No, it definitely doesn't encourage the illegal activities. But illegal activities find it's way as the transaction occurs anonymously here. Steps need to be taken to abort this kind of activity.

Indeed it does. Because the users are anonymous, it makes it hard to track down the owners. This has led to people to take unfair advantage of it, and they end up scamming people. But if one is smart he/she will be able to track the IP address, even a simple email id can help too.
