Pretty sure the answer is yes.  I would check the fightalpha site and go through this thread carefully.  They will not make it easy, but the logic to try is that others were granted refunds well past pay pals deadline.  Gather what evidence you can, including  coindesk articles and bitpay severing ties.  If none of that works, file bbb complaint.  May work out if you keep pounding at them and refuse to take no for an answer.

They'll say it's past some timeframe, as did my cc company, but simply this was a pre-paid item, you had no way of knowing there was a problem until after that period had expired.  Also do not forget to document their issues with consumer law in the UK.  Go back through this thread for details on that.

they've said on their forum that they have shipped all X-3's, and for people to contact them if they haven't gotten theirs for some reason.

no idea what's going on with the X-1's/1.5's, and people are not getting any help at all with miners that have malfunctioned, but you're likely right, they'll just go dark and let this slide away, hope to rework some scam in some other way maybe.....

If people should be suing anyone they should be suing Black Arrow and Alex Sovu, who through his account on this forum and theirs made promise after promise to get people's money and then broke them one right after the next.  As long as you're going to be in the US for this Alex, would you care to take up these consumer issues in US District Court I wonder or would you still like to hide behind Hong Kong law, scum-ball.....

that this was not the first stop on this joyride is my guess also and it seems logical that this issue of refunds could be some of it at least.   MS has given some, I think they were refunding out of pocket at one point because BA was refusing, although I don't know that for sure.  BA has totally refused any refunds after months of saying they would, making one lame excuse after another to delay them (please wait, everyone is busy building miners, we'll issue them as soon as we catch up) and then simply denying them altogether, deleting the refund thread on their own site that they themselves started and have proceeded to try to jam this junk on people ever since.

It would be very much like BA and Alex in particular to misrepresent the situation and try to lay total blame on the other party.  It's what they done all along through all of this.  A year late, miners that start on fire, major quality issues and on and on and on, and yet none of it is their fault.  We seen the suppliers blamed, the customers were berated for pushing too hard resulting in no testing or removal of defective components and miners that burned.  At one point it was the shipper's fault.  They were making people pay shipping to send these defective components back.   Never was/is anything the fault of the people actually running this mess. 

And yes, I have little doubt these guys were/are running a mine.  First they said the datacenter was ready, then it didn't exist, then you could pay their "partner" (who has never been identified) for hosting (for a fee of course).  sure they had X-3's to deliver now, even they can't use them any longer- it is the stereotypical scam in this business.  Take the customer's money, mine them until they're useless and then ship them out.   

They've been so totally devoid of ethics of any kind, this latest issue with MS just being the latest example, that it is clear they have none.   If they could have been running a mine, they have been.  I have little doubt about that.

I think there's a lot more going on here than those assholes at Black Arrow are telling people.   

In the meantime they've justified, based on their word only without any supporting evidence whatsoever being offered, fucking MS customers and totally cutting them loose.  That they would do THAT is something I do believe, as these people have proven nothing if not that they will fuck people whenever and however possible.

That isn't true actually.  I don't want your money but in any action regarding your transaction you are still the person of record and you are the person who would have to sign any documents and be paid.

If that's CC or paypal it goes back to you.

If it's via court you are still the plaintiff.

Handle it that way and they have to trust you not the other way around.

yeah,  I think I filed my stuff near the end of June, took a month or two to get it done.

those that paid via CC or PayPal may still have a viable shot, others will be fighting over a rapidly dwindling pool of resources, more than likely.

on the other hand, I'd probably still file.  nothing to lose.   few bucks in court fees to kick them in the balls would be worth it to me.
