姚某现年41岁，系长沙某装饰公司在华强项目部的结算员。2012年8月26日上午，26岁的被害人胡某某来到该项目部应聘，姚某负责接待面试，并对胡某某产生了好感。

当日晚上，该公司老板请新老员工吃饭。胡某某、姚某等几个同事一起在株洲市某饭店聚餐，后又到KTV唱歌，23时许散场，胡某某因无车回市区，便与同事们回到项目部办公场所休息，随后其他同事陆续回家只剩下胡某某和姚某两人。

姚某将胡某某安排在一楼办公室与厨房之间的通道房住宿，自己则准备住在一楼客厅进门左侧靠内的小办公室。两人相继洗完澡后，姚某出于好感，便来到通道房向胡某某表白想追求其作女友，胡某某当即拒绝，姚某仍继续纠缠。

胡某某试图离开房间，姚某遂萌生通过发生性关系来达到胡某某答应其追求的意图，便上前抱住胡某某，将其推倒在小办公室内事先铺好的地铺上，并用身体压住胡某某。胡某某奋力反抗，姚某便又坐在胡某某腿上，一边言语纠缠，一边强行脱胡某某的衣裤。胡某某虽奋力挣扎并以死相胁，但因体力不支，被姚某强行与之发生性关系。

随后姚某逃离现场。公安机关于2017年10月24日在广东省佛山市将姚某抓获，姚某到案后如实交代自己强奸的意图和过程。法院鉴于其认罪态度较好，遂作出上述判决。
