I don't see a problem with it as long as he isn't actively impersonating him.

The only problem is if there is a copyright on that picture and the copyright owner objects to the use of that picture.

I have seen him post somewhere in some signature campaign thread, got me confused for a second, but he's doing no harm.
It's not like someone has the copyrights for their avatar.
