Therefore, financial services companies—like the one which attempted to register the mark—shouldn’t be able to do register a ‘bitcoin’ mark. Finally, the Bitcoin community always has the option to register the mark itself, but this seems to be counter to the regulatory hands-off approach the community appears to possess. On top of that, such a registration may more readily expose Bitcoin to regulatory oversight by the likes of the SEC or other government agencies."



That is old news from July 15th, 2011.  Smiley At the moment, the Bitcoin trademark has already been successfully registered in a number of countries. Feel free to google it yourself.  Smiley

But like I said, whatever the community decides, I'll go along with it. Do I have any other choice?  Smiley

Bitcoin is a trademarked Logo. Did you get that part?

TOKYO, JAPAN - October 14, 2011 - As the owner of the largest Bitcoin trading platform, Mt.Gox, we at Tibanne K.K feel obliged to step up and oppose opportunists around the world from trademarking the concept and term “Bitcoin”, which would severely limit the ability of those in the Bitcoin community to freely enjoy and use our beloved Crypto-currency.

As some in the community may be aware, back in July Michael Pascazi, a law attorney in upstate New York started to file for ownership of the Bitcoin trademark. This took place not only in the US but in other key countries like France and Japan where trademark laws favour the party who is “first-to-file”, rather than the first actual user of the term.

While Michael Pascazi apparently acquiesced in his attempt to trademark Bitcoin in the U.S. (thanks to a stricter “first-to-use” trademarking system), he has since submitted a claim in France through his wife Celine Mouchon Pascazi, where Pascazi has far stronger legal standing as the first entity to apply.

In reaction, we at Tibanne K.K in Japan have started legal proceedings in the hopes of opposing this filing in France, at a European level as well as in in other countries across the world.

The Pascazis' stated intention is to profit from these trademarks, which would hamper Bitcoin enthusiasts, businesses and the community as a whole on a global basis in the free use and promotion of Bitcoin. Tibanne K.K will oppose this and any other "greed based" trademark application, in order to prevent self-serving attempts to profit from Bitcoin through spurious legal suits, and keep the term “Bitcoin” free for all.

We would like to use this opportunity to formally announce that all trademarks related to the term “Bitcoin” filed for and obtained by Tibanne K.K will be made freely available to anyone to use for whatever purpose whatsoever, whether that be for non-profit or commercial endeavours.

We will keep you apprised on these matters as soon as updates become available.

You can become 'legal' when you have the need for it.
I agree - right now there isn't really a need.
building a qora franchise is your biggest "protection" against other people trying to trademark and enjoy qora reputation in cryptocurrency.

I can go along with that.. If that is what the community wants, that's what the community gets..

What do you think Bitcoin Foundation is?  It's a Fantasy organization run by a bunch of anonymous hackers?

If a crypto is ever to become accepted by the mainstream, it has be led by a group of people with real business background.  Smiley

My only goal and dream is to make Qora as big as Bitcoin. I'm sorry that you don't share my vision.

I cannot argue with someone who is not well-schooled and lack common knowledge.

This is nonsense, do you think Bitcoin is a logo? Its a protocol that no one controls, that's the whole point. No one can fool anyone, its in the public domain.


I'm sorry but when I see people crawl out from under rocks on this forum calling for regulation and legal frameworks so we can be as 'good' as the real financial world I say BS.

I personally would prefer you not only drop the notion but also that you leave the 'foundation' I'm sounding harsh but I don't trust someone who sounds like someone trying to strangle a project about freedom with legality at such an early stage as well. I feel like you acting like a Financial Lawyer on steroids with a suspicious agenda.


Bottom line if something is owned and can be pinned down a government of large money interest can buy it and control its use.

That's correct.  Smiley  Qora is not simply a piece of software, it is also a brand, a name. We also need to protect the name from being stolen. (Like what happened to Bitcoin trademark in UK, it took bitcoin foundation a while to get it sorted out).

Look, if you guys are all against it, I'll drop the issue. No problem.

But I can tell you, as someone who has experience running a corporation and conducting business in the real world, making everything legal on paper is a necessity.

I understand that in the Crypto Community, most people are simply coders and programmers who don't hold MBAs and no experience doing business in the real world, and that is fine.

Let me say that, if a Crypto is ever to become accepted by the mainstream (ie. Bitcoin), something like Bitcoin Foundation will need to be formed at some point.  Remember that, you cannot hide behind your monitors forever.  Smiley

legal foundation smells of decentralisation to me. I mean if you copyright something etc somewhere someone down the line needs to have their real name slapped on it.


Trademark & software patents are two different things. I'm not advocating that we apply for software patents on behalf of Qora. (Most people in Tech community are against it, so am I). 

I'm saying that at some point, we need to have something like Bitcoin Foundation (a legal structure) in order to defend the integrity of the Qora project. The sooner, the better.

In the business world, people plan ahead in order to avoid potential conflicts and legal hassle/issue. Qora is a popular and good name. What if tomorrow, a company like Google or Apple trademark the name "Qora" to be the official name of a new line of products?

It will instantly become illegal for us to use QORA in any publication.  You guys don't realize it yet, but they can sue us for promoting QORA if they're the rightful owner of the trademark.

So the bottom line is - Qora software, like Bitcoin, will remain decentralized, anyone can dev or do anything to it.  But a legal foundation must be set up to defend it in the real world. Yes, some people need to come out and put their real names down on paper in order for it to happen (I've got no problem with that).  But to me, it's a step we need to take at some point.

It sounds reasonable but having a legal orgazisation for a decentralized currency is kinda odd.

Difficult to say.
You can become 'legal' when you have the need for it.

That is why I was asking you to become a member of the foundation (if it is ever created), because you're the owner and creator of qora project. You need to take possession of it in a legal way.

I wish to make my thinking and reasoning clear to everyone --

The software component of the project (qora protocol, server, client and so forth) will forever remain decentralized.. At some point, the source code will be released to the wild. It will be picked up and examined by people around the world. And maybe at some point, we will see Qora clone, and that is fine.  Smiley

But think about this for a moment -- What if in the near future, someone in UK or Russia obtains a copy of qora source code, register a trademark for the name "Qora" in UK, and start marketing qora as his own product. What are we going to do then?  Smiley

That is the sole purpose of Bitcoin Foundation. A lot of people in this community probably doesn't realize "Bitcoin Foundation" is not just a name on paper, but it's a legal structure. It's a legal structure created to defend the integrity of the Bitcoin Project (so no one can steal Bitcoin name and claim to be their own).

That's why I'm advocating that we have some sort of legal foundation at some point. As I mentioned before, people fail to realize a lot of legal problems can arise in later stages. When I mentioned "asset," people automatically think of it as money  Smiley  That's understandable..  Smiley

But to people in the business world, asset can mean a lot of things (real estate, business name,trademark, patent, DBA.. etc). In this case, I'm talking about trademarking the name QORA in respective countries and regions (it will become an asset owned by foundation).

Also, last night, a member donated the name qoratalk.org to the qora community.  Who is going to take possession of it?  A legal structure like foundation will solve that problem.

We need to do things by the book in a legal manner to avoid potential conflict later.

Let's keep the dev out of this boring organizing stuff. His voice and his will is heard no matter what, if he's a member or any committees or not. There will be dev and infrastructure committees later. Do you want him be part of all of them?

I concur and I understand.  Smiley  dzarmush is right.  Organizing this stuff is going to take a lot of time.  Hopefully, we'll be ready before qora is listed on any exchange.

Would you consider becoming a member in our newly formed committee?  I think I represent everyone here when I say we'd be honor to have you as the head of the committee (or at least be an advisor to us).

I really hope that you don't think we're out of bounds here for organizing a committee without consulting with you first. If you have any suggestion or objection to anything we're doing, I'd appreciate if you could share it with us.

Thanks for all the hard work you put into the project.

Over the last days I have had a lot of pm's about the same issues.
What I am planning to do is create a private repository with a public bug tracker to which everyone will have access.
This will allow for better bug tracking and to give a better overview on what is being developed.

I have been trying to follow the discussions on qora.club. It is up to the community to decide where they want to discuss certain things.
I will follow the majority of the community.
If you have certain questions it is best to pm me.
I will not be able to keep following every discussion once the community grows bigger.

As you probably now I have no intention do promote or market this currency at the early stages.
However I can not or will stop others from doing this.

I think a lot of people in this community are used to doing things in a amateurish way, but they fail to realize a lot of legal problems can arise in later stages.

For instance, in UK, a man tried to register a trademark for Bitcoin...

We need to prevent that from happening by acting first.  Setting up a legal foundation is a good option.

By having a legal foundation, we can move all assets (ie. domain names, trademark) under one umbrella.

That's what I was talking about..

What is the problem? We have domain names like qoratalk.org, who is going to hold it?  We need a legal structure to hold stuff like this right?

Also, although software cannot be patented, the name qora can be trademarked. I think we should set up a foundation and move everything under it.

I didn't want to gather the fund right now because in this case we'd need a treasurer and I remember days and days of discussions who will keep the funds in Nxt. But then suddenly everybody voted for TwinWinNerD without any arguments so it's fine. We need a fund address from him where everybody could send donations.

Qora dev will be responsible for core development, yes. He's in charge, so I'd say we need at least his opinion on every important issue. Whether it's time or not to develop a mobile wallet/web wallet etc. Of course anybody can do his own wallet, but there will be only one "official" desktop wallet/mobile wallet/web wallet and all of that stuff will be developed on dev fund money.


So TwinWindNerD is still the treasurer for NXT?  That's good to know.  Smiley  In that case, could you, TwinWind provides us an official QORA fund address so we can start sending donations to you?

Also, could you guys send in your applications to make your membership official?

People don't understand there will be lots of benefits for joining the committee (free healthcare excluded)...

I am thinking we should hold weekly party (maybe in ChiIraq, courtesy of the marketing fund), trips on private jet.. etc
We will have a good time, and we'll visit each member's hometown.. Best yet, we'll be partying til we drop!

Jokes aside, I've really got a lot of plans for the committee. I'm hoping we can make it legal (register it legally).  The legal structure will be able to hold assets and apply for trademark/patents. I've had experience running a business, so it's kind of right up my alley.

What do you think we can do to bring awareness to the committee?  Should we send out individual invites?  I wish the dev can move the announcement to first page so it doesn't get buried. Has DEV shown up today?

Actually, that's what I was thinking too.  I was thinking along the same line.  If we set up a dev fund and contribute to it, we can have someone from outside dev for GUI for instance, but I think dzarmush was against setting up a dev fund. And qora dev will be responsible for core development... So there is no conflict.

What's your thinking on this, dzar? care to share some insight with us?



The main area of focus should be getting a talented person with a good sized bounty to create an awesome web wallet (it's crucial in my mind) and also a decent looking blockchain, nothing amateur, whoever did the NXT blockchain should be scouted and funded.
I guess my point is get the best we can pay for, no amateur hour stuff whatever is decided to be done.

This is critical - Nxt blockchain dev was contacted but unavailable. NHZ crew were also contacted...any word from them? The qora community should spend what it takes via bounties or converted btc/fiat for devs outside crypto to develop the best, most cutting edge of what has been done to date. It will be worth the cost. And this is why the dev fund is so important.

That's awesome! On behalf of the qora community, I'd like to thank you for your generosity.  Grin  eyd_li1 has a site up (qora.club). is it possible to forward all visitors to qoratalk.org to qora.club for now?

In any case, I believe dzarmush or eyd_li1 is in charge of web development. Or maybe the dev might have some use for it. I don't know.

The recipient probably need to delete the data folder and redownload the blockchain again.
