Poloniex account hacked

My Poloniex account was hacked back in 2017 and 7 btc were stolen. I did not have 2FA at that time and the hacker got to my account and traded those coins away.

However, 2 Russians were Indicted and US law enforcement seized some cash and currencies. From news source "Millions of dollars in virtual currency and dollars have since been seized by US authorities."

I am still chasing poloniex and they keep telling me that my account was compromised and they are still investigating to see if my funds can be recovered. But its been more than 3 years now.

My question is, can I take Poloniex to court? how can i get my funds back from US law enforcement given they have seized some funds.

This would depend on how exactly your account was hacked, was it a breach due to an error on your end or was it from poloniex server. If it was from your end then suing them would likely not yield much. Such services use their ToS to indemnify themselves in such situations, one of such terms on Poloniex;

Polo will not be liable for any loss or damage arising from your failure to protect your Account or your User information.

If your funds were stolen from the indicted scammers, then you should consider seeking professional legal advice on the next steps to take.

Since 2017 is a long time and enough for poloniex to address the issue if they has wanted to, like what upgraded00 already said, depending on where the fault of hack came from, if this is from you for any other reason besid 2fa then I doubt the exchange will be paying for any damages that was no fault of them,

What I don't get is, was it because of your hacked account alone the 2 Russians where indicted by the US law enforcement or there were other hacked account involved, if that is the case I don't think the fault is from you, except I did not fully understand it.

How did you make the conclusion that it was hacked? Because Poloniex assured you or some incident that let you to realized that it was hacked? I guess this is important.

You better need to talk to a lawyer who has experience of dealing cryptocurrency cases. A lawyer with no online experience will not understand your case.

First of all I'm really sorry to hear such thing and hope you get your money back soon.
Also, please give us more information about how exactly this happened to your account. Sometimes a hacker find and exploit on an exchange or the db side of the exchange and they will hack many accounts in same time, in this case it's all because of the Poloniex, because they didn't provide the security for the users. In short words they are guilty because lacks of security and they definitely should pay back the money to the users.
But sometimes it's all your fault because you chose and easy password and didn't activate the 2fa, in this case the can say your account your responsibility and don't pay you a penny for all the bitcoins you lost. Unfortunately, after signup the users won't read the tos and just accept everything, the ToS will be useful for Poloniex and even if you take them to the court you won't have too much chance.
Here I would recommend you to start seeking for the hacker(s), you can also ask Poloniex for help maybe they can give you transaction information to find the hacker.

In this case i am not showing enough light for your issue and sorry to say that this is why exchange authority is giving you only hope for last three years. Based on poloniex TOS about account protection its account owners responsibility to protect his information and they will not take the responsibility in this case.

I don't want to discourage you by telling that your chances of getting the fund back is so less but you can hire a lawyer from your local area and discuss with him about the incident but i don't know that crypto currency is accepted in your country or not.

In order to make a lawsuit to the law enforcement sector, I think you need to gather all the evidence of the transaction and evidence of pretext, for example traces of shipments made by hacking. because the number of bitcoins is not small, so you immediately have to collect various evidence that can make you strong in court.

If you read the news story it tells how the  guys who are now indicted in the US carried out the attack. Poloniex recognises the attack on my account. Please see the last email from pooniex below, its been goin on for 3 years now and they have still not fully investigated it: email from poloniex below:

Thanks for the message, we can see that the original attack on your account with the bad trades had occurred around 6th June 2017,

Please allow us time to review the information and conduct an investigation after which we can get back to you should we recover any assets on the attacker account.

Sorry with your loss and bad experience. Taking it into the court could cost you more than what you're trying to reclaim. I'm not an expert with disputes but if they are still investigating it for that long, it's hard to tell if they'll give you hope or even if you battle against it.
The result that I can see if you bring this to the court is that they'll give you attention because they seems to be not doing it right now and left you hanging.

Okay, here's some question of mine. How you can be so sure that those guys who had been caught are the ones who had attacked or hacked poloniex? If ever they are really the ones who do make such
hack then this would really be a big news but recovering those funds wont really be giving out 100% guarantee on taking it back.

Not to discourage you but this would be still on a hard situation yet recovery is less likely to happen.Poloniex support might responded about your query but on 3 years time which considered
a very long time but still havent able to resolved this case.

When it comes to crypto hacking where transactions are irreversible then its really hard to fight for on legal ways.You are just basically wasting off your time and effort
for paying up legal service where you dont even know if you do succeed or not.

I have a bad experience in this exchange as well I think the exchange was a complete scam I have an issue in 2FA back in 2019 in this exchange because I lost my phone at that time but going to the support was a nightmare and almost like trying to discourage you like it is already a lost account. The exchange was actually great back in 2017 but it was already pretty bad this day I access one of my accounts in the exchange because the bitcoin price is around 40k$ so I check it out but everything just disappears in my exchange wallet even though I can still see my transactions history in the exchanges but there was no history of withdrawal but the funds are gone.

You may want to see if there is a time limit on the time you can still sue.  Here in Alberta, Canada  we have 2 years to sue ,after the fact , in British Columbia Canada it's one year . Since your is a criminal matter it may be different, but worth checking out before spending money .

I guess you will have to start from here. Poloniex has sort of promised you that, so it will have to deliver. It is clear here that Poloniex told you by email that it will review the information and then conduct an investigation. It is therefore your right as a client to receive the results and findings of the said investigation. Poloniex owes it to you.

So start from there. Ask Poloniex what happened to that review and investigation. Ask them the result.
