I am writing to you as your name and contact details have been passed to Thames Valley Police who are looking into a number of complaints that have been lodged with the National Fraud Intelligence Bureau in the UK in relation to a company called Black Arrow.
 
I should say at the outset that there are a number of ways this matter could proceed. If it is decided that there appears to be sufficient evidence to warrant a criminal investigation then Thames Valley Police will take the matter forward though ultimately it will fall to the Crown Prosecution Service  to determine whether charges should be laid.  If Thames Valley Police consider there is insufficient evidence to investigate this as a potential criminal offence or the CPS fail to authorize criminal charges then you may wish to deal with any losses you feel you have suffered through the civil courts. Thames Valley Police will advise you in due course of the outcome of the enquiries it is currently undertaking.
 
In order for me to consider the matter further I should be grateful if you would let me have a response to the following:
 
1.       What was your understanding of the terms and conditions of the product you were purchasing from Black Arrow?

2.       Do you have a copy of these terms and conditions? If so, please scan and forward these to me.

3.       In simple terms, how did you intend using the product you purchased from Black Arrow?

no one really is and they are cutting their losses.

this is exactly what BA wanted.

But I am taking different action. I sent some really bad people on a manhunt. Then we will see who is ready to issue refunds.

We do understand that situation may seem grim due to the delays that have happened, however the terms and conditions that you have agreed and signed when you purchased your order, have the necessary factors presented that has capacity and legal purpose. Everything was presented prior to you placing and purchasing your order.

Termination
11.1 We reserve the right to terminate and rescind an approved order, or the entire Sales Agreement, immediately in the event the Purchaser breaches the Sales Agreement and fails to rectify such breach within fifteen (15) calendar days from Our written notification to the Purchaser of the breach. Such notice shall not affect Our right to claim damages or any other economic compensation due to the Purchaser’s breach. Further, We reserve the right to immediately terminate and rescind an approved order, or the entire Sales Agreement, in the event that the Purchaser: (i) no longer conducts any of its business activities, (ii) suspends its payments, (iii) enters into liquidation or initiates reorganization, (iv) initiates negotiations with creditors on composition or (v) for any other reason may reasonably be deemed as insolvent.

11.3 The Purchaser understands and agrees that we will use his payment in order to purchase the necessary materials or pay workmanship required to fulfill his pre-order which will be non-refundable if cancelled. For this reason, the purchaser hereby gives us the right and agrees with our decision to decline any requests from him or third parties to cancel his pre-order.

Where the payment was made, is not the one the puts you and us on legal grounds, it is you agreeing to the terms and conditions BA has presented, prior to you purchasing your order.

The terms and conditions that was presented prior to you purchase, has the mutuality of obligation (consisting of offers and acceptance), we clearly defined the terms and considerations. If the said necessary factors or capacity and legal purpose had been lacking, don't you think we would still be here answering to your tickets? BA has presented and had clearly explained the causes of delay. Official emails, website news and updates, and even through our ticketing system, we have presented the issues, concerns and even accepted open opinions for help. Clearly BA has the right to prove to you that as a company we do exist and trying to resolve the problems that had been.

BA also acknowledges the right of its customers to air in written and in any form their dismay for the delay of their orders and services, however, customers should also be reminded that whatever a customer may say or do can also be taken against them and be pressed as Libel. We can take the verbal and written battery, but we also know where the line is, between us as a company and with our obligations to our customers. There is no proof that BA is a scam as we have proofs of delivery of customer's order and services, and yes, despite the presented circumstances, we gained loyal customers. We have proofs of contracts with our internal and external partners and reports of what and why there is a cause of necessary delays. All was well explained written and even verbal to all of the affected parties, and that includes our customers.

Mining equipment was never done to produce large amounts of Fiat or profit, but as a tool for Bitcoin enthusiasts, the device still serves it's purpose and can miner bitcoins, that is it's original purpose.

Also before purchasing any equipment/service, you must get familiar with product/service you are investing to, as we do not sell out of the shelf products. The purchase is classified as investment into development of new products. As any investment it involves risk.

However, if you experienced issues with our products we still provide RMA. Unfortunately development of miners are complex process and things not always go as planned, which we apologize for from our side. However we do not refuse to deliver product, or repair it as per agreement during purchase.

Unfortunately the Bitcoin mining market demand is very low and we have no hope of selling your machine to someone else. We see no other choice but to decline your refund as per clause 11.3 of our terms and conditions and honor your order as placed. We are sorry for any inconvenience this might have caused you.

As per Management, we cannot afford to send refunds as we've spent all money to purchase parts required to build the miners. If we cancel your order we have nothing to do with the cases, power supplies and other goods that have been manufactured just for your order.

We can only offer 50% compensation for the original hashing power purchased in hardware as previously offered and stated on our website; without going into bankruptcy and rendering our customers unable to receive products or compensation. Unfortunately we are unable to provide FIAT refunds.

Also, we can offer to ship you ASIC CHIPS instead and we can dispatch them immediately.
We exchange base on your order, 120 ASICs per 1 Prospero X3 or 7 ASICs per 1 Prospero X1.
We exchange 1 ASIC chip for each $45 you paid for the Cloud Hashing service.
Note that should you choose this option you are forfeiting the compensation previously announced.

Understanding your dismay due to the various causes of delay, but your refusal to receive your order will either lead to the destruction of your goods, or we might accept it as gift to us and send it to other customer. Who is Daniel Andronic and what's his position within Black Arrrow? As far as I know Alex Sovu is the crook who runs/owns the compay.

Daniel is a Director at blackarrow, he is another douchebag.

I sent a message to Alex last night and on facebook as well... if you guys want to see this alex guy, this is his facebook name : alexey.andreev.7 which is funny because daniel's facebook is daniel.andronic.77 weird similarities with the .7 and .77 ...lol... anyways I told him i was going to make his life miserable and i filed complaints with Germany, UK, Interpol and HK. and he replied this to me last night....

the standard Chinese legal position is that there is no "class action suit" as there is in US or UK, however there are provisions for multiple claimants on the same "bill"

Those who've sent me details up to 15th September i have included into my request to BA.

however, i have recently found out and had confirmed from the lawyers that their liability for the company ( not to be confused with legal liability insurance ) has a declared limit of 10k

Now, the main HK signatory is 'ole Alex himself

The main signatory in the UK is 'ole Alex himself and a lady called Cristina... strangely she appears twice on the company house records with firstname then middlename and then surname and then as company secratary as a different named individual using middlename and surname.... so he's been a bit naughty in registering the company.

I had a little chat with Alexey A. from "Sales"
 
I told him that I had gotten German, UK, Hong Kong  and Interpol Authorities aware of their scam and that I would spend time and money making their lives miserable... This is the reply I got...

They stole $12,000 from me and are ignoring me, I reported them to the police and government for fraud and theft. They obviously don't sell anything and take peoples money and keep them hanging on with promise of hardware. The Police have been communicating back and forth with me to collect extra evidence on the suspects.
 
I suggest everyone makes a police report ASAP. (Who ever got scammed of course)

Blackarrow is a fucking scam, they stole $12,000 from me and i fucking reported them to all the authorities possible. Everyone that made orders got fucking scammed! No one is getting refunds and they are ignoring every request!

Stay the fuck away from this company they are fake and only take your money and stall you until you give up!

Update: 17th of June 2014

1. Batch 1 hasn't shipped.

Reports of a few insiders receiving raspberry pi based X1 miners have surfaced.

2. Batch 2 hasn't shipped.

3. Stated shipping date: June 23rd.

4. Refunds refused.

Customers requesting refunds are being placed in a "refund queue".

5. The distance in time between the customer and his money continues to grow.

They are hosted in Germany this means Interpol can be involved. Their corp is in HK so it means they are hiding behind nominees... but there is 1 thing i know about nominees... At the first sign of trouble... They resign and run away.

So I officially believe that BlackArrow has pretty much stolen my money!!!

They keep ignoring me and when they do make contact it's a whole bunch of stall tactics.

Before any moderators boot me for talking shit on a company, I would like to let you know if have documented everything and if needed I will post it up here to backup my story.


I strongly believe that They don't even ship anything out.... Their business model is to make believe that they will ship you a product but in the end, all they do is TAKE your MONEY and STALL you until you can't ask for a REFUND.

They then keep hope alive by telling you that they will refund you but need to find a "Buyer" for the hardware you already purchased but that they "CAN'T" deliver yet... seems like all this makes no sense...

I sent them USD $12k on the 21st of Feb of this year (2014) and they told me, "Shipments will go out on the 30 of April".... As you can clearly guess.... This day never came and the replies got more and more "generic" and the response time because ridiculous.... 1-2 week response...

I then started smashing them on their own bitcoin discussion forum to get their attentions... Guess what? They responded withing an hour and threatened me. They said if I said anything else about that... They will put me at the bottom of the refund list!! (hanging $12k over my head)

Their actual response was:

"We find your behaviour unnaceptable and we would like to ask you to review it. If you will abuse or threaten us again, your refund will automatically go to the end of the refund queue or we will hold you to the agreed terms and conditions and ship you the order, as we see fit."

Now I don't know if I am able to show any of my communications with them cause they end each reply with:

They killed the post very quickly and gave me warnings.

All I would like to say is I think they are a big scam and I am pretty sure that I have lost my money... No Hardware and stall tactics to get a refund that I fear will never come. Maybe They will transfer all the money in another corp and then will be impossible to make any claims... I also find it weird that some Russian called ALEXEY is handling the CS for this Hong Kong Company that is supposedly also run in HK... I say supposedly because I am 100% sure their HK corp is just a front with Nominees to take the fall should anything go down...

Has anyone ever received anything from BlackArrow? What do you all think is happening here...

You will be hard pressed to find anyone (with any sense) selling altcoins for a Paypal or credit card payment..

Get some BTC first...

but if i setup an escrow deal I make the payment before I receive anything. Once I receive the coins they release the funds to a direct form of payment.

If someone really want's BTC, i can make a BTC -> MRY trasaction.

I am not opposed to it at all.

I bought 2 Black Arrow Prospero X-3 (2000Ghash/second) Miners about 3 months ago on pre-order.

I am beginning to think this was a mistake because I don't trust Black Arrow will deliver any hardware and has taken my money...

Too many red flags come up with this company... For 1, they always answer vaguely their messages, they said shipments go out on April 30 and now they are telling me to "give them some time".. No one really has anything concrete to say about them and I really think I lost $12,000.
They don't have any call center, you can never actually speak to anyone, I spoke to my contact in China and she said this is only a "corporate address.. They don't have a manufacturer there" She actually went to look. So yeah... I am a little worried.

Does anyone have anything good to say about Black Arrow?

Did you not read my over 300 deleted posts prior to ordering, or were they deleted by the time you read the main self-moderated thread on this forum? Fortunately, some were quoted, thus preserved. In brief, Black Arrow is run by a known Romanian scam artist, of which I offered up tons of proof.

BTW, if in the future you get your hands on bitcoins and want to trade on a safe exchange, I suggest using Mount Coxs - formally Mt Gox - operated by a pedophile. Your second option is Bitcoin-Central, own my Paymium, if you're in Europe, for they're kind enough to steal my 1,132 BTC under the guise of the InstaWallet "hack" and won't return them, but davout, staff on this forum and owner of Bitcoin-Central, is keeping them warm in one of his personal bitcoin wallets.

For your next bitcoin miner purchase, may I suggest KnC: for every miner ordered and delivered late, they built two for themselves to mine with in a helicopter hangar in northern Sweden (The Node Pole). This is done so to protect their customer's best interest, i.e. keep the difficulty in check.

But, there's no need to worry about any conflicts of interests because the same investor backing KnC will also be running Mount Coxs, coupled with trying to get one of the open seats on The Bitcoin Foundation.

The above would be so fuckin' funny if in fact it weren't true.

Unfortunately I did not see your previous posts... So you are saying I am screwed and BlackArrow is just a scam?..
