The Transportation Security Administration is expanding its screening of passengers before they arrive at the airport by searching a wide array of government and private databases that can include records like car registrations and employment information.

 While the agency says that the goal is to streamline the security procedures for millions of passengers who pose no risk, the new measures give the government greater authority to use travelers’ data for domestic airport screenings. Previously that level of scrutiny applied only to individuals entering the United States.

The prescreening, some of which is already taking place, is described in documents the T.S.A. released to comply with government regulations about the collection and use of individuals’ data, but the details of the program have not been publicly announced.

It is unclear precisely what information the agency is relying upon to make these risk assessments, given the extensive range of records it can access, including tax identification number, past travel itineraries, property records, physical characteristics, and law enforcement or intelligence information.

The measures go beyond the background check the government has conducted for years, called Secure Flight, in which a passenger’s name, gender and date of birth are compared with terrorist watch lists. Now, the search includes using a traveler’s passport number, which is already used to screen people at the border, and other identifiers to access a system of databases maintained by the Department of Homeland Security.

Privacy groups contacted by The New York Times expressed concern over the security agency’s widening reach.

CryptoSeal Privacy Consumer VPN service terminated with immediate effect


With immediate effect as of this notice, CryptoSeal Privacy, our consumer VPN service, is terminated.  All cryptographic keys used in the operation of the service have been zerofilled, and while no logs were produced (by design) during operation of the service, all records created incidental to the operation of the service have been deleted to the best of our ability.

Essentially, the service was created and operated under a certain understanding of current US law, and that understanding may not currently be valid.  As we are a US company and comply fully with US law, but wish to protect the privacy of our users, it is impossible for us to continue offering the CryptoSeal Privacy consumer VPN product.

Specifically, the Lavabit case, with filings released by Kevin Poulsen of Wired.com (https://www.documentcloud.org/documents/801182-redacted-pleadings-exhibits-1-23.html) reveals a Government theory that if a pen register order is made on a provider, and the provider's systems do not readily facilitate full monitoring of pen register information and delivery to the Government in realtime, the Government can compel production of cryptographic keys via a warrant to support a government-provided pen trap device.  Our system does not support recording any of the information commonly requested in a pen register order, and it would be technically infeasible for us to add this in a prompt manner.  The consequence, being forced to turn over cryptographic keys to our entire system on the strength of a pen register order, is unreasonable in our opinion, and likely unconstitutional, but until this matter is settled, we are unable to proceed with our service.

Two years ago this month, in a disused Norfolk airfield, a small group of scientists were preparing to undertake one of the more controversial experiments in British scientific history. What little equipment it needed – a B&Q pressure washer, 1km of hydraulic hose and an 8m air balloon – had been bought or loaned. A truck was ready. Once in the air, the dirigible balloon would spray 120 litres of fine water droplets into the East Anglia sky, a miniaturised test for a much larger system that would eventually pump out chemical particles to reflect sunlight and, so the scientists calculated, cool the planet. Geoengineering – as defined by the Royal Society in 2009 – is the large-scale, technological manipulation of the climate (some call it "planet hacking").     I’ve got to confess, though, I found this result surprising. As I pushed the button to run the analysis on my computer, I fully expected I’d be shown a modest negative correlation between identifying with the Tea Party and science comprehension.

    But then again, I don’t know a single person who identifies with the Tea Party.  All my impressions come from watching cable tv — & I don’t watch Fox News very often — and reading the “paper” (New York Times daily, plus a variety of politics-focused internet sites like Huffington Post & Politico). 

    I’m a little embarrassed, but mainly I’m just glad that I no longer hold this particular mistaken view.

The National Security Agency is harvesting hundreds of millions of contact lists from personal e-mail and instant messaging accounts around the world, many of them belonging to Americans, according to senior intelligence officials and top secret documents provided by former NSA contractor Edward Snowden.

The collection program, which has not been disclosed before, intercepts e-mail address books and “buddy lists” from instant messaging services as they move across global data links. Online services often transmit those contacts when a user logs on, composes a message, or synchronizes a computer or mobile device with information stored on remote servers.

Rather than targeting individual users, the NSA is gathering contact lists in large numbers that amount to a sizable fraction of the world’s e-mail and instant messaging accounts. Analysis of that data enables the agency to search for hidden connections and map relationships within a much smaller universe of foreign intelligence targets.

During a single day last year, the NSA’s Special Source Operations branch collected 444,743 e-mail address books from Yahoo, 105,068 from Hotmail, 82,857 from Facebook, 33,697 from Gmail and 22,881 from unspecified other providers, according to an internal NSA PowerPoint presentation. Those figures, described as a typical daily intake in the document, correspond to a rate of more than 250 million per year.

Each day, the presentation said, the NSA collects contacts from an estimated 500,000 buddy lists on live-chat services as well as from the “in-box” displays of Web-based e-mail accounts.

The collection depends on secret arrangements with foreign telecommunications companies or allied intelligence services in control of facilities that direct traffic along the Internet’s main data routes.

Although the collection takes place overseas, two senior U.S. intelligence officials acknowledged that it sweeps in the contacts of many Americans. They declined to offer an estimate but did not dispute that the number is likely to be in the millions or tens of millions.

A spokesman for the Office of the Director of National Intelligence, which oversees the NSA, said the agency “is focused on discovering and developing intelligence about valid foreign intelligence targets like terrorists, human traffickers and drug smugglers. We are not interested in personal information about ordinary Americans.”

The spokesman, Shawn Turner, added that rules approved by the attorney general require the NSA to “minimize the acquisition, use, and dissemination” of information that identifies a U.S. citizen or permanent resident.

The NSA’s collection of nearly all U.S. call records, under a separate program, has generated significant controversy since it was revealed in June. The NSA’s director, Gen. Keith B. Alexander, has defended “bulk” collection as an essential counterterrorism and foreign intelligence tool, saying “you need the haystack to find the needle.”

Contact lists stored online provide the NSA with far richer sources of data than call records alone. Address books commonly include not only names and e-mail addresses but also telephone numbers, street addresses, and business and family information. In-box listings of e-mail accounts stored in the “cloud” sometimes contain content such as the first few lines of a message.

Taken together, the data would enable the NSA, if permitted, to draw detailed maps of a person’s life, as told by personal, professional, political and religious connections. The picture can also be misleading, creating false “associations” with ex-spouses or people with whom an account holder has had no contact in many years.

The NSA has not been authorized by Congress or the special intelligence court that oversees foreign surveillance to collect contact lists in bulk, and senior intelligence officials said it would be illegal to do so from facilities in the United States. The agency avoids the restrictions in the Foreign Intelligence Surveillance Act by intercepting contact lists from access points “all over the world,” one official said, speaking on the condition of anonymity to discuss a classified program. “None of those are on U.S. territory.”

Because of the method employed, the agency is not legally required or technically able to restrict its intake to contact lists belonging to specified foreign intelligence targets, he said.

When information passes through “the overseas collection apparatus,” the official added, “the assumption is you’re not a U.S. person.”

In practice, data from Americans is collected in large volumes — in part because they live and work overseas, but also because data crosses international boundaries even when its American owners stay at home. Large technology companies, including Google and Facebook, maintain data centers around the world to balance loads on their servers and work around outages.

A senior U.S. intelligence official said that the privacy of Americans is protected, despite mass collection, because “we have checks and balances built into our tools.”

NSA analysts, he said, may not search or distribute information from the contacts database unless they can “make the case that something in there is a valid foreign intelligence target in and of itself.”

In this program, the NSA is obliged to make that case only to itself or others in the executive branch. With few exceptions, intelligence operations overseas fall solely within the president’s legal purview. The Foreign Intelligence Surveillance Act, enacted in 1978, imposes restrictions only on electronic surveillance that targets Americans or takes place on U.S. territory.

By contrast, the NSA draws on authority in the Patriot Act for its bulk collection of domestic phone records, and it gathers online records from U.S. Internet companies, in a program known as PRISM, under powers granted by Congress in the FISA Amendments Act. Those operations are overseen by the Foreign Intelligence Surveillance Court.

Sen. Dianne Feinstein (D-Calif.), chairman of the Senate Intelligence Committee, said in August that the committee has less information about, and conducts less oversight of, intelligence-gathering that relies solely on presidential authority. She said she planned to ask for more briefings on those programs.

“In general, the committee is far less aware of operations conducted under 12333,” said a senior committee staff member, referring to Executive Order 12333, which defines the basic powers and responsibilities of the intelligence agencies. “I believe the NSA would answer questions if we asked them, and if we knew to ask them, but it would not routinely report these things, and in general they would not fall within the focus of the committee.”

Because the agency captures contact lists “on the fly” as they cross major Internet switches, rather than “at rest” on computer servers, the NSA has no need to notify the U.S. companies that host the information or to ask for help from them.

“We have neither knowledge nor participation in any mass collection of webmail addresses or chat lists by the government,” said Google spokesman Niki Fenwick.

At Microsoft, spokesman Nicole Miller said the company “does not provide any government with direct or unfettered access to our customers’ data,” adding that “we would have significant concerns if these allegations about government actions are true.”

Facebook spokesman Jodi Seth said “we did not know and did not assist” in the NSA’s interception of contact lists.

It is unclear why the NSA collects more than twice as many address books from Yahoo than the other big services combined. One possibility is that Yahoo, unlike other service providers, has left connections to its users unencrypted by default.

Suzanne Philion, a Yahoo spokesman, said Monday in response to an inquiry from The Washington Post that, beginning in January, Yahoo would begin encrypting all its e-mail connections.

Google was the first to secure all its e-mail connections, turning on “SSL encryption” globally in 2010. People with inside knowledge said the move was intended in part to thwart large-scale collection of its users’ information by the NSA and other intelligence agencies.

The volume of NSA contacts collection is so high that it has occasionally threatened to overwhelm storage repositories, forcing the agency to halt its intake with “emergency detasking” orders. Three NSA documents describe short-term efforts to build an “across-the-board technology throttle for truly heinous data” and longer-term efforts to filter out information that the NSA does not need.

Spam has proven to be a significant problem for NSA — clogging databases with data that holds no foreign intelligence value. The majority of all e-mails, one NSA document says, “are SPAM from ‘fake’ addresses and never ‘delivered’ to targets.”

In fall 2011, according to an NSA presentation, the Yahoo account of an Iranian target was “hacked by an unknown actor,” who used it to send spam. The Iranian had “a number of Yahoo groups in his/her contact list, some with many hundreds or thousands of members.”

The cascading effects of repeated spam messages, compounded by the automatic addition of the Iranian’s contacts to other people’s address books, led to a massive spike in the volume of traffic collected by the Australian intelligence service on the NSA’s behalf.

After nine days of data-bombing, the Iranian’s contact book and contact books for several people within it were “emergency detasked.”

In a briefing from the NSA’s Large Access Exploitation working group, that example was used to illustrate the need to narrow the criteria for interception of data. It called for a “shifting collection philosophy”: “Memorialize what you need” vs. “Order one of everything off the menu and eat what you want.”

The National Security Agency has gotten the green light to continue its controversial collection of U.S. phone call records.

The Foreign Intelligence Surveillance Court authorized the program for limited time periods — with a requirement that the government submit new requests every several weeks, The Hill reported Friday.

The Office of the Director of National Intelligence announced the court’s approval in a statement late Friday.

The phone record snooping — first revealed in leaks by Edward Snowden — generated criticism from privacy advocates and some lawmakers, who are concerned the collection affects millions of Americans who aren’t suspected of any wrongdoing.

Mark Rumold, an attorney for the Electronic Frontier Foundation, a digital privacy watchdog group, told The Baltimore Sun in June NSA’s program “targets more people than has ever been issued before, that we have known about publicly, in the history of the United States.”

“There has been a significant amount of debate about the subpoenaing of AP reporters’ phone records,” Rumold said. “This is that on steroids. It’s everyone.”

The NSA collects records from phone companies — like phone numbers, call times and call durations — of all U.S. calls and then compiles them in a database, though the administration insists it doesn’t include any conversations, The Hill reported.

NSA analysts are only allowed to search the database if there is a “reasonable, articulable suspicion,” that a phone number is connected to terrorism, The Hill reported.

Armed private security guards are on the job to keep the public away from Philadelphia’s Independence Hall, and one even threatened to arrest a political activist if he stepped on the sidewalk beside the iconic building where the Declaration of Independence and Constitution were debated and adopted.

“You will be arrested,” said one of the hired guards to activist Craig Bergman as a video team filmed his stop at the downtown historical center.

In the video, Bergman asks a National Park Service ranger who was paying for the rented cops, and was told, “You are.” The badge on the private guards read “SecTec,” a Virginia-based security company that operates around the nation. A source said that SecTec often is used for the Hall's security. Their webpage includes Independence Hall as a client.

WASHINGTON (AP) -- The U.S. government's aggressive prosecution of leaks and efforts to control information are having a chilling effect on journalists and government whistle-blowers, according to a report released Thursday on U.S. press freedoms under the Obama administration.

The Committee to Protect Journalists conducted its first examination of U.S. press freedoms amid the Obama administration's unprecedented number of prosecutions of government sources and seizures of journalists' records. Usually the group focuses on advocating for press freedoms abroad.

Leonard Downie Jr., a former executive editor of The Washington Post, wrote the 30-page analysis entitled "The Obama Administration and the Press." The report notes President Barack Obama came into office pledging an open, transparent government after criticizing the Bush administration's secrecy, "but he has fallen short of his promise."

"In the Obama administration's Washington, government officials are increasingly afraid to talk to the press," wrote Downie, now a journalism professor at Arizona State University. "The administration's war on leaks and other efforts to control information are the most aggressive I've seen since the Nixon administration, when I was one of the editors involved in The Washington Post's investigation of Watergate."

Downie interviewed numerous reporters and editors, including a top editor at The Associated Press, following revelations this year that the government secretly seized records for telephone lines and switchboards used by more than 100 AP journalists. Those suspected of discussing classified information are increasingly subject to investigation, lie-detector tests, scrutiny of telephone and email records and now surveillance by co-workers under a new "Insider Threat Program" that has been implemented in every agency.

"There's no question that sources are looking over their shoulders," Michael Oreskes, the AP's senior managing editor, told Downie. "Sources are more jittery and more standoffish, not just in national security reporting. A lot of skittishness is at the more routine level. The Obama administration has been extremely controlling and extremely resistant to journalistic intervention."

To bypass journalists, the White House developed its own network of websites, social media and even created an online newscast to dispense favorable information and images. In some cases, the White House produces videos of the president's meetings with major figures that were never listed on his public schedule. Instead, they were kept secret - a departure from past administrations, the report noted.

Frank Sesno, a former CNN Washington bureau chief who is now director of George Washington University's School of Media and Public Affairs, told Downie the combined efforts of the Obama administration are "squeezing the flow of information."

"Open dialogue with the public without filters is good, but if used for propaganda and to avoid contact with journalists, it's a slippery slope," Sesno said.

In the report, White House officials objected to findings that the administration has limited transparency or information. Press Secretary Jay Carney said such complaints are part of the "natural tension" between the White House and the press.

"The idea that people are shutting up and not leaking to reporters is belied by the facts," Carney told Downie.

National Security Adviser Ben Rhodes said there is still investigative reporting about national security issues with information from "nonsanctioned sources with lots of unclassified information and some sensitive information."

Downie found the Sept. 11 terrorist attacks were a "watershed moment," leading to increased secrecy, surveillance and control of information. There is little direct comparison between the Bush and Obama administrations, though some journalists told Downie the Obama administration exercises more control.

"Every administration learns from the previous administration," said CBS Chief Washington Correspondent Bob Schieffer. "They become more secretive and put tighter clamps on information."

Shortly after Obama entered office, the White House was under pressure from intelligence agencies and Congress to stop leaks of national security information. The administration's first prosecution for leaking information came in April 2009 after a Hebrew linguist working for the FBI gave a blogger classified information about Israel.

Other prosecutions followed, targeting some government employees who believed they were whistle-blowers. The administration has rejected whistle-blower claims if they do not involve "waste, fraud or abuse," according to report. So sources exposing questionable or illegal practices are considered leaks.

To date, six government employees and two contractors have been targeted for prosecution under the 1917 Espionage Act for accusations that they leaked classified information to the press. There were just three such prosecutions under all previous U.S. presidents.

Maryland's Health Connection, the state's Obamacare marketplace, has been plagued by delays in the first days of open enrollment.  If users are able to endure long page-loading delays, they are presented with the website's privacy policy, a ubiquitous fine-print feature on websites that often go unread. Nevertheless, users are asked to check off a box that they agree to the terms.

The policy contains many standard statements about information automatically collected regarding Internet browsers and IP addresses, temporary "cookies" used by the site, and website accessibility.  However, at least two conditions may give some users pause before proceeding.

The first is regarding personal information submitted with an application for those users who follow through on the sign up process all the way to the end.  The policy states that all information to help in applying for coverage and even for making a payment will be kept strictly confidential and only be used to carry out the function of the marketplace.  There is, however, an exception: "[W]e may share information provided in your application with the appropriate authorities for law enforcement and audit activities."  Here is the entire paragraph from the policy the includes the exception [emphasis added]:

Should you decide to apply for health coverage through Maryland Health Connection, the information you supply in your application will be used to determine whether you are eligible for health and dental coverage offered through Maryland Health Connection and for insurance affordability programs. It also may be used to assist you in making a payment for the insurance plan you select, and for related automated reminders or other activities permitted by law.  We will preserve the privacy of personal records and protect confidential or privileged information in full accordance with federal and State law. We will not sell your information to others.  Any information that you provide to us in your application will be used only to carry out the functions of Maryland Health Connection. The only exception to this policy is that we may share information provided in your application with the appropriate authorities for law enforcement and audit activities.

The site does not specify if "appropriate authorities" refers only to state authorities or if it could include the federal government, as well.  Neither is there any detail on what type of law enforcement and/or audit activities would justify the release of the personal information, or who exactly is authorized to make such a determination.  An email to the Maryland Health Connection's media contact seeking clarification has not yet been answered

The second privacy term that may prompt caution by users relates to email communications.  The policy reads:

If you send us an e-mail, we use the information you send us to respond to your inquiry. E-mail correspondence may become a public record. As a public record, your correspondence could be disclosed to other parties upon their request in accordance with Maryland’s Public Information Act.

Since emails to the marketplace could conceivably involve private matters regarding finances, health history, and other sensitive issues, the fact that such information could be made part of the "public record" could prevent users from being as free with their information than they might otherwise be.  However, as noted, any requests for such emails would still be subject to Maryland's Public Information Act which contains certain exceptions to the disclosure rules.

Why don’t people behave in more environmentally friendly ways? New research presents one uncomfortable answer: They don’t want to be associated with environmentalists.

That’s the conclusion of troubling new research from Canada, which similarly finds support for feminist goals is hampered by a dislike of feminists.

Participants held strongly negative stereotypes about such activists, and those feelings reduced their willingness “to adopt the behaviors that these activities promoted,” reports a research team led by University of Toronto psychologist Nadia Bashir. This surprisingly cruel caricaturing, the researchers conclude, plays “a key role in creating resistance to social change.”

Writing in the European Journal of Social Psychology, Bashir and her colleagues describe a series of studies documenting this dynamic. They began with three pilot studies, which found people hold stereotyped views of environmentalists and feminists.

In one, the participants—228 Americans recruited via Amazon’s Mechanical Turk—described both varieties of activists in “overwhelmingly negative” terms. The most frequently mentioned traits describing “typical feminists” included “man-hating” and “unhygienic;” for “typical environmentalists,” they included “tree-hugger” and “hippie.”

Another study, featuring 17 male and 45 female undergraduates, confirmed the pervasiveness of those stereotypes.

A subsidiary of Visa, a key Obama campaign donor, that specializes in credit card transactions has abruptly stopped servicing the nation’s largest gun store after four years because the store sells guns, a fact the owners never hid.

Hyatt Gun Shop of Charlotte, N.C., told Secrets that the subsidiary, Authorize.net/CyberSource, simply sent an email to owner Larry Hyatt to announce that it was suddenly breaking off the business relationship. The reason: “The sale of firearms or any similar product.”

The company email said that gun sales violated a section of the service agreement the two signed over four years ago and after Hyatt went into detail about its sales and products -- and name.

“We’ve never seen anything like this,” said Justin Anderson, Hyatt’s marketing director. He said it took a week and thousands of dollars to line up a “gun friendly” credit card processor for online sales.

The number of Americans giving up their citizenship has rocketed this year - partly, it's thought, because of a new tax law that is frustrating many expats.

Goodbye, US passport.

That's not a concept that Americans contemplate lightly. But it's one that many of them seem to be considering - and acting on.

The number of expatriates renouncing their US citizenship surged in the second quarter of 2013, compared with the same period the year before - 1,131 cases to 189 in 2012. It's still a small proportion of the estimated six million Americans abroad, but it's a significant rise.

The list is compiled by the Federal Register and while no reasons are given, the big looming factor seems to be tax.

A new law called the Foreign Accounts Tax Compliance Act (Fatca) will, from 1 July next year, require all financial institutions around the world to report directly to the US Internal Revenue Service (IRS) all the assets and incomes of any US citizens with $50,000 (£31,000) on their books. The US could withhold 30% of dividends and interest payments due to the banks that don't comply.

Listen up children: Cheating on your homework or cribbing notes from another student is bad, but not as bad as sharing a music track with a friend, or otherwise depriving the content-industry of its well-earned profits.

That’s one of the messages in a new-school curriculum being developed with the Motion Picture Association of America, the Recording Industry Association of America and the nation’s top ISPs, in a pilot project to be tested in California elementary schools later this year.

A near-final draft of the curriculum, obtained by WIRED, shows that it comes in different flavors for every grade from kindergarten through sixth, to keep pace with your developing child’s ability to understand that copying is theft, period.

“This thinly disguised corporate propaganda is inaccurate and inappropriate,” says Mitch Stoltz, an intellectual property attorney with the Electronic Frontier Foundation, who reviewed the material at WIRED’s request.

“It suggests, falsely, that ideas are property and that building on others’ ideas always requires permission,” Stoltz says. “The overriding message of this curriculum is that students’ time should be consumed not in creating but in worrying about their impact on corporate profits.”

The material was prepared by the California School Library Association and the Internet Keep Safe Coalition in conjunction with the Center For Copyright Infringement, whose board members include executives from the MPAA, RIAA, Verizon, Comcast and AT&T.

Each grade’s material includes a short video, and comes with a worksheet for teachers to use that’s packed with talking points to share with students.

In the sixth-grade version, (.pdf) teachers are asked to engage students with the question: “In school, if we copy a friend’s answers on a test or homework assignment, what happens?”

The answer is, you can be suspended from school or flunk the test. The teachers are directed to tell their students that there are worse consequences if they commit a copyright violation.

“In the digital world, it’s harder to see the effects of copying, even though the effects can be more serious,” the teacher worksheet says.

The material is silent on the concept of fair use, a legal doctrine that allows for the reproduction of copyrighted works without the rights holder’s permission. Instead, students are told that using works without permission is “stealing.”

“Justin Bieber got started singing other people’s songs, without permission, on YouTube. If he had been subjected to this curriculum, he would have been told that what he did was ‘bad, ‘stealing,’ and could have landed him in jail,” says Stoltz.

“We’ve got some editing to do,” concedes Glen Warren, vice president of the California School Library Association, the non-profit that helped produce the material with the Internet Keep Safe Coalition and industry.

A national tea party group is asking for permission to keep their donors secret — just like the socialists.

Citing a long litany of harassment examples, the Tea Party Leadership Fund is asking the Federal Election Commission for the same right granted to the Socialist Workers Party to shield the names and information of their donors from the public.

In a new request to the FEC shared with POLITICO, the group argues that tea party donors and activists are being targeted for harassment by government officials and private groups — and they cite derogatory comments by politicians and overbearing government investigations as evidence.

“Nobody likes the communists and really for good reason,” said Dan Backer, the attorney for the group who wrote and filed the complaint. But, Backer said, the same legal principle that grants left-wring groups the right to hide their donors should also cover tea party groups.

“As we very thoroughly document at almost three times the length of the socialist request, tea party supporters are subject to an unprecedented level of harassment and abuse,” Backer said.

If the tea party request is granted, the decision could open the floodgates to outside groups, candidates and political parties who want to hide their donors with the government’s blessing.

“This will be the beginning of a conversation about the burdens and the perils of disclosure,” Backer predicted.
