My group purchased 2 x 400GH Bitfury AUGUST DELIVERY mining rigs.

Bitfury is currently slated to begin shipment in August. We are placing both pre-orders for immediate sale.

Price starts at 250 BTC each and increments by 1 BTC per bid thereafter. Bidding will cease at 11 am Central Time (GMT -6) on Saturday, August 3rd, 2013. We offer a BUY IT NOW price of 500 BTC each in case you really don't want to risk not getting these AUGUST DELIVERY pre-orders.

Terms:

We agree to 100% escrow with John K. (or equal) if the conditions for release of the escrow do not include waiting for physical delivery of the unit to the buyer. If physical delivery of the unit were required, we might as well wait and sell at an "equipment in hand" price.

We consider the conditions for release of the escrow to include third party verification:[/color]
  • of seller control of the Bitfury pre-order account,
  • of the Bitfury pre-order information and payment,
  • that reasonable control of the Bitfury pre-order accounts was shared/turned over to the buyer (within MEGABIGPOWER policy limits).

A 5% escrow retainage would be acceptable to ensure that the seller has assisted the buyer in having the equipment delivered to the buyer either directly or by immediate reshipment. This final escrow retainage would be released upon proof of shipping dispatch to buyer.

In case of reshipment, seller would consult buyer for instructions. Cost for reshipment (unless buyer uses BUY IT NOW where shipping costs are free) and any applicable taxes, duties, or customs clearance fees would be borne by buyer.

Mining Option: In the unlikely event that you don't want to mine, we pay low electrical rate, and would only charge about $4/day for hosting each unit at our facility.

Shipping: Buyer will pay shipping at cost plus insurance (payable in BTC to seller). This will be mutually agreed at time of re-shipment to your satisfaction. If buyer uses BUY IT NOW pricing, priority express shipping is free.

Fees: All escrow fees will be born by seller. A reputable escrow company (like John K.) would need to be utilized. We are willing to provide full disclosure details to any escrow company to verify our purchase details as necessary to allow you to bid with confidence.

Delivery: Bitfury has stated repeatedly stated that shipping begins in August. Our order numbers are very low and in combination would ship in first dispatch lot.

Q: Why wouldn't you accept 100% escrow?

A:  The down payment clause was instituted to ensure that the buyer has sufficient
     commercial incentive to complete the transaction. The down payment amount is
     negotiable to the satisfaction of both parties.

What do you think about the chances they will charge everything on BTCT as illigal investment offerings?

I think they are pretty good, actually.  From the attendant Investor Alert:

"the fraud may also involve an unregistered offering or trading platform"

and, here's the real kicker:

"Any investment in securities in the United states remains subject to the jurisdiction of the SEC regardless of whether the investment is made in U.S. dollars or a virtual currency. In particular, individuals selling investments are typically subject to federal or state licensing requirements."

I have, of course, counseled my clients on this point for some time.  Looks like I was right.

Attention Unregistered Exchanges, Perpetual Mining Bonds (PMBs), REITs, and other members of the Bitcoin investment space: The SEC has explicitly indicated its intention to apply the already-existing laws to your security.  You are selling securities in violation of the Securities Laws.  Come into compliance, and do it quickly.

Yea the only thing I think that might be a saving grace is are any of these listed securities worth the SEC's time.

Roughly speaking, how would an exchange "come into compliance" quickly?

I guess we'll start to see in a few weeks..  I have the cost of a moderate house riding on KNC and the cost of a compact car riding on BitFury.  I bought a crapload of BFL stuff, too, but it's likely to be worthless by the time it's delivered.

I know that this argument has been done to death but if you really are putting that kind of capital into mining hardware you would be much better served just buying BTC on the dips and riding waves.
Mining profit potential will be decreasing drastically and we do not know if any vendor can even meet their deadlines. BTC profit potential is much greater with discipline and a good strategy. Just saying

What happened to the 1500Gh for $30k??  Aren't people still waiting for them?

It's still 1,500 GH/s for the $22K - it's 3x 500 GH/s units though instead of 1 so initially it seems that people are only receiving 1 unit at a time. I haven't seen anyone that's gotten their full mini-rig order.

Actually, it is now 500 GH/s for $22K. The original 1500GH/s for $30K buyers are getting
3 x 500's at the original price because BFL is honoring their hash rate commitment. There
are people who have received more than one 500GH/s rig already. It is based on their
order payment date position.
