In my opinion it's better to try to understand his situation, try to re-establish communication, and work with him on a plan that allows him to refund everyone.

unfortunately there is not too many people able to handle this situation the way you described..

hi all,

I communicated with agath yesterday evening via #btcfpga IRC channel and email, he sent me his signed contract with Tom and we agreed on coordinated complaint to Tom's bank (Woodforest TX). Right now I have found an email from him that he received a full refund yesterday evening.

I'm going to try contact Tom again, hope he will respond. If not, I will contact his bank and try everything possible to get my money back.

I do not think Tom is a scammer, but the way how he communicate with his customers is definitely bad.

Tom - if you read this, please do a simple thing - just communicate! Anyone can get into trouble and I personally can understand that and agree on how to resolve the situation.

Agath - congratulations a I hope everyone will have such luck as you Smiley

if there is any coordinated action from EU citizens against BTCFPGA I will participate on it. Order #1438, $8,589, paid via wire transfer, no refund yet. I ran out of patience.

I'm also finding it odd that the btcfpga forums only have 118 members, and they are supposed to be one of the only 3? companies about to drop revolutionary device. I'm not saying scam,  but a few things seem, lets say, "off".

It does not mean anything. I have preordered 8 bASIC units from Tom and I have no account on his new forum. All questions important for me in this stage have been already answered (both via this forum or via direct communication with Tom).

that barely adds up to 200THash, which is about 10 times the current network rate, and if difficulty goes up by a factor of ten using the same formula above. your ROI is 156 days.

honestly, it isn't that bad.

this would be true only in the case that the difficulty will remain unchanged for 5 months, and you know that it will not Smiley

real ROI will be, at best, somewhere at 8 months.

I wonder if anyone has tried to pay BTC to the government for their taxes on a purchase made with and invoiced as BTC

I think that price on invoice will be listed also in USD or other "regular" currency, otherwise it did not pass through customs.

I think they have no idea what is ASIC or Bitcoin, they will handle with it as with regular computer hardware.

For example this one would be suitable:

Processors and controllers, whether or not combined with memories, converters, logic circuits, amplifiers, clock and timing circuits, or other circuits

My card keeps getting declined from the BTCFPGA website. Is it because Tom is switching to the new site or is it something else?

probably yes, he stated that during site switchover he will disable ordering to keep database consistent

@benco: seriously, you would go and fill out a tax declaration and pay almost a quarter of the amount to your state at your time expense and frustration ? I'm not saying you shouldn't but would you ? Seriously that would be my last thought and I wouldn't go pay it, unless the tax man comes to my door and fills in all the papers or sends me by email with everything already filled out. Its their duty, not mine to waste my time to fill out their forms. First you'd go to your local Fiscal Administration waste couple of hours, then you go in line to the local Treasury and effectively pay the VAT.. sounds like 1-2 days wasted to give your state money for a product that is build outside of your state and for which they have no contribution ?

I will install the miner in 19" cases with 4HE, so the height is important for me.  Wink

Is there anything special for EU customers? You only have to pay VAT and some import fees depending on country (for me is 20% VAT + up to 5% import fee), thats all. Am I missing something?

Seriously.. some people need to shut the fack and grow the fack up.  All I'm hearing/seeing is this:

People Type A complains how there are no information about BFL or how they're not transparent enough with their business practices.
BFL releases information on 3D CAD designs for upcoming ASIC protoypes. -> People Type A retorts back saying those are just computer generated images and BFL is a SCAM.
BFL releases information on ASIC production machines -> People Type A retorts back how those can be ovens or machines to make other stuff (conspiracy theories).. and BFL is a SCAM
BFL releases information on ACTUAL real-life ASIC prototype boards as of their most recent news. -> People Type A still continues to bitch about it and says BFL is a SCAM

it's mainly because of unclear BFL backgroud (their CEO of CTO or who actually is he) and also because of big differences in promised and real power consumption of their FPGA based miners..

I swear by the time BFL actually SHIPS the products out, people will still continue to find a way to bitch.  I'm not saying BFL isn't a scam but neither am I saying it is.. all I'm saying is I'm growing weary everytime I read complaints about BFL this and that.  Besides, for those who didn't pre-order their Jallies or Singles.. WHY ARE YOU BITCHING ABOUT SOMETHING YOU NEVER INVESTED IN?  I placed a pre-order in the start but decided to pull out.. BFL refunded me promptly.  That was my decision based on my own due-diligence.  If you didn't place a pre-order, you shouldn't be bitching about anything IMO.  Yes, it's just my IMO and my words can't hurt you.

Geez people.. SERIOUSLY! >=/

it's not only about 'pre-order or not to pre-order'..Can you imagine what would happen if one of the ASIC miner vendors was a real crook and stole hundreds of thousands or millions of USD? I think Bitcoin really does not need another mega fuckup in his short history..Only we can do here is: Ask, ask, ask..and get relevant feedback..

BFL seems to be a leader in ASIC based miners development (OK, they were first who announced these toys) and I would personally expect completely different marketing strategy they actually use - especially PR since what BFL_Josh / Inaba is doing here is a pure disaster..

If I had to bet on anyone delivering ASIC it would be BFL as they are way ahead of anyone else on delivering bitcoin consumer products.

They've got the most convincing photos and should have machine capacity for 900 units per day.

That should burn through pre-orders quickly, so I'm just gonna sit tight and wait for the thing to be in stock.

OK, it depend on what do you mean under 'profitable', since with this difficulty the ROI for Jalapeno is 12+ months (without electricity costs) and this applies only in case if difficulty stays at this level and will not increase.. 12 months is too much, have you any idea how fast and energy efficient ASICs will be on market at the end of 2013? after 6 months on the market Japalenos will be good only as a paperweight Smiley

IF that $14.7 Million was re-invested in ASICs at a 1:1 ratio

The new network Hash Rate would be 676 Th = 27x

please take into consideration that not everyone bought GPU for mining, there is a lot of people who bought GPU for common usage and use them also for mining..

in case of 676Th hashrate Ebay will be full of Jalapenos as soon as their owners realize that they will mine nothing with them Smiley even the 60Gh Single is non-profitable in this case..

That's true, but I really would like to know in advance, what should I do when $30k device stop working and I will not know, how long I have to wait for repair and how much will it cost (after warranty expiration).   Smiley
