Дохлое дело. Сколько уже было таких "полиций", и где они  Пиратство будет жить и процветать. Пора бы производителям контента вместо вкачивания бабла в слепую борьбу научиться работать с сетевыми технологиями и при грамотном позиционировании продукта "пиратство" будет не вредом, а бесплатным маркетингом. Сколько? Приведете примеры? Вы также за распространение контрафакта, в том числе и лекарственных препаратов? Вы прямо все в кучу смешали) Борьбой с безобидным онлайн пиратством и борьбой с контрафактом занимаются разные службы. И последствия разные - в первом случае страдают воспаленные мозги "правообладателей", во-втором случае речь идет об угрозе жизням тех, кто употребляет контрафакт. Так что ничерта Вы не смыслите, а еще ICO проводите). "Матчасть учите!", как говорят некоторые. Вы не цепляйтесь за что то одно, игнорируя другое, и сразу все станет на свои места. Мы не смешиваем, а создаем проект, который направлен на выявление и устранение, как контрафакта, так и пиратства. Уделите нам время, почитайте WP, поймете, что мы не только "Матчасть знаем", как говорят некоторые. После того, как будет тонна фейковых жалоб, производители перестанут обращать внимание, так как разгребать эти жалобы станет себе дороже. Те же копии брендов продаются вполне себе открыто, никто их не трогают. Просто дают на руку и на них закрывают глаза. Многие специально покупают себе подделки, чтобы не платить за оригинал. Чтобы система работала ее нужно внедрять в масштабах государств. Если в Вашей сети будет несколько сотен или даже тысяч человек, то это будет каплей в море. Жалоба не может быть фейковой, при наличии факта. Факты у каждого свои. Вот мне показалось, что этот продукт поддельный - взял и накатал жалобу. А там пусть разбираются. На деле это будет просто борьба с ветряными мельницами. И поджимают слегка хвосты мошенники, процесс идет. Работают технологии.
Да ни уж то) Живут и процветают. Моя знакомая рассказывала, что в Европе, если ты зайдешь в магазин Луи Вьютон с поддельной сумкой, то они вызывают полицию. Не знаю, инфа сотка или нет, но похоже на правду. Для Европы и США, данный проект имеет место быть, у нас же в СНГ ситуация несколько запутанней... А мне, например, приходит по емайлу предложение что то купить, например тренинг или фильм. потом за символическую плату сообщают приватную ссылку для скачивания и всё. Что я в этом случае должен зафиксировать? Если я конечно захочу подзаработать на этом деле, а не посмотреть фильм почти на халяву. Обезличенность - относительна. Регистратор доменного имени или хостер, знают собственника в 95% случаев. Будет ли Правообладатель ориентироваться на получение штрафа или компенсации, это второй вопрос, мы начинаем с первого - формализация и устранение. Вы должны зафиксировать то, что будет указано в конкретной заявке Правообладателем. К примеру сделать скрин страницы на который размещен нелегальный контент или который содержит лого правообладателя. Вот интересно, через какие инстанции будут проводиться карательные мероприятия для нарушителя, если домен зареган в Зимбабве, например? Или Гаагский суд в помощь? Смотрите, если домен зарегистрирован в Зимбабве, то у него есть доменный регистратор, который подчиняется закону той или иной страны, к примеру, так же Зимбабве. В Зимбабве есть свой порядок выявления и устранения, регламентированный местным законодательством. Именно по нему и будет проводиться работа по устранению нарушения. Гаагский трибунал - хорош, но здесь не имеет отношения Но какова вероятность того, что нарушитель понесет наказание? Как вы сами знаете на территории стран СНГ борьба с пиратством на уровне зародыша Например у нас в Украине я не слышал прецедентов реальных судебных разбирательств на почве нарушения прав интеллектуальной собственности! Это ведь далеко не первый проект который нацелен на борьбу с подобными видами нарушений ? Из тех которые закончили айсио что-то пока ни один не на слуху. На форуме по крайней мере не видно активности в тех ветках. Желаем чтобы у вас все получилось не так как у предшественников.
С подобным подходом и с методами решения проблемы - первый. Мы устраняем как онлайн, так и оффлайн нарушения. Боремся, как с пиратством, так и с контрафактом. И самое главное, что делаем это совместно с потребителями, которые замотивированы больше, чем когда либо! Т.е. существуют схожие по принципу проекты? В чем ваше преимущество над конкурентами? В целом проект очень интересный, буду продолжать следить. |
