As you may know, XYO token ended with the company screwing all their investors by "allocating" another token sale out of their arses.
Part of the PR spin includes a claim that they will provide a refund to those who ask for it. 

Well I asked for it and have not yet received it.   I want to know:  Did you ask for a refund?  Did you get your eth back yet?

wow is this really true? i have been researching about this project and this is number one in the ICO rating. One of the best and good ICO in 2018 but how come it fails? Well this is cryptocurrency one of the risk that could possibly crossed in your path would be the ones of like this. Anyway though there are risk but the ICO investment is worth risking for since we could earn also relatively huge amount from its bonuses and discounts.

You are very inded a newbie you should post this in speculation but qst you must not conclude it as an scam you should investagate or do more. Why base on your post you kind a got scammed and anskung questions that yiu should atlest try but I am not being harsh here yes you are a newbie and asking everything as all it is a yes for me try to talk to someone you got to invest or gave money ask for a refund if no money returned you go post it at speculations and say it is a 100% scam if you wait musch more longer or no replies.

XYOs ico is a prime example and warning for "Pay to Win" ICOs.

Isn't it obvious by now that you can not trust the ratings on ICO ratings sites?
Isn't it obvious that XYO pumped TONS of money into advertising and getting good reviews on ICO ratings sites?

And still in the end, they didn't do well.
This is a great sign that the ICO crowd is growing up and being smarter about what they invest in.

A company suddenly just doing another round of ICO and generating new tokens is a MAJOR red flag.
If you invested, I highly recommend you ask for a refund.

Take that money you put into XYO and put it into something else.
Since the market is down, instead of doing another ico, look into recently finished ICOs that have been listed and the price has gone below ICO price.

For example, Daostack (whose public crowdsale sold out in like 2 minutes) is at or below ico price, a terrific bargain for a substantial company with the tech to allow full Decentralized Governance.

The problem is they are not making you whole.  They are giving you USD at the value of the time of purchase.    I want my Ether back. 
Now I am thinking legal action.
