs with shipping date March week 4. To document this, I printed now all their webpages.
From Zefir we know(last week), he is working to finish the firmware for the rigs.  Similar information from a disappointed customer had been posted today.

How can Bitmine sell products (and take money for this items), even if the product do not exist? Is there some information on the website, that this product does not exist ? I can find nice description about the energy consumption, the turbo mode, the front display and other useless information.
But nothing about the fact, that this product does not exist.
Without knowledge of this comments here, a possible customer will send orders and wonders why nothing happens. (the same happened to me)

We remember: Dec. 10th, when Mr. Massaratro posted:
“As of now, the January and later batches should NOT be affected by the delay because our production capability is enough to recover the delays”
This really sounds great for someone who considered end of December to place an order. 

Again: Dec 10th  - still no product available, but Mr. Massarotto knows, that January batches are not affected.

I am afraid that the “Bitmine story” might be something for the Swiss authorities soon.  That’s one reason, why I don’t want to wait any more.

I just prepared the request for the "Betreibungsregisterauszug" which will be filed tomorrow. I'll keep you updated.

Good evening Swissmining.  Hopefully you will share the "Betreibungsregisterauszug" with us. This is the most reasonable thing for now.
Not sure, what we will see, but from my point of view, the wait time is over !!!
