You'll note that the IIHS is a privately funded, privately run, non-profit organization, much like Underwriter's Labs. No government regulation created it, and it holds no regulatory power.

But car manufacturers listen to it, and it has made the highways much safer than any law ever did. (And tests more stringently than the NHTSA.)
